The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building, 23 June 1971. at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Grabow, Comm-
issioner Lehrkind, Commissioner Vollmer, Acting City Manager Keyes, Acting City Attorney Andriolo
and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 16 June 1971 were approved as read.
Acceptance of SID No. 498 and Final Payment - Haggerty Messmer $14,514.64:
The certifivate of the engineer of Thomas, Dean and Hoskins, Inc., on Special Improvement Dis-
trict No. 498 stating that the construction of the watermain improvements has been completed in
accordance with the terms and stipulations given in the plans and specifications for such work
with exceptions as noted on Pay Estimate No.1 was presented. The Acting City Manager concurred
in the recommendation of the engineers and recommended that the project be accepted and approved by
the City Commission and final payment made. This final acceptance and payment does not relieve
the contractor of the responsibility for ~eg1igence or faulty materials or workmanship within the
extent and period provided by law. The contractor has furnished a performance bond equal to the
total contract bid to guarantee material and workmanship for a one year period commencing upon
final acceptance. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that as
recommended the project be accepted as completed and the Director of Finance be directed to issue
a warrant in payment in the amount of $14.514.64 to Haggerty Messmer Company and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer. Commissioner
Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No. none.
Kennel License Application - Helen Donahue, 209 No. Eighth Ave.:
An application received from Helen Donahue, 209 North Eighth Avenue. requesting a kennel lic-
ense in accordance with Ordinance No. 857. Section 5.16.040 of the Bozeman Municipal Code. together
with the required fee was presented. Following a discussion. it was moved by Commissioner Grabow.
seconded by Commissioner Lehrkind, that the kennel license be approved and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind.
Commissioner Vollmer and Mayor Langohrj those voting No, none.
Request for Flood Plain Report to Montana Water Resources Board:
The Acting City Manager presented and recommended execution of a joint City-County request
which had been prepared by the Planning Director to request that the Montana Water Resources Board
prepare a flood plain report with the assistance of the United States Army Corps of Engineers at no
cost to the City to establish a Fifty-Year Flood plain to be delineated from aerial photographs for
the purpose of restricting building in the various areas of the City and County. There is also a
map prepared showing the priority of the various river areas with Bozeman Creek shown as number one
priority.
The Commission concurred with the Acting City Manager. and it was moved by Commissioner Lehr-
kind. seconded by Commissioner Vollmer. that the City execute the Flood Plain Report with the Galla-
tin County Board of County Commissioners as ~oint signators. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner
Grabow and Mayor Langohr; those voting No, none.
License Bond - Montana Power Company. $2,000.00:
In compliance with Chapter 15 of the Bozeman Municipal Code. the certificate of the Montana
Power Company. Bozeman, in the amount of $2,000.00 was presented. The Building Inspector recommended
the continuation of the bond and the Acting City Attorney approved the bond as to form. It was
moved by Commissioner Vollmer. seconded by Commissioner Grabow, that the bond be approved and accepted
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, eommissioner Grabow, Commissioner Lehrkind and Mayor Langohr; those voting No, none.

The Acting City Manager commented on the reports and recommended the approval thereof. It was
moved by Commissioner Grabow, seconded by Commissioner Lehrkind, that the reports be approved and

ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Grabow, Commissioner Lehrkind, Commissioner Vollmer and Mayor Langohr; those voting
No, none.
proclamation "Fourth of July" - "Ringing of Bells."
Mayor Langohr announced his proclamation designating 4 July 1971 as the day for "Ringing of
Bells" and urged all citizens of the City of Bozeman to participate in the ringing of bells to let
the world know that patriotism lives within the heart of every citizen of this City. It was moved
by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur in the Mayors pro-
clamation and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Vollmer, Commissioner Grabow and Mayor Langohr; those voting
No, none.
Proposed Paving of Durston Road from Seventh Avenue to Eleventh Avenue:
The City Commission initiated a discussion as to what means can be found to accomplish the
paving of Durston Road from North Seventh Avenue to North Eleventh Avenue. Following a review of the
status of this section of the road, it was moved by Commissioner Grabow, seconded by Commissioner
Lehrkind, that the Acting City Manager be instructed to gather all available information to deter-
mine what steps are necessary to clear up the question of Right-of~Way on this road and provide a
legal position for setting up a paving Special Improvement District. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Lehrkind,
Commissioner Vollmer and Mayor Langohr; those voting No, none.
Adjournment:
There being no further business to come before the Commission at this time, it was moved by
Commissioner Lehrkind, seconded by Commissioner Vollmer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those vo "ng Aye being Lehrkind,
