HomeMy WebLinkAbout1971-09-22 I I I 173 Bozeman, Montana 22 September 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 22 September 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held 15 September 1971 were approved as read. Contract Documents, SID No. 503 - Diteman Construction Company for Execution: The Contract documents for the construction of water mains on North Seventh to North Fifth Avenue from Tamarack to Juniper Streets, SID No. 503 as awarded to Diteman Construction Company on the basis of their adjusted bid in the amount of $20,277.00 was presented. The City Manager re- commended that the Contract documents approved as to form by the City Attorney be approved. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the Contract documents be approved with the Change-Order and that the Mayor and the Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman and that Diteman Construction Company be authorized to proceed with the construction and that the pledge for bid security be returned to Ditemsn Construction Company and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer; those voting No, none. Plans & Specifications for Approval - HUD WSF-MT-08-00-00l7- SID No. 502: Plans and Specifications for approval - HUD WSF-MT-09-00-0017 for construction of Water Main Improvements in Special Improvement District No. 502, for the City of Bozeman_ Montana, were placed before the Commission. Following a discussion, it was moved by Commissioner Vollmer_ seconded by Commissioner Sedivy, that the plans and specifications be approved and that upon approval by the State Board of Health and the regional office of the Department of Housing and Urban Developments construction bids be called for and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Quit Claim Deed: For Execution to Corrrect Old Sewage Disposal Plant Site: (Co>,,,.,,, 'i',,~" h.'~ \ ,;, fl.;.", 1'1':; ) A Quit Claim Deed transferring and conveying to Lyn Nelson Taylor a strip of land 10.60 feet in width and 816.42 feet in length, lying 489.40 feet East and parallel to the West line of the Northeast one-quarter (NE\) of Section Six (6), Township Two (2) South, Range Six (6) East, Montana principal Meridian, Gallatin County, Montana, from the City of Bozeman was presented. The deed has been drawn to correct an error in property boundaries. Following a discussion, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind_ that the Quit Claim Deed be approved as recommended by the City Manager and that Resolution No. 1491 be passed and adopted authorizing the Mayor and Clerk of the Commission to execute the Quit Claim Deed transferring a strip land from the City of Bozeman to Lyn Nelson Taylor. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commiss- ioner Sedivy, and Mayor Langohr; those voting No, none. Commission Resolution No. 1488 - Assess Weed Abatement - $1,079.75: Resolution No. 1488 leving the assessment in the total amount of $1,079.75 for the extermination and removal of noxious weed for the y~ar 1971 was presented, entitled: COMMISSION RESOLUTION NO. 1488 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN LEVYING AND ASSESSING A SPECIAL ASSESSMENT OF TAXES UPON CERTAIN PROPERTIES IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA, TO DE- FRAY THE COST OF EXTERMINATION AND REMOVAL OF NOXIOUS WEEDS FOR THE YEAR 1971, PURSUANT TO THE PROVISIONS OF CHAPTER 6.50 OF THE BOZEMAN MUNICIPAL CODE. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the resolution be provisionally passed and adopted and 29 September be set as the date for public hearing. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commiss- ioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. -- 1~4 Application for HB42 & 436 Funds - Road Oil $2,320.19: An application for the purchase of road materials, equipment rental and labor from the Mont- ana State Highway Commission at an estimated cost of $2,320.19 to be paid from the Gas Tax Funds allocated to the City of Bozeman under provisions of House Bills No. 42 and 436 and complying with Rules and Regulations promulgated by the Montana State Highway Commission for administration of the Ace was presented. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the application be submitted to the Montana State Highway Commission as presented and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Comm- issioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Application for HB42 & 436 Funds - Kagy Boulevard $2,000.00: An application for the installation of an improved gravel surface (825' X 26' X 10') on a portion of Kagy Boulevard easterly approximately 825' at an estimated cost of $2,000.00 to be done by Gallatin County. Road Department and to be paid for from Gas Tax funds allocated to the City under provisions Extraordinary Session House Bill No. 42 & 436 and complying with Rules and Re- gulations promulgated by the Montana State Highway Commission for administration of the Act. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the application be sub- mitted to the Montana State Highway Department as presented above and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Curb Opening 2206 Spring Creek Drive: Bill Johnstone: A letter received from Bill Johnstone, 2206 Spring Creek Drive requesting zoning code variance from twenty-feet for a double car garage to two fourteen foot curb openings at a new residence at 2206 Spring Creek Drive. Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that they concur with the recommendation of theCity Engineer, also concurred in by the City Manager, and approve a twenty-eight foot curb cut variance for a double garage at the new residence located at 2206 Spring Creek Drive and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. Amendment to Annexation Agreement (Zoning) - Five C. Corporation: An amendment to the Annexation and Utility Agreement between the five C. Development, Inc., and the City of Bozeman, that Five C. Development, Inc., will have restrictive covenants requiring that all buildings erected on said lands comply with the zoning requirement chart in the City of Bozeman for a Class "B" residential district was presented. The Commission concurred with the Re- commendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the amendment to the Annexation Agreement be approved and the Mayor and Clerk of the Commission be authorized to sign the amendment and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Authorization to Purchase thirty 5/8 X 3/4" Water Meters - Approx;mately $1,000.00: The Water Department has a need for thirty 5/8" X 3/4" Water Meters at an approximate cost of $1,000.00 and the City Manager requested authority to purchase the meters. It was moved by Comm- issioner Grabow, seconded by Commissioner Lehrkind, that the City Manager be granted authority to purchase the water meters and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow and Mayor Langohr; those voting No, none. Reports: The following reports were presented. Cemetery Director of Finance The City Manager commented on the reports and recommended the approval thereof. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. I I I I Annexation Proposal: A proposal to annex an area adjacent to the present City Limits along North Rouse Avenue and Bridger Road was presented. Following an extensive discussion, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the City Manager instruct the City Engineer to proceed with the mapping of the proposed annexation and ascertain the exterior boundaries for zoning and present this plat to the City-County Planning Board for their recommendation. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Adjournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, Seconded by Commissioner Vollmer, that the meeting be adjourned.
