The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 17 March 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm-
issioner Grabow, Commissioner Vollmer, Commissioner Sedivy, City Manager Fryslie, City Attorney Berg
and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 10 March 1971 were approved as read.
Authority to Attend A.W.W.A. - W.P.C.A. Meeting - 24-27 March 1971:
The American Water Works Association and the Montana Water Pollution Control Association Con-
vention is scheduled to be held in Great Falls, 25-27 March 1970 and in concurrence with the recommend-
ation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Grabow,
that the City Engineer, Water Superintendent and Waste Water Plant Operator be authorized to attend
the convention and, it being in the public interest, their expenses be charged to the appropriate
fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow. Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr: those
voting No, none.
Veteran of Foreign Wars Auxiliary Poppy Sale -"Poppy Day" 15 May 1971:
A letter received from the Veterans of Foreign Wars Auxiliary designating 15 May 1971 as "Poppy
Day" and permitting the sale of the "Buddy Poppy" was presented. It was moved by Commissioner Grabow,
seconded by Commissioner Vollmer, that permission to conduct the fund drive on 15 May 1971 be granted
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those
voting No, none.
Continuation Certificate of License Bond .:.. New Mannix Electric:
In compliance with Chapter 15 of the Bozeman Municipal Code, the Electrical Bond of New Mannix
Electric, Bozeman, was presented. The City Manager stated the Building Inspector had recommended
approval of the above mentioned bond and the City Attorney had approved the bond as to form. It was
moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the continuation of the afore-
mentioned bond be approved and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow and
Mayor Langohr; those voting No, none.
Consideration of Bids - Tractor-Backhoe-Loader:
It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that consideration of
bids on the purchase of a Tractor-Backhoe-Loader be continued for a period of one week until 24 March
for the purpose of obtaining additional information and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow, Commissioner Vollmer,
Commissioner Grabow and Mayor Langohr; those voting No, none.
Request for Sign Code Variance - State Farm Insurance to retain Plywood Sign:
A letter received from the State Farm Insurance requesting permission to retain a plywood sign
erected on the face of a building recently purchased by them was presented. Following a thorough
discussion, it was moved by Commissioner Sedivy, seconded by Mayor Langohr, that the request for sign
code variance be continued for a period of at least one week for further consideration and final
action and the motion was carried by the following Aye and No vote: those voting Aye being Commission-
er Sedivy, Commissioner Grabow, Commissioner Vollmer, and Mayor Langohr; those voting No, being
Commissioner Morrow.
Bozeman Symphony Society - Membership Drive 12 April--2 May 1971:
A letter received from Mrs. Herbert Agocs, Secretary of the Bozeman Symphony Society requesting
permission to hold their annual membership drive from 12 April to 2 May 1971 was presented. The
Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner
Morrow, seconded by Commissioner Grabow, that the request to hold the membership drivebe granted and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow,
Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Authority to Attend Montana League of Cities Meeting - Helena, 18 March 1971, C~mmission & M0nager~
It was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the City Commission
and the City Manager be authorized to attend the meeting of the Montana League of Cities Board of
Directors and Legislative Committees to be held in Helena, 18 March 1971, and the expenses be paid

from the General fund and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow
and Mayor Langohr; those voting No, none.
Dedication of Alley - Block 2, Durston 2nd Subdivision:
A letter received from Douglas Drysdale along with a Certificate of Dedication whereby Howard
Nelson and Karen Nelson owners of the North Twenty - five feet of Lot Twelve in Block Two of Dur-
ston's Second Subdivision granted, donated and dedicated to the City of Bozeman the North Twenty- I
five feet of Lot Twelve in Block 2 of Durston's Second Subdivision for the use of the public as an
alley and public way was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Certificate of
Dedication be accepted as presented. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner
Grabow and Mayor Langohr; those voting No, none.

The City Manager commented on the reports and recommended the approval thereof. It was moved
by Commissioner Sedivy, seconded by Commissioner Morrow, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, and Mayor Langohr;
those voting No, none.
Commission Resolution No. 1460 Set Public Hearing on Zone Code Amendments
COMMISSION RESOLUTION NO. 1460
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO
RECLASSIFY AND CHANGE FROM A CLASS "A" RESIDENTIAL ZONE TO MOTOR
BUSINESS ZONE THE EAST 150 FEET OF LOTS 8~B AND 8~C OF THE HOMESITES
ADDITION TO THE CITY OF BOZEMAN, MONTANA.
In Concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow
seconded by Commissioner Grabow, that Resolution No. 1460 be passed and adopted and that Wednesday,
7 April 1971, be the date set for public hearing and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer,
Commissioner Sedivy and Mayor Langohr; those voting No, none.
Solid Was te Mangement School 23-26 March 1971, Ellcnsburg, Washington - Robert F. Keyes:
It waS moved by Commissioner Grabow, seconded by Commissioner Vollmer,that Ass't. City Manager
Keyes be authorized to attend the Solid Waste Management Course to be held 23-26 March 1971 in
E11ensburg, Washington, and, it being in the public interest his expenses be paid from the Sanita-
tion Department and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor
Langohr; those voting No., none.
