The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 12 May 1971, at 1:15 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm-
issioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Frys1ie, Ass't. City Manager
Keyes, City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular session held 5 May 1971 were approved as corrected.

The Montana State University is conducting a study of Police Courts and several students werc
present to discuss and ask questions in regard to the Bozeman Police Court proceedure.

An Application and Agreement to extend the Water and Sewer facilities of the City of Bozeman
outside the City Limits of the City of Bozeman to service the Covered Wagon Park Subdivision prepared
pursuant to Section 11-1001, R.C.M., 1947, and Commission Resolution No. 1466 was presented to the
Commission by Mr. J. W. Tschache owner of the property.
The Commission concurred with the recommendation of the City Manager, that the i\greemcnt and
^nnexation as submitted be approved conditioned upon the vacation by the Gallatin County Commission
of the Stevens Subdivision which is plated and will include a portion of the land upon which the
proposed mobile home park is to he located. In addition Mr. Tschache will provide a covenant that
the property will be used only for residential purposes until annexed to the City. The following
stipulation are included in the Agreement.
1. The City of Bozeman agrees to allow the Party of the Second Part to construct
a water main and sanitary sewer main to serve the aforedescrihed property, to be
constructed and installed to the specifications of the City of Bozeman and connect-
ed to the existing water main and sewer main of the City of Bozeman.
2. The cos t of the cons truc tion of said Hater mains and se~ver mains on the pro-
perty of the Party of the Second Part herein described shall be borne by the Party
of the Second Part, and the Party of the Second Part shall also pay all water and
sewer assessments and rates established by the City of Bozeman for the use of said
systems.
3. All extensions of said water and sewer lines provided to serve the property of
the Party of the Second Part herein shall be constructed in accordance with the
design and specifications approved by the City Engineer of the City of Bozeman
prior to the installation of said water and sewer lines.
If. The Party of the Second Part covenants and agrees to pay to the City of Boze-
man, prior to the making of the connection of said water system and sewer services,
all regular connection fees and costs which may be in effect at the time that said
connection is made.
5. The undersigned covenants and agrees to convey that portion of the complete
water main and city sewer main constructed on the right of way of the City of
Bozeman, to the City of Bozeman, to become a part of the city water and sanitary
sewer system and to be so maintained by the said city.
6. In consideration of the Party of the Second Part paying for the construction
of the water main and sewer mains on the property of the party of the Second Part
as herein provided, it is agreed that the Party of the Second Part shall be entit-
led to be compensated pro-rata for any extension of water and sewer mains upon
additional property not belonging to the Part of the Second Part.
7. The Party of the Second Part agrees, upon reques t by the Ci ty of Bozeman, to
cooperate and permit the annexation of the preperty herein described into the
incorporated limits of the City of Bozeman.
It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the Mayor and the
Clerk of the Commission be authorized and directed to sign the Agreement for Annexation upon satis-
faction of the conditions of approval and the motion was carried by the following Aye and No Vote:
those voting Aye being Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commi.ssioner
Vollmer and Mayor Langohr; those voting No, none.

The Water department has need for water meters and the City Manager requested authority to
purchase water meters in the approximate amount of $1,300.00. It was moved by Commissioner Morrow,
seconded by Commissioner Grabow, that the City Manager be granted authority to purchase thirty 3/l:"
and four I" water meter~ at an approximate cost of $1,300.00 and the motion was carried by the

The City l1unicipal Band Board of Directors selected Mr. IHlliam Long, Bozeman Junior High
School Band Director, as Director of the Bozeman Municipal Band for the 1970-1971 season, the term
covering a period of one year ending in April 1972. It was moved by Commissioner Grabo~y, seconded
by Commissioner Vollmer, that the Commission concur in the selection of Mr. Long as Band Director
and that they also approve the concert schedule as outlined and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner
Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.

A letter received from Howard Nelson, 705 South Tracy Avenue requesting that the curb opening
be changed from seventeen feet to twenty four feet to provide additional off-street parking at 705
South Tracy Avenue was presented.
Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy,
that the request for re-aligning the curb opening at 705 South Tracy Avenue to a maximum of twenty-
four feet at the throat of the driveway curb opening be approved and the motion was carried by the

The following applications for kennel licenses in accordance with Ordinance No. 857, Section
5.16.04.0 of the Bozeman Municipal Code together with the required fee were presented. Following a
discussion, it was moved by Commissi.oner Sedivy, seconded by Commissioner Morrow, that the request
of Dorothy Kenck, Robert T. Stevens, Jr., and Gordon Duntsch for kennel license in the amount of
$20.00 each be approved and that the request of Mrs. A. W. Clark of 1103 Cherry Drive be denied be-
cause "Alterations need to be made in the facilities" and "as a matter of Sanitation." The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commiss-
ioner Morrow, Commissioner Grabow, Commissioner Vollmer, Mayor Langohr; those voting No, none.

Mayor Langohr announced his proclamation of 16 Mayas "International Shrine Hospital Day" in
the City of Bozeman and urged all citizens to join in paying tribute to the Shrine of North America.

the City Manager be authori:>:ed to attend the meeting of the Montana League of Cities Board of Direct-
ors and Legislative Committees to be held in Helena, 19-20 Hay 1971 and the expenses be paid from
the General fund and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vollmer, Commissioner Sedivy, Commissioner MorrmJ, Commissioner Grabm-1 and Mayor Lan80hr;

The City Engineer completed his survey of I,Jalks and Curbs within the City of Bozeman and recomm-
endations for repair and/or installation for the year 1971.
Following a thorough discussion and in concurrence with the recommendation of the City l1anager,
it Has moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the City Engineers recomm-
endation for repair and/or installation of ''Walks and Curbs" tJithin the City for the year 1971 be
tentatively approved and that the Clerk of the Commission be authorized to "Call for Bids" for repair
and/or installation of "\<Jalks and Curbs" to be opened on 9 June 1971 and the motion was carried by
