The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 7 July 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Comm-
issioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Frys1ie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 30 June 1971 were approved as read.
Hearing, Commission Resolution No. 1472 - Intent to Create SID No. 502:
Commission Resolution No. 1474 - Creating SID No. 502:
This was the time and place designated in Commission Resolution No. 1472 to hear protests to the
creation of Special Improvement District No. 502. Affidavit of publication of Notice and the Clerk's
mailing certificate stating that all property owners had been notified as required by law were presented.
The City Engineer presented written protests filed with the Clerk of the City Commission representing
1.1% of the proposed district.
Following a discussion and in concurrence with the recommendation of the City Manager also con-
curred in by the City Engineer, it was moved by Commissioner Grabow, seconded by Commissioner Lehr~
kind that the protests representing 1.1% of the proposed district be considered insufficient it
being less than 50% of the property within the proposed district. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Comm-
issioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none.

It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the resolution
be passed and adopted to creat Special Improvement District No. 502 and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer.
Commissioner Sedivy. Commissioner Grabow and Mayor Langohr; those voting No. none.
Jim Fisher Present to Discuss Installation of Sidewalk along Durston Road:
James R. Fisher was present in regard to installation of new sidewalks adjacent to his property
along Durston Road. The Commission assured Mr. Fisher that in view of the engineering problems that
are existing along Durston Road the deadline of 21 July 1971 for the installation of new sidewalks
would be extended and that the City will not authorize or direct the contractor to proceed with
the work of installing sidewalks until at least thirty days following the time upon which adequate
information can be provided.
Request to place Sidewalk Ad;acent to Curb - South Sixteenth Avenue - Hugh Reid:
A letter received from Hugh Reid of 1520 West College Street Requesting permission to install a
sidewalk adjacent to a curb on South Sixteenth Avenue was presented. The Commission delayed action
on Mr. Reid's request for a period of one week to go out and inspect the subject area.
Curb Installation - Main Street and Church Avenue:
A letter received from Don Lanphear, Chairman of the Board Rental Development Incorporated in
regard to installing new curbing on the corner of Church Avenue and Main Street was presented.
Following a thorough discussion. it was moved by Commissioner Lehrkind. seconded by Commissioner
Vollmer. that the request be denied and Rental Development Incorporated be instructed to replace
seventy-five lineal feet of curb and gutter on the corner of Church Avenue and Main Street. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Vollmer, Commissioner Grabow and Mayor Langohr; those voting No beingCommissioner Sedivy.
Request to Connect to City Utilities - Montana Industrial Development, Inc.:
Del Lichtenberg, Secretary of the Montana Industrial Development, Inc.. appeared before the
Commission to request permission to connect a fifty-two unit mobile home court located adjacent to
the Bridger View Mobile Home Court on Bridger Canyon Road to City utilities. The Commission acknow-
ledged receipt of the request and tabled the matter for additional study.
Request for Curb Opening - Grinwis, 511 West Peach Street:
The request of Mr. Ben Grinwis. 511 West Peach Street. to place a twenty foot curb opening at
his residence was presented for further action following an opportunity to individually view the
situation. After discussing the request at length. it was moved by Commissioner Vollmer, seconded
by Commissioner Sedivy. that the request be denied for the greater curb opening because it would be
in violation of our zoning code. specifically an off-street parking location in a portion of the
front yard located at 511 West Peach Street. The motion was carried by the following Aye and No vote:

Lehrkind and Mayor Langohr; those voting No, none.
Authority to Proceed with Soroptimist Park: Federal Grant Fund:
A federal grant of $4,000.00 to match local funds for the construction of the Soroptimist Park
has been approved by the Department of the Interior's Bureau of Outdoor Recreation.
Following a thorough discussion, it was moved by Commissioner Sedivy, seconded by Commissioner
Grabow. that the City proceed with the development of the Soroptimist Park. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Commissioner Grabow.
Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No. none.
Request to Conduct Baseball "Rally Day" 10 July 1971:
A letter received from Mrs. William Hunt. Parade Chairman for Little League Board requesting
permission to hold a baseball "Rally Day" parade on Saturday, 10 July 1971. at 10:00 o'clock A.M.
was presented. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that permiss-
ion to conduct the parade be approved and that provisions be made to avoid children from running in
the street and to avoid littering as a result of the refreshments. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Grabow. Commissioner Lehrkind, Comm-
issioner Vollmer. Commissioner Sedivy and Mayor Langohr; those voting No, none.
Jaycee Roundup Parade - 6:00 o'clock P.M.. 25 August 1971:
A letter received from the Jaycees requesting permission to hold a parade on Wednesday. 25 August
1971 at 6:00 o'clock p.m. to begin at buttrey's shopping center and proceed down Main Street to Church
Avenue was presented.

It was moved by Commissioner Lehrkind, seconded by Vollmer, that the request be granted and that
the Chief of Police be contacted so that proper protection can be provided and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer,
Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none.

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be instructed to issue
warrants in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, the the
claims be approved and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and
Mayor Langohr; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
