HomeMy WebLinkAbout1971-09-15 170 Bozeman, Montana 15 September 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building:, 15 September 1971, at 1:15 o'clock p.m. Present were Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keys, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 8 September 1971 were approved as read: Absence of Mayor Langohr: In concurrence with the recommendation of the City Manager, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the absence of Mayor Langohr be authorized in compliance with Section 11-3245, R.C.M., 1947, and that Commissioner Sedivy be designated to act as President Pro Tempore of the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, and Commissioner Sedivy; those voting No, none. l. Commission Resolution No. 1480 - Hearing Special Levy for St. L~ghting, Final Passage: This was the time and place set for hearing on levying assessment for the Street Lighting for the year 1971 in the amount of $16,473.21. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 1480 provision- ally passed and adopted at the regular session held 8 September 1971 was presented for final passage. In concurrence w~th the recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Comm- issioner Vollmer, Commissioner Grabow and Commissioner Sedivy; those voting No, none. Commission Resolution No. 1481 - Hearing Special Levy for St. Sprinkling, Final Passage"! This was the time and place set for the public hearing on levying assessment for Street Sprink- ling for the year 1971 in the amount of $7,908.96. Affidavit of publication of Notice was presented. No one was present to protest and no written protests having been filed, Resolution No. 1481 pro- visionally passed and adopted at the regular meeting held 8 September 1971 was presented for final passage. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the resolution be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Grabow, Commissioner Lehrkind and Commissioner Sedivy; those voting No, none. Offer to Process Land Exchange - Bozeman Creek Drainage - U.S. Forest Service: A letter received from Mr. Ross MacPherson in regard to a possible land exchange between the City and the United States Forest Service was presented. The United States Forest Service would like to acquire City of Bozeman land in the upper Bozeman Creek Drainage (Sections 27,35, S\ 31, 1, 7, E\ of 13 and 19). For this land the United States Forest Service would like to exchange National Forest Land around the City intake at the mouth of Bozeman Creek (Sections 8, 17, and 18) and the National Forest land just north of the Lyman Creek watersheed (Section 21). Following a discussion of the possible land exchange the Commission directed the City Manager to arrange a date to inspect the area.l,?-;-.;; .7/) Authorize Purchase Share Bozeman Creek Reservoir Company - Purchase Agreement & pymt - Res. 1490: A purchase Agreement as prepared by the City Attorney whereby Harry V. Corning and Virginia A. Corning agreed to sell and convey to the City of Bozeman One(l) share of Bozeman Creek Reser- voir Company capital stock represented by certificate numbered 25 entitling the holder thereof to one hundred (100) miner's inches for fourteen (14) days or fifty (50) miner's inches for twenty- eight days from Mystic Lake Reservoir through Bozeman Creek for a total price of Fifteen-Thousand Dollars ($15,000.00), together with interest at the rate of six percent (6%) per annum on the un- paid balance of the purchase price payable as follows was presented. The sum of $5,000.00 is to be paid upon the execution of the Agreement, the balance of the purchase price in the sum of Ten Thousand Dollars ($10,000.00) to be paid in semi-annual install- ments of Twelve Hundred Fifty Dollars ($1,250.00) each, together with interest on the unpaid prin- cipal balance remaining from time to time. Said semi-annual payments to commence on the 15th day of December 1971, with the second semi-annual payment due on the 15th day of June, 1972, and semi- annually thereafter until the whole of said balance of the purchase price is paid in full. I I I I I I Upon advisement of the City Attorney and recommended by the City Manager, it was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that Commission Resolution No. 1490 authorizing the Acting Mayor and Clerk of the City Commission to execute a purchasing Agreement on behalf of the City of Bozeman and that the Director of Finance be directed to issue a warrant in the amount of $5,000.00 upon execution of the agreement and the motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commiss- ioner Vollmer a~&~~'or Sedivy; those voting No, none. Request to Conduct Parade & Snake Rally - 25 September 1971, 1 October 1971, Bozeman Senior High School: A request from the Bozeman Senior High School, for permission to conduct a Homecoming Parade on Saturday, 25 September 1911 at 10:00 o'clock A.M. and to stage a "Snake Dance" on Main Street on Friday, 1 October 1971 at 7:30 o'clock p.m. was presented. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that permission to conduct the Homecoming Parade on Saturday, 25 September 1971 be authorized providing arrangements can be made so the parade does not conflict with the 11:00 o'clock A.M. parade scheduled by the Gallatin Shrine Desert Patrol and was authorized by the Commission on 8 September and that permission to stage the "Snake Dance" on Friday, 1 October be granted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow and Commissioner Sedivy; those voting No, none. License Bond Continuation - Plumber & Gas Fitter - William Lynas: In compliance with Chapter 16 of the Bozeman Municipal Code, the Plumbing and Gas Fitter Lic- ense Bond of William S. Lynas was presented. The City Manager stated the Building Inspector had recommended approval of the above mentioned boroand the City Attorney had approved the Bond as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the aforementioned bond be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Grabow, Commissioner Lehrkind and Commissioner Sedivy; those voting No, none. Commission Resolution No. 1486 - Fixing Date, Maturity date and Amount of SID No. 503: Commission Resolution No. 1486 authorizing the issuance of bonds of Special Improvement District No. 503 was presented, set forth in full: COMMISSION RESOLUTION NO. 1486 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING THE DATE, MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE ISSUED IN SPECIAL IMPROVEMENT DISTRICT NO. 503 It was moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Commissioner Sedivy, those voting No, none. Withdvaw Construction Bid Call & Bond Sale Notice - SID No. 504: It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they withdraw the "Call for Bids" with an opening date of 15 September and the Bond Sale with an opening date of 22 September for the construction of Special Improvement District No. 504 for paving West Aspen to West Tamarack Street from North Fifth to North Seventh Avenue since the bids called for construction to begin in March 1972 and the Contractors are caught in the wage-price freeze. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer Commissioner Grabow and Commissioner Sedivy; those voting No, none. Subdivision No. 8B - Sour Dough Creek Properties - Final Plat The final plat of Subdivision No. 8B Sour Dough Creek properties was presented along with the favorable recommendation of the City-County Planning Board. Following a discussion, and noting that the plat conformed generally with the master Plat of this area, the City Manager recommended that the plat be approved as presented. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the plat be approved as recommended and that the City Manager be authorized and directed to sign the plat as the Director of Public Service and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Grabow, Commissioner Lehrkind and Commissioner Sedivy; those voting No, none. Reports: The following reports were presented: Director of Public Service Fluoridation Cashier 171 ~2 I The City Manager commented on the reports and recommended the approval thereof. It was moved by Commissiner Grabow, seconded by Commissioner Lehrkind, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Commissioner Sedivy; those voting No, none.
