The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 28 April 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow,
Commissi\oner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Frys1ie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Morrow opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular session held 21 April 1971 were approved as read.

Commissioner Vollmer, that the resolution be passed and adopted to become effective 1 July 1971 and

plans and Specifications covering the proposed improvements in Special Improvement District No.
499, for the construction of Paving North Seventeenth Avenue between t-Jest Beall Street and Durston
Road, Special Improvement District No. 500 for the construction of paving West Beall Street from North
Twentieth Avenue east to alley west of North Eighteenth Avenue and Special Improvement District No.
501 for the construction of paving a portion of South Sixteenth Avenue prepared by Thomas, Dean and
Hoskins, consulting engineers were placed before the Commission. In concurrence with the consulting
engineers, the City Manager recommended that the plans and specifications as presented be approved
and that a call for construction bids aId a sale of the district bonds in the maximum amount be
authorized. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the plans
and specifications be approved and the Clerk of the Commission be authorized and directed to publish
a "Call for Bids" for the construction of the improvements for Special Improvement District Nos. 499,
500 and 501 with an opening date of 19 May 1971, and to advertise for bids for the sale of bonds of
Special Improvement District No. lf99 in the approximate amount of $83,OOO.0~ Special Improvement
District No. 500 in the approximate amount of $31,000.00 and Special Improvement District No. 501 in
the approximate amount of $22,500.00 to be received 26 May 1971 and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Comm-
issioner Morrow, Commissioner Grabow and Mayor L8ngohr; those voting No, none.

The sixteenth Annual Attorney General's Law Enforcement Conference is scheduled to be held in
Helena, 20-21 May 1971. The Chief of Police requested authority to attend the conference. It was
moved by Commissioner Vollmer, seconded by Commi.ssioner Sedivy, that the Chief of Police he authorized
to attend the conference and, it being in the public interest, his expenses be paid from the General
fund and the motion waS carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow and Mayor Langohr; those voting
No, none.
Proclamation, Legion POPPY~f;J.. 21-22 May J221:
A letter received from Mr~. Hazel Roys, Poppy Chairman American Legion Auxiliary, requesting that
the Mayor proclaim 21-22 Mayas "Poppy Day" in the City of Bozeman was presented.
In accordance with the above request, Mayor Langohr proclaimed 21-22 May 1971 as "Poppy Day"
and urged every citizen to give generous recognition to this program and to obtain and wear a Mem-
orial Red Poppy on these days. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that this proclamation be approved and endorsed and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner MorroW, Commissioner Grabow, Comm-
issioner Vollmer and Mayor Langohr; those voting No, none.

those voting No, none.
Kennel License:
A letter received from Thomas L. Eversman requesting a kennel license for three male hunting
dogs in accordance with Ordinance No. 5.16.040 of Bozeman Municipal Code was presented. It was moved
by Commissioner Morrow, seconded by Commissioner Grabow, that the request for kennel license in the
amount of $20.00 be approved and the motion was carried by the followinG Aye and No vote: those
voting Aye being Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy
and Mayor Langohr; those voting No, none.

A letter received from Mr. Gene Goben. District Executive, Yellowstone Valley Council of the
Boy Scouts of American, requesting permission to hold the Annual "Cub Scout Days" on 26-27 July
1971 at Bogart Grove was presented. In concurrence with the recommendation of the City Manager, it
was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the request be approved and
the motion was carried by the following Aye and No vote: those voting Aye being Oommissioner Grabow,
Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No,
none.

A request from Mr. Mike Roberty of Bozeman Senior High School for permission to conduct a Candy
Sale starting Thursday =29 April 1971- for a period of one week, the fund to be used to pay the bands
expenses to attend and compete in the Moose Jaw Saskatchewan Band Festival for three days, was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Bozeman Senior High
School Band members be granted permission to conduct the Candy Sale for a period of one week and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow and Mayor Lan80hr; those voting No, none.
Mobile Units - Traffic Hazard:

Mr. Clifford Cullen owner of the Cullen Corner Grocery appeared before the Commission to protest
against a mobile unit operating in Bozeman during the summer months to dispense grocery and refresh-
ments on streets. The safety aspect of children crossing streets and the refusal of granting a lic-
ense due to competition was discussed by the Commission. The commission informed Mr. Cullen, that
they cannot refust to grant a license based on competition, but the safety aspect would be considered
by the Commission if a license is applied for.

It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the City Attorney
be instructed to draw up a resolution changing the time of Commission Meetings from 1:00 o'clock
p.m. to 1:15 o'clock p.m. each Wednesday and the motion was carried by the following Aye and No vote;
those voting Aye being Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner
Vollmer and Mayor Langohr; those voting No, none.

There being no further business to come before the Commission at this time, it was moved by
Commissioner Morrow, seconded by Commissioner Grabow, that the meeting be adjo~rned and the motion
