Municipal Building. 21 July 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow. Comm- issioner Lehrkind. Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 14 July 1971 were approved as read. Minutes of the special meeting held 19 July 1971 were approved as read. Request for Sign Code Variance - Bozeman Hotel: A request from Glen Worten representing the Bozeman Hotel for a sign code variance for the installation of a five foot canopy on the east side of the Bozeman Hotel was presented. Following a discussion, the City Manager concurred with the recommendation of the Building Inspector, that in accordance with Ordinance No. 855. Section 17.08.460 (2) (b) Bozeman Municipal Code. the awning may project not more than three feet over or into any required yard or court. It was moved by Comm- issioner Vollmer, seconded by Commissioner Sedivy. that the request for the Sign Code Variance for a five foot canopy located on the east side of the Bozeman Hotel be denied and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow. Commissioner Lehrkind and Mayor Langohr; those voting No, none. Bozeman Soroptimist Club Contribution to Park Fund: Mrs. Marguerite Good. President of the Bozeman Soroptimist Club appeared to present two checks to the City Commission. One check in the amount of $1,000.00 as a contribution toward their portion of the park of $4,000.00 to match the $4,000.00 grant from the Bureau of Outdoor Recreation for the development of the downtown Soroptimist Park. The second check for $10.00 was contributed toward the purchase and planting of a tree to commemorate departed charter member Alice Kleinschmidt. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow. that a letter be addressed to the Soroptimist Club acknowledging receipt of the contribution of $1,010.00 and that they express considerable gratitude and appreciation for the contribution and effort that the organization is investing in this project and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No. none. Bozeman Softball Association Proposal: Clayton Linebarger, pres(ent of the Bozeman Softball Association along with several members of the Bozeman Softball Association appeared before the Commission to comment on the softball complex proposal to be located on the Old Country Club property belonging to the City of Bozeman and bor- dering on Haggerty Lane. The proposal is for the construction of four ball fields in a fourleaf clover type design. The fields are to be separated by earth mounds which provide lighting and bleachers, underground water systems and a centrally located building to serve as a storage area, rest rooms, meeting room and central office. The complex is proposed to cover some fifteen acres. including the parking for approximately 500 cars with potential use as a multiple recreation fac- ility, summer and winter. The estimated cost of the complex is between 100.000 to 115.000 if all the work were contracted. However. the Softball Association plan to do much of the work themselves by volunteer help from the some 376 members of the Bozeman Softball Association and from the general public. A local contractor has agteed to contribute the moving of part of the fill dirt for the nine foot mounds. The possibility of sponsorship for certain portions of the complex was also discussed. The City Manager said that land which the group propose to use was purchased by the City partially with a federal grant and with certain stipulations as to future use. He also suggested the Commiss- ion should not give permission for the development without first discussing the proposal with the Cemetery Board, whichoontrols the land. He directed the City Attorney to find out what the legal position is on all the property and informed the group that a Cemetery Board meeting would be called. Following an extensive discussion. it was moved by Commissioner Grabow. seconded by Commissioner Lehrkind, that action on the Softball Complex proposal be delayed for a period of one week and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer. Commissioner Sedivy, Commissioner Langohw; those voting No. none. Authority to Purchase Water Meters - 3/4" & 2" - Approximately $1,600.00: The Water department has need for water mains and the City Manager requested authority to purchase thirty 3/4" and two 2" water meters in the approximate amount of $1.600.00. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the City Manager be granted authority :146 to purchase the water meters and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No. none. Request to Operate Concession Stand - Jaycees for Babe Ruth Tournament - Kirk Park, 16-18, 25-27 July: A request from the Jaycess for permission to operate a concession stand at Kirk Park for the Babe Ruth Tournament to be held the 16-18 and the 25-27 July was presented. It was moved by Commissioner Vollmer. seconded by Commissioner Sedivy, that the Jaycees be granted permission to operate the concession stand for the Babe Ruth Tournament and the motion was carried by the follow- ing and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none. ~cation for Beer License - Karl Marks ~izza. 1003 W. College: The application of a one-half year beer license, together with the required fee from Karl T. Gilbertson of Karl Marks Pizza. 1003 West College Street was presented. The City Manager and the Police Captain stated they had no reason to believe that the business would warrant disapproval of the application. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow. that the above application be approved and the one-half year Beer License issued and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No. none. Addendum to Seal Coat Project HB-436-2l2 (040): An addendum to HB-436-212 (040) Street Seal Coating project for sealing approximately 11,100 linear feet of crack sealing and curb line sterilization in the area between South Eighth and Fif- teenth Avenues from West Main to College Streets at a cost of $1,600.00 was presented. The Comm- ission concurred with the recommendation of the City Manager and it was moved by Commissioner Gra- bow. seconded by Commissioner Lehrkind, that the addendum to HB-436-2l2 (040) for sealing cracks and curb line sterilization at a cost of $1.600 be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Comm- issioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Appropriation Ordinance No. 908. 1971-1972 for Provisional Passage; Hearing 4 August 1971: The City Manager reviewed the proposed budget for the fiscal year ending 30 June 1972 and Ordinance No. 908 was presented, entitled: ORDINANCE NO. 908 AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN. MONTANA, FOR THE FISCAL YEAR ENDING 30 JUNE 1972. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Ordinance No. 908 be provisionally passed and adopted and 4 August 1971 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No. I I none. Carnival License - Police Protective Association - 21-24 July 1971: A letter received from Dar Hanson, President Bozeman Police Protective Association, requesting permission and authorization to obtain a City License to hold the Intermountain Shows Carnival in Bozeman. 21-24 July was presented. It was moved by Commissioner Vollmer, Seconded by Commissioner Sedivy, that the above request be approved with a $50.00 license fee consideration as a charitable project and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer.
