The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building, 30 June 1971. at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Comm-
issioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy. City Manager Fryslie. Ass't. City
Manager Keyes. City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 23 June 1971 were approved as read.
Sidewalk Installation on West Durston - Petition:
A petition signed by several property owners living on Durston Road requesting certain stipu-
lations in connection with the Sidewalk installation on West Durston was presented. Several property
owners were also present to discuss the petition.
The Commission informed the property owners that their petition would be taken under advisement
and every effort would be made to work out the problems existing.
Abatement of Sidewalk Replacement Orders:
Letters received from Zales Duncan, 21 East Beall Street. John Recktenwald, 330 North Wallace
Avenue and Mae Riggs, 304-308 North Tracy Avenue, requesting abatement of an order to reconstruct
sidewalks in these areas at this time were presented. Following a discussion, it was moved by Comm-
issioner Sedivy. seconded by Commissioner Grabow. that the order to install sidewalks at the Duncan,
Recktenwald and Riggs property be revoked for this year and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow. Commissioner Lehr-
kind. Commissioner Vollmer and Mayor Langohr; those voting No, none.
Request to Sell Calenders July and August 1971, Bozeman Jaycees:
A letter received from Mrs. Bill Young, President. Bozeman Jayceens, requesting permission to
sell Birthday Calendars from 1 July to 1 September 1971 to the residents of the City of Bozeman was
presented. It was moved by Commissioner Grabow. seconded by Commissioner Lehrkind, that permission
to sell the calendars be granted and the motion was carried by the following Aye and No vote: Those
voting Aye being Commissioner Grabow, Commissioner Lehrkind. Commissioner Vollmer, Commissioner
Sedivy and Mayor Langohr; those voting No. none.
Durston Road - Proposed Paving:
The paving of Durston Road from North Seventh Avenue to North Eleventh Avenue was again presented
for discussion. The Commission delayed action on the matter pending completion of a study by the
City Attorney to determine what rights-of-way the City now has.
Request for Curb Opening - Grinwis, 511 West Peach Street:
A letter received from Ben Grinwis, 511 West Peach Street, requesting a twenty-foot curb opening
at his residence was presented. Following a lengthy discussion, the Commission tabled action of
the request to go out and inspect the property in question.
Petition Against Covered Wagon Mobile Home Court. Water & Sewer Services:
A petition signed by thirty-three property owners in the general area of the proposed Covered
Wagon Park located upon property north of the present terminus of North Seventeenth Avenue was
presented. The Commission instructed the City Manager to acknowledge receipt of the petition.
Request for Water and Sewer Service - Development Technology, Inc.,~
A request from Development Technoloby, Inc., a new electronics manufacturing firm to locate
here for permission to connect to the existing water and sewer lines of the City of Bozeman ~ a
point where the same parallels the above described property located on North Rouse Avenue and ad-
jacent to Interstate 90 was presented. The firm will use approximately 80 gallons of water per
minute for a total of eight hours per day.
The commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Grabow, seconded by Commissioner Lehrkind. that the City proceed with steps to provide water
and sewer service to Development Technology. Inc.. and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Grabow. Commissioner Lehrkind, Commissioner Vollmer.
Commissioner Sedivy and Mayor Langohr; those voting No, none.
Federal Aviation Administration - Planning Grant Agreement & Resolution No. 1473:
The Planning Grant Agreement FAA form 5900-1 PG 1, Project No. A 30 0010 01, Contract No. DOT-
FA-7l-CE6085 and Resolution authorizing execution of the Grant Agreement between the City of Bozeman
and the Federal Aviation Administration in an amount not to exceed $39.297.00 in Federal funds for a
comprehensive 'study of the airport was presented. Howard Nelson, Secretary of the Gallatin Field
Board and David Rask, a Representative of the Federal Aviation Administration were present to discuss

the Agreement and answer questions.
Following a thorough discussion, it was moved by Commissioner Vollmer, seconded by Commiss-
ioner Sedivy, that the City enter into the Grant Agreement and the Resolution accepting, adopting,
approving and authorizing the execution of a Planning Grant Agreement for the Development of an
airport master plan for Gallatin Field Airport and that the Mayor and the Clerk of the Commission
be authorized and directed to execute the documents for the federal funds on behalf of the City of
Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Lehrkindartd Mayor Langohr;
those voting No, none.
Senior Citizens - Request for Mill Levy:
Several members of the Senior Citizens appeared before the Commission in regard to the one mill
levy authorized by the 1971 Legislature to help support activities and programs for Senior Citizens.
The Commission acknowledged receipt of the request and asked that they obtain additional information.
Sanitary Landfill Assessments:
Following a month of study by the City Commission, the proposed new Sanitary Landfill Assessment
Policy was again presented. The City Manager explained the policy thoroughly and recommended that
the new Sanitary Landfill Assessment Policy be adopted. In concurrence with the recommendation of
the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that the
new policy be adopted in general with final approval to be included within the new budget as follows
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those
voting No, none.

POL ICY
1. All property equipped with and using an improved incinerator will be entitled 'to a
50% reduction of Landfill Assessment.
2. All single firm multiple use which falls into two or more categories the higher
classification will prevail in all cases unless individual areas are easily determined.
3. Trailer Courts shall be assessed as 25% of basel space available.
4. All Apartment Houses and other living units shall be assesifaccording to Residential
Assessment using 30% of base for a 4 room unit.
5. All Hotels, Motels and Rooming Houses shall be assessed at 5% of Base/unit or room
as applicable.
6. All storage space at, above, or below grade shall be included in gross area and
assessed at rates prescribed for the commercial type use.
7. All appeals for assessment tax abatement shall be made through the existing channels.
8. The assessment year shall be from July 1st through June 30th, commencing July 1, 1971.
9. All partial use or change in use shall be considered only if in effect for more than
3 months of assessment year and if abatement exceeds $5.00.
10. All gross area shall be determined by exterior measurements and by the B. I. Office.
11. The Assessment rate schedule may be changed occasionally based on supplemental data.
12. All property which produces solid waste shall be assessed under existing rate
schedules for the cost of purchase and operation of an approved solid waste disposal
system, either by the established rate schedule or on a trip basis.
13. The Landfill Assessment shall be collected annually by the Director of Finance of
the City of Bozeman and deposited in the Sanitation Fund in the same manner as the
existing garbage collection method.
14. All assessments shall constitute a lien on the property and is the duty of the owner
of record to discharge.
15. All General Contractors, Stockyards, and other activities not specifically listed
and subject to large volume fluctuation or bulky objects shall be charged on a trip
basis at the Landfill Site or at a negotiated rate.
LIQU\R LICENSE
New Arcade, Doris Ferguson:
An application for license to sell liquor at retail at the New Arcade, 43 West Main Street,
together with the required fee was presented. The City Manager and the Chief of Police stated they
were not aware of any reason that would warrant disapproval of the application. The City Commission
concurred with the recommendation and it was moved by Commissioner Grabow, seconded by Commissioner
Lehrkind, that the above application be approved and the Director of Finance be directed to issue a
license in accordance therewith and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer, Commissioner
Sedivy and Mayor Langohr; those voting No, none.

Reports:
The following reports were presented.
Librarian
Director of Finance
The City Manager commented on the reports and recommended approval thereof. It was moved by
Commissioner Lehrkind, seconded by Commissioner Vollmer, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and Commissioner Grabow and Mayor Langohr;
those voting No, none.
Contract Documents - Walks & Curbs, W. D. Howell:
The performance bond and contract documents for the contract of W. D. Howell awarded 16 June
1971 for the construction of miscellaneous walks and curbs within the City of Bozeman for the year
1971 was presented. The Bond and Contract were approved as to form by the City Attorney and the
City Manager. reported that the City had Evidence the contractor is adequately insured and recommended
the documents be approved. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy,
that the contract be so approved as presented and the Mayor and the Clerk be authorized and directed
to sign the contract for the City and W. D. Howell be authorized to proceed with the construction
of the miscellaneous sidewalks and curbs and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Comm-
issioner Lehrkind and Mayor Langohr; those voting No, none.
Letter of Condolence to the Family of Walter L. Sales:
It was moved by Commissioner Sedivy, seconded by Commissioner Grabow, that an appropriate
letter of Condolence be addressed to the family of Walter L. Sales and the motion was carried by the
following Aye and No vote: those veting Aye being Commissioner Sedivy, Commissioner Grabow, Comm-
issioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Adjournment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Grabow, seconded by Commissioner Lehrkind, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commiss-
ioner Lehrkind, Commissioner Vollmer, Commissioner Sedivy and/Mayor Langohr; those voting No, none.
