HomeMy WebLinkAbout1971-04-14 106 Bozeman, Hont8na 14 April 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 14 April 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 7 April 1971 were approved as read. Consid.eration of Resolution No. ll~60 - Intent to Rezone Edsall Property: Commission Resolution No. lL~60 to reclassify and change from a Class "A" residential zone to motor business zone the east 150 feet of Lots 8-B and 8-C of the Homesite Subdivision owned by Wayne Edsall was presented for further consideration and a final decision following a week of delay to allow the two parties to make every effort to work out a possible solution. Mr. Heath, Attorney for Wayne Edsall, then provided the Commission with a letter stating his client would provide restrictive covenants for the land if it were changed from a Class "A" resid- ential zone to motor business zone which would bar any business except mobile home parks from locating there. Following a discussion of the covenants, the City Manager recommended that the matter be de- layed for an additional week at which time restrictive covenants prepared by City Attorney Ben Berg, McKinley Anderson, Attorney for the opponents and Robert Heath, Attorney for ~lr. Edsall, will be presented. The Commi.ssion concurred with the recommendation of the City Manager and it was moved by Commissioner Morrow, seconded by Commissioner Grabow, that the final decision be'continued for another week to draw up and present to the commission "Special Covenants" prior to making a decision. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. Contract Documents for SID No. 498 - For Execution: ~~--~~-.._.- , The Contract Documents for the construction of Water Mains on North Seventeenth Avenue between West Beall Street and Durston Road, Special Improvement District No. 498 as aHarded to Haggerty-Mess- mer, Inc., Bozeman, Montana, on 31 March 1971 were presented. The City Manager recommended that the documents approved as to form by the City Attorney be approved. It was moved by Commissioner Grabow seconded by Commissioner Vollmer, that the contract documents be approved and that the Mayor and Clerk of the Commission be authorized and directed to sign the contracts for the City of Bozeman and that Haggerty-Messmer, Inc., be authorized to proceed with the construction and that the pledge for bid security be returned to llaggerty-Messmer, Inc., and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Comm- issioner Morrow and Mayor Langohr; those voting No, none. ~onsi~.~~rati_on of Bids Liquid~,lorine - Hater Department & Ivi1ste Water Treatment Plant: The Water Superintendent and the City Engineer having checked the bids on the purchase of approximately 58,000 1bs of Liquid Chlorine for the water department and the waste water treatment plant recommended the bid of SEC Corporation, Billings. The City Manager concurred with the re- commendation of the Water Superintendent and the City Engineer and recommended the bid of SEC Corp- oration at $175.20 per ton, it being the most advantageous to the City of Bozeman. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Vollmer, sec- oncded by Commissioner Sedivy, that the bid of SEC Corporation be accepted at $175.20 per ton delivered and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer I I I I I I 107 Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Langohr; those voting No, none. At1~h2rity t~ Purchase Copper Pipe - Approximately $3,600.00: The Water department has need for copper pipe and the City Manager requested authority to pur- chase 3500 ft. of 3/4", 1000 ft. of I" and 500 ft. of 2" copper pipr in the approximate amount of $3.600.00. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Vollmer, that the purchase of the copper pipe be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vollmer, Commissioner Mo~row, Commissioner Grabow and Mayor Langohr; those voting No. none. Re_CJ..L~~~~2__Condu~~Parade - Antique Auto Club - 18 June 1971: A request received from the Antique Auto club for permission to conduct an Antique Gaslight Auto Parade on 18 June 1971 was presented. It was moved by Commissioner Vollmer, seconded by Commiss- ioner Sedivy, that the request to conduct the "Gaslight" Parade on 18 June 1971, at 8:30 o'clock p. m. in conjunction with the spring tour of the Montana Pioneer and Antique Auto Club be granted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Morrow. Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Commission Resolution No. 1463: To Insure Elected Representation - Planninp; Organiz.'1tion: Resolution No. 1463 declaring it to be the intention of the respective Commissions to insure elected representation from the City of Bozeman and County of Gallatin to establish an executive planning Committee with duties as announced herein but generally to include supervision of all planning functions as set forth, entitled Resolution No. 1463 A JOINT RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AND THE BOARD OF COUNTY COMMISSIONERS OF GALLATIN COUNTY DECLARING IT TO BE THE INTENTION OF THE RESPECTIVE COMMISSIONS TO INSURE ELECTED REPRESENTATION FROM THE CITY OF BOZEMAN AND COUNTY OF GALLATIN BE INCLUDED AMONG THE MEMBERSHIP OF THE BOZEMAN CITY-COUNTY PLANNING BOARD AND FURTHER DECLARING THE INTENTION OF THE RESPECTIVE COMMISSIONS TO ESTABLISH AN EXECUTIVE PLANNING COMMITTEE WITH DUTIES AS ANNOUNCED HEREIN BUT GENERALLY TO INCLUDE SUPERVISION OF ALL PLANN- ING FUNCTIONS WITHIN THE CITY OF BOZEMAN AND COUNTY OF GALLATIN WITH THE MEMBER- SHIP OF SAID COMMITTEE CONSISTING OF NOT LESS THAN 60% ELECTED AND POLICY SETTING OFFICIALS OF THE RESPECTIVE CITY AND COUNTY GOVERNMENTS PARTICIPATING IN THE PLANNING FUNCTIONS AND PROCESSES Following a discussion, the Commission concurred with the recommendation of the City Manager I an& it was moved by Commissioner Morrow, seconded by Commissioner Grabow, that Commission Resolution No. 1463 be passed and adopted and the Mayor and Clerk of the Commission be authorized to execute the resolution on behalf of the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none. :\uthoE.~c~L..!:.()_Attend ~P.W.A. Meeting Helena, 20-23 April 1971 - City_Engineer.~_Ass't. C~Sl:~: The American Public Works Association has scheduled a meeting to be held 20-23 April 1971 in Helena and the City Manager recommended that Ass't. Manager Keyes and City Engineer Fargo be authorized to attend the meeting. It was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the Ass't. City Manager and the City Engineer be granted authority to attend the meeting and their expenses be paid out of the appropriate fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Comm- issioner Morrow and Mayor Langohr; those voting No, none. Rep~rts : The Following reports were presented: Water Report Director of Public Service The City Manager commented on the reports and recommended the approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow. Commissioner Grabow and Mayor Langohr; those voting No, None. ~~ter ~f Condolence to the Paul Busch Family: It was moved by Commissioner Morrow. seconded by Commissioner Sedivy, that an appropriate letter of condolence be addressed to the family of Frances Busch and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none.
