HomeMy WebLinkAbout1971-09-01 :162 Bozeman, Montana 1 September 1971 MINUTES OF THE MEETING OF THE CITY COMMISSION rile Connnission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 1 September 1971, at 1:15 o'clock PJM. Present were Mayor Langohr, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Frys1ie, Ass't. City Manager Keyes, Acting City Attorney Andriola and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 25 August 1971 were approved as read. Open Construction Bids S.LD. 503 - Water Mains: This was the time and place for opening bids for the construction of Water mains on North Seventh to North Fifth Avenue , from Tamarack to Juniper Streets SID No. 503. Affidavit of publication of "Notice to Bidders" was presented. I t was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. The following bids were then opened and read: Diteman Construction Company, Bozeman Edsall Construction Company, Bozeman Falls Construction Company, Great Falls Haggerty-Messmer Construction Company, Bozeman Utility Building, Inc., Great Falls $21,177.00 21,203.00 21,668.00 23,087.50 24,321. 60 The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the bids be referred to the engineers representing consultant Thomas, Dean & Hoskins, Inc. and the City Engineer for final tabulation and recommendation contingent upon the successful sale of the bonds held 8 September 1971 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, None. Acceptance and Final Payments - SID No. 499,500,501: The certificate of the engineer of Thomas, Dean & Hoskins, Inc., on Special Improvement District No. 499, Special Improvement District No. 500 and Special Improvement District No. 501 stating the construction has been completed in accordance with the plans and specifications was presented. The City Manager concurred in the recommendation of the engineers and recommended that the projects be accepted and final payment made and that final acceptance and payment does not relieve the contractor of the responsibility for negligence or faulty material or workmanship within the extent and period provided by law. It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that as recommended, the projects be accepted as completed and the Director of Finance be directed to issue warrants in payment of same to Long Construction Company, Billings, in the amount of $7,282.97 for Special Improvement District No. 499; $13.880.71_ for Special Improvement District No. 500; $1,565.88 for Special Improvement District No. 501 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Commissioner Grabow. Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none. Acceptance and Recommendation for Final Payment - Project 212(08) Street Seal Coating - $37,157.20 The Certificate of the engineer of Thomas, Dean & Hoskins, Inc., stating the construction of the Seal Coat Street Improvements, city wide, Project No. HB-436-2l2 (08), by Holland Construction Company has been completed in accordance with the terms and stipulations given in the plans and specifications for such work was presented. The City Manager Concurred in the recommendation of the consulting engineers and recommended acceptance by the Stafe Highway Department. final acceptance and final payment of the work contingent upon the/The final acceptance and payment does not relieve the contractor of the responsibility for the negligence or faulty materials or workmanship within the extent and period provided by law. The contractor has furnished a performance bond equal to the total contract bid to guarantee materials and workmanship for a one year period commencing on final acceptance. It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the project be accepted as completed that the contract of Holland Con- struction Company for Project No. HB-436-212 (08) in the amount of $37.157.20 for Seal Coat Street I I I I I I improvements in the amount of $37.157.20 be accepted as completed contingent upon the acceptance by the State Highway Department and that final payment to the contractor be recommended and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer. Commissioner Sedivy and Mayor Langohr; those voting No, none. Acceptence and Recommendation for Final Payment - Alley Surfacing Improvements Highway Project No. HB 436-212 (09): The certificate of the engineer of Thomas, Dean & Hoskins, Inc., stating the construction of the alley surfacing improvement between 10th and 11th Avenues from Beall Street to Durston Road, by Long Construction Company has been completed in accordance with the terms and stipulations given in the plans and specifications for such work was presented. The City Manager concurred in the recommendation of the consulting engineers, that the Alley Surfacing Project be accepted as completed in accordance with the plans and specifications, contin- gent upon acceptance by the State Highway Department recommending final payment thereof. The final acceptance and payment does not relieve the contractor of the responsibility for the negligence or faulty materials or workmanship within the extent and period provided by law. !he contractor has furnished a performance bond equal to the total contract bid to guarantee materials and workmanship for a one year period commencing upon final acceptance. It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the Project No. HB 436-212 (09) hmmammmpmmdmasmmmmpmemmd construction of alley surfacing improvement between 10th and 11th Avenue from Beall Street to Durston Road and that the contract of Long Construction Company in the amount of $7,029.00 be approved con- tingent upon the acceptance by the State Highway Department and that final payment to the contractor be recommended and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No. none. Application for B.O:R. Grant - $65.900.00. Funding for Softball Field Complex: The City Manager presented an application for Bureau of Outdoor Recreation funds for the develop- ment of a year-round multi-purpose recreation complex on approximately fifteen acres of undeveloped City owned property in the eastern portion of Bozeman, Montana. The application for Federal assistance amounts to approximately $65,900.00. The matching funds for this proposed complex will come from funds raised by the Bozeman Softball Association which has pledged an immediate portion of this money with strong indications that additional funds will be forthcoming. Following a thorough discussion. the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer. seconded by Commissioner Sedivy, that the applic- ation be approved contingent upon the completion of the Title Opinion and that the Mayor and the Clerk be authorized and directed to sign the application for the grant. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, commissioner Sedivy. Comm- issioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No. non. Canvass and Tabulation of Election Returns - Primary Municipal Election 31 August 1971: Under the provisions of Section 23-1801, R.C.M., 1947, and this being the first legal day after the Clerk of the Commission had received the returns of the Primary Election held Tuesday, 31 August 1971. the Clerk of the City Commission aided by the City Commissioners proceeded to canvass the said returns. The results of the canvass were as follows: 163 164 It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Clerk of the Commission issue certificates of nomination to each person nominated by a plurality of votes and that Edmund P. Sedivy, Milt Vandeventer, Eldon Conser and Robert F. Taylor be declared candidated for the office of Commissioner of the City of Bozeman at a regular municipal election to be held on Tuesday, 2 November 1971 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Ad i ournmen t: There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, Seconded by Commissioner Grabow, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting No, none.
