The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 7 April 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm-
issioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Frys1ie, Ass't. City Manager
Keyes, Acting City Attorney Andrio10 and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 31 March 1971 were approved as read.
Hearing, Resolution No. 1460, Intent to Amend Zoning - Edsall Property: Homesites Subdv.
This was the time and place set for hearing Commission Resolution No. 1460 to reclassify and
change from a Class "A" residential zone to motor business zone the east 150 feet of lots 8-B and
8-C of the Homesites Subdivision and owned by Wayne Edsall. Affidavit of publication of Notice as
required by law was presented. Several property owners were present to discuss the zoning variance
from existing Zone "A" Residential to motor business.
Following a thorough discussion of the intent to amend the zoning map and after hearing both
sides of the arguement, it was moved by Commissioner Sedivy, seconded by Commissioner MOrrow, that
action be deferred on the reclassification and change from a Class "A" residential zone to motor
business zone with a recommendatin that every effort be made to work out a possible solution between
the two parties. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Morrow. Commissioner Grabow. Commissioner Vollmer and Mayor Langohr;
those voting No, Mayor Langohr.
It was then moved by Commissioner Morrow, seconded by Commissioner Grabow, that the matter be
tabled for a period of one week until 14 April 1971 at which time it will again be considered and a
final decision rendered and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor
Langohr; thpse voting No. none.
Bid Opening - 58,000 lbs. Liquid Chlorine for Water Department & Waste Water Treatment plant:
This was the time and place set for opening bids on the purchase of approximately 58.000 lbs of
Liquid Chlorine for the Water department and the Waste Water Treatment plant. It was moved by Comm-
issioner Grabow. seconded by Commissioner Vollmer, that the bids be opened and read and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow. Commissioner
Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No. none.
The following bids were then opened and read:

The Commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Vollmer, seconded by Commissioner Sedivy. that the bids be referred to the Water Superin-
tendent and the City Engineer for tabulation and recommendation to be made to the Commission at
their next meeting on Wednesday, 14 April and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer. Commissioner Sedivy. Commissioner Morrow. Commissioner
Grabow and Mayor Langohr; those voting No, none.
Request for Circus License - Montana State University Fieldhouse - Hubert Castles Three Ring:
A letter received from Bud purd_y Fieldhouse Manager requesting permission to obtain the proper license
license to hold Hubert Castles' Three Ring Circus in the Montana State University Fieldhouse for
two performances Thursday, 8 July 1971, was presented. He also requested the Commission to protect
Montana State University two weeks prior and two weeks after the date of the circus from issuing any
license for a circus or carnival to any other organization. The City Manager recommended that the
request of Mr. Purdy be granted as presented. It was moved by Commissioner Sedivy, seconded by Comm-
issioner Morrow, that the subject request be approved with the instructions that this circus be fully
licensed in thetotal amount of $220.00 _in compliance with the provisions of Chapter 3.04.080 of the
Bozeman Municipal Code and the motion was carried by the following Aye and No vote: those voting Aye
Being Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer and Mayor
Langohr; those voting No, none.
Bozeman Lion's Club - Carson & Barnes Circus 9 July 1971:
A verbal request from the Bozeman Lions Club for a city of Bozeman business license to sponsor

Carson & Barnes Circus, 9 July 1971, was presented. Following a thorough discussion, it was moved
by Commissioner Morrow, seconded by Commissioner Grabow, that the verbal request from the Lions
Club for a City of Bozeman business license to sponsor Carson & Barnes Circus 9 July 1971 and the
supplemental request that the full license fee not be imposed be denied in an attempt to avoid detri-
mental conflicts and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr;
those voting No, none.
Confirmation of Police Officer John L. Smith:
A letter received from Chief of Police Robert Johnson, concurred in by the City Manager, in-
forming the Commission that Officer John Lawrence Smith had satisfactorily completed the required
six month probationary period as of 3 April 1971 and recommending that officer Smith be confirmed
as a regular officer of the Bozeman Police Department effective 3 April was presented. It was moved
by Commisswner Grabow, seconded by Commissioner Vollmer, that the confirmation of Police Officer
Smith be approved and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr;
those voting No, none.
~uthority to Install Screens at Water Settling Basins:
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the City Manager be
granted authority to proceed with the construction of screens to be located in the water settling
basins which supply the City's water supply. The screens will screen out debris which enters the
water system and will cost approximately $3,000.00. The motionwas carried by the following Aye and
No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow,
Commissioner Grabow and Mayor Langohr; those voting No, none.
~uthority to r:urchase Hower for P?rk Department - $3,340.72.:
The Park department has need for a lawnmower and requested authority to purchase a 72" Hustler
Hydrostatic Rotary Mower at an approximate cost of $3,340.72. It was moved by Commissioner Sedivy,
seconded by Commissioner Morrow, that the purchase of the Hustler Hydrostatic Rotary Mower be autho-
rized and the motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those
voting No, none.
License Bond - Bruce T. Siren Electrical License:
In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrical bond of Bruce T.
Siren, Bozeman, was presented. The City Manager stated the Building Inspector had recommended appro-
val of the above mentioned bond and the Acting City Attorney had approved the bond as to form. It
was moved by Commissioner Morrow, seconded by Commissioner Grabow, that the Electrical License Bond
of Bruce T. Siren be approved and the motion was carried by the following Aye and No vote; those
voting Aye being Commissioner Morrow, ;ommissioner Grabow, Commissioner Vollmer, Commissioner Sedivy
and Mayor Langohr; those voting No, none.
Proclamation - April as American Legion Youth Month:
In accordance with the American Legion, Mayor Langohr proclaimed the month of April as "American
Legion Children & Youth Month" and called to the attention of all citizens the good works of our legion-
naires and the members of the American Legion Auxiliary in their dedication to the admirable purpose
of this outstanding program. It was moved by Commissioner Grabow, seconded by Commissioner Vollmer,
that the Commission concur in the proclamation and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Comm-
issioner Morrow and Mayor Langohr; those voting No, none.

Resolution No. 1462 authorizing the issuance of bonds of Special Improvement District No. 498
was presented, entitled:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN FIXING
THE DATE, MATURITY DATE AND THE PRINCIPAL AMOUNT OF BONDS TO BE
ISSUED IN THE SPECIAL IMPROVEMENT DISTRICT NO. 498.
It was moved by Commissioner Vollmer, secondijd by Commissioner Sedivy, that the Resolution be
passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be directed to issue
warrants in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that
the claims be approved and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer and
Mayor Langohr; those voting No, none.
