Mon t.:ana 19 Nay 1971 The Commission of the City of Bozenla met in regular session in the Commission Room, Municipal Building, 19 May 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm- issioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Frys1ie, Ass't. City Manager Keyes, Ci ty At torncy Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular session held 12 May 1971 were approved as corrected. This was the time and place set for opening bids for the construction of paving North Seven- teenth Avenue between West Beall Street and Durston Road SID No. 499, paving West Beall Street from North T\ventieth Avenue East to alley west of North Eighteenth Avenue SID No. 500, and paving of a portion of South Sixteenth Avenue SID No. 501.. Affidavit of publication of "Notice to Bidders" was presen ted. One sealed bid \olas on file and it \Vas moved by Commiss ioner Morro\ol, seconded by Comm- issioner Grabow, that the bid be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Graboe, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. The bid of Long Construction Company, Billings, Hontana, was then opened and read: Long Construction Company, Billings - $99,821.95 In concurrence \<li th the recommenda ti.on of the Ci ty Han8ger, it was moved by Commiss ioner Grabow, seconded by Commissioner Vollmer, that the bid be referred to the engineer representing Consultant Thomas, Dean & lloskins for final tabulation and recommendation contingent upon the success- ful sale of the bonds held 26 May 1971 and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those vo ting No, none. Park .'\1"1::<1 Residents: ^ petition signed by approximately sixty property owners in regard to the City of Bozeman reversing its decision of 12 May 1971 approving extension of Water and Sewer to the Covered Wagon Mobile Home Park was presented as follows: Re: Extension of Sewer and Water Lines to the Covered Waz,on Park: Will you please consider this letter in form of a petition to the City of Bozeman to reverse its decision of May 12, 1971, approving extension of water and sewer to the Cover.ed Wagon Park, Incorporated for the following reasons: I. It does not represent orderly development, specifically: a. Traffic problems have not been resolved. The only ingress and egress is North Seventeenth which is not completely improved. The present Covered Wagon Park, with only 17th as an ingress and egress, would represent a hazardous cul-de-sac arrangement. b. There Ls no time schedule for obtaining right-of-way for the orderly development of 15th Street which forms the easterly boundary of the Covered Wagon Park. c. Although the master plan designates North 19th Street, which forms the westerly boundary of the Covered Wagon Park, as an arterial road, the right-of-way has not been completely obtained and state funds have not been scheduled for its improvement. d. Durston Road, as the main arterial for all streets in northwest Bozeman, is in dire need of improvement to carry the current traffic load. Securing right-or-way and funds for this road improvement should be under a fiml timetable in order to facilitate orderly d eve lopmen t . e. There are no time schedules for obtaining right-of-way for the orderly development of Hest Oak forming the northerly boundary of the pro- posed Covered Wagon Park. er L. It is the petition's belief that 15th Street, 19th Street and Hest Oak \Vill not be developed for several years because of right-of-way diff- iculties and lack of funds. 2. Orderly development requires careful consideration by all and especially the recommendations of the City-County planner and City Engineer. In addition, traffic studies should be made to properly identify and propose solutions to potential problems. 3. New developments, more especially high density developments, should have an adequate storm sewer system and be part of the master plan. In summary, we believe that granting an extension of sewer and water facilities to the Covered Hagon Park is not consistent with orderly development of the area in question. I I I I I I Mr. Russel E. Estes, Mr. Donald A. Rudberg, Mr. Francis L. Niven and Mr. David A. Or1ady were also present to discuss the decision. Following a thorough discussion of the interest in working toward upgrading vehicular and pedestrian traffic facilities providing ingress and egress to that neighborhood and the proposed Covered Wagon Mobile Homes Park, it was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the City Manager acknowledge receipt of the petition, assur- ing them that the City is vitally concerned with providing the best possihle facilities for all parties concerned and that the interested property owners and the City of Bozeman work together to\~ard the goal of proper provision for traffic and the motion was carried by the following Aye and No vote: Thos voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Mayor Langohr; those voting No, none. r::.l?29_l.:.~-9n Hont~ Lib~9_r.L...:\ssoci<ltion Convention - Marfarct Hileman: City Librarian Margaret Hileman gave an extensive report on her attendance at the Montana Library Convention held in Missoula, 7-9 May 1970. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that Miss Hileman be congratulated on the completeness of her report and that it be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner MorrO\~, Commiss- ioner Grabow and Mayor Langohr; those voting No, none. C"~!.!..Jor Bids -_lyel Sup'p_~ he opened 9 June 1971: The Ci ty Manager reques ted authority to call for sealed hids from gasoline, diesel fuel and I'" kerosene supplie"s to furnish the City of Bozeman for a period of one year through 30 June 1972, with approximately 65,000 gallons of regular gasoline, approximately 11,000 gallons No. 2 Diesel Fuel and approximately I,OOO gallons kerosene. It was moved by Commissioner Sedivy, seconded by Commiss- ioner Grabow, that the request be approved and the Clerk of the Commission be directed to issue a "Call for Bids" to be opened 9 June 1971 and the motion \"as carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer, Commissioner Morrow and Mayor Langohr; those voting No, none. !\uth02.:.LS::.. to~Purchase Flail Mower - $729.00: The Street department has need for a flail mower at an approximate cost of $729.00 and the Ci.ty Manager reql1es ted au thori ty to purchase the flail mower. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the City l'lanager acknowledge receipt of the request and that it be tabled for. investigation and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Horrow, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none.
