The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 13 January 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow,
Commissioner Sedivy, Commissioner Grabow, Commissioner Vollmer, City Manager Fryslie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Mayor Langohr opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held Wednesday, 6 January 1971, were approved as read.

It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that consideration of
Ordinance No. 904 be continued for a period of one week and brought back for action at the next
regular meeting of the Commission. The motion was carried by the follmving Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Morrow, COTIlmissioner Grabow, Commissioner Vollmer,
Mayor Langohr, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk.

The Certificate of the engineer of Thomas, Dean & Hoskins, Inc., on the construction of the
Bozeman Sanitary Sewers Project by the Felton Construction Company have been completed in accordance
with the terms and stipulations given in the plans and specifications for such work, with exceptions
for replacing certain sections of asphaltic and concrete pavement, as noted on pay estimate No. 12-
Final, was presented. The City Manager concurred in the recommendation of the engineers and recommended
that the project be accepted and final payment made and that final acceptance and payment does not
relieve the contractor of the responsibility for negligence or faulty material or workmanship with-
in the extent and period provided by law. The Contractor has deposited $7,500.00 with the City to
assure completion of the pavement repairs when weather permits. The Contractor has furnished a
performance bond equal to 100 percent of the contract price, to guarantee materials and workmanship
for a one-year p~riod commencing upon final acceptance.
It was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that as reconlmended the
project be accepted as completed and the Director of Finance be directed to iSsue a warrant in pay-
ment of $8,Ot~1.4l to Felton Construction Company and final payment of gross receipts tax to the State
of Montana in the amount of $13,331.66 for the construction of the Bozeman Sanitary Sewers Project
No. Mont-125 and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Grabow, Commissioner Vollmer, Commissioner Morrow, Con~issioner Sedivy and Mayor Langohr;
those voting No, none.

It was moved by Commissioner Morrow, seconded by Commissioner Grabow, that the Commission
concur in the appointments and reappointments of the Mayor and the motion was carried by the Follow-
ing Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Grabow, Commissioner
Sedivy, Commissioner Vollmer and Mayor Langohr; those voting No, none.

A letter received from the Bozeman City-County Planning Board in regard to the request by the I
Senior Social Center for revisions in the zoning requirement in the efficiency, one bedroom apart-
ment and also to reduce the requirement of off-street parking was presented.
Following a discussion, the Commission concurred with the recommendation of the City Manager
and it was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that the matter be referred
to the Board of Adjustment along with a request dated 25 November 1970 from Wayne Edsall Construction
Company, Tract 8C and Part of Tract 8B, Homesite Subdivision to rezone his land from Class A Resident-
ial to Motor Business to schedule a public hearing at an early date resulting in a recommendation
from them to the City Commission and the motion was carried by the following Aye and No vote: those

and recommended the approval thereof. It was moved by Commissioner Sedivy, seconded by Commissioner

Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none.
