HomeMy WebLinkAbout1971-02-03 I I I Bozeman, Montana 3 February 1971 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 3 February 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, CityManager Fryslie, Ass't City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had: Minutes of the regular meeting held 27 January 1971 were approved as read. Proclamation, February "Heart Month:" Several members from the Heart Association appeared before the Commission to request Mayor Langohr to proclaim February to be "Heart Month" and 14 February to be ''Heart Sunday." In con- currence with their wishes, Mayor Langohr issued the proclamation calling upon all citizens to support this important drive with their gifts and voluntary services. It was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Mayor's proclamation be approved and endorsed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow and Mayor Langohr; those voting No, none. License Bonds - Western Plumbing & Heating, Wilson & Company - Sheet Metal: In compliance with Chapter 16 of the Bozeman Municipal Code, the plumbing and heating bond of Western Plumbing and Heating and the Sheet Metal bond of Wilson & Company was presented. The City Manager stated the Building Inspector had recommended approval of the above mentioned bonds and the City Attorney had approved the bonds as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow. that the continuation of the aforementioned bonds be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss- ioner Sedivy, Commissioner Morrow, Commissioner Grabow and Mayor Langohr; those voting No, none. Authority to "Call for Bids" 50.000 lbs. Sodium Silicofluoride, to be opened 24 February 1971: The Water department has a need to replenish its supply of sodium silicofluoride for use as an additive to the City' Water supply and the City Manager requested that the purchase of 50.000 lbs be authorized. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the purchase as requested be authorized and the Clerk of the Commission be directed to issue a "Call for Bids" for the purchase of 50.000 lbs. sodium silicofluoride, to be opened 24 February 1971 and the motion was carried by the following Aye and No ,vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting No, none. Consideration of Bids, Motor Grader: The Commission was referred to the opening of bids for the Motor Grader for use by the Street Department on 27 January 1971. The bids having been tabulated and analyzed. the City Bnigeer and the Street Superintendent recommended to the City Manager the purchase of the 1971 Cleveland D-562 Motor Grader on the basis of their net base bid with the guaranteed repurchase price of $35,600.00. it being the lowest bid and equaling or exceeding the specifications as contained in the "Call for Bids." The City Manager. after due consideration, recommended to the City Commission that all bids submitted be rejected and that they keep the Galion Grader and in so doing the buy back guarantee now available to the City Expire. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Vollmer, that all bids be rejected and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner MorroW, 83 84 Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow and Mayor Langohr; those voting No, none. Confirmation of Police Officer Richard J. Stelzer: A letter received from Chief of Police Robert Johnson, concurred in by the City Manager, inform- ing the Commission that Officer Richard J. Stelzer had satisfactorily completed the required six month probationary period and recommending that Officer Stelzer be confirmed as a regular officer of the Bozeman Police Department effective 1 February was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the confirmation of Police Officer Richard J. Stelzer be app- roved and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- I ioner Vollmer, Commissioner Grabow, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Authority to Attend FBI National Academy - Officer Douglas C. Taylor: An invitation has been received by the Chief of Police from J. Edgar Hoover, Director of the Federal Bureau of Investigation of the Department of Justice for Bozeman Police Officer Douglas C. Taylor to attend the 87th Session of the FBI National Academy beginning 12 April 1971. The cost of the school and transportation to and from Bozeman is paid by the FBI. Cost to the City will be Taylor's wage of which 60 percent may be returned under the Omnibus Crime Bill if an application is approved by the Crime Control Commission. The City Manager pointed out that this invitation from Mr. Hoover is splendid recognition of the City of Bozeman and strongly recommended commission approval of the acceptance of this invitation. It was moved by Commissioner Grabow, seconded by Commissioner Vollmer, that Police Officer Douglas C. Taylor be granted leave of absence with pay to attend this school and that his actual expense for such attendance be paid from the General fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Grabow, Commiss- ioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Proposal "Time Outdoor, Inc., Placing Benches and Trash Recepticles: The proposal of Time Outdoor, Inc., to place a certain number of benches and trash receptacles on both private and public property throughout the City of Bozeman was presented following a week of study. The Commission concurred in the recommendation of the City Manager, that adhering to a long established policy of not entering into any type of commercial franchise or permit on public property particularly public streets, and it was moved by Commissioner Morrow, seconded by Commissioner Vollmer, I that a letter be addressed to Mr. Rupp of Time Outdoor, Inc., denying his request to locate the ben- ches and trash receptacles on any City property and to encourage Mr. Rupp to approach private property owners tn : 'regard to the above proposal and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Morrow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Grabow, Commissioner Langohr; those voting No, none. Hearing. Resolution No. 1l~51 - Paving Beall, No. 18th to No, 20th, Resolution 1456 Creating SID 500: This was the time and place set in Commission Resolution No. 1456 to hear protests to the creation of Special Improvement District No. 500. Affidavit of publication of Notice and the Clerk's mailing certificate stating that all property owners had been notified as required by law were presented. The City Manager informed the Commission that as of 5:00 o'clock p.m., 1 February 1971, there were no protests on file and no one appeared to verbally protest the creation of the district. The City Manager recommended that the City Attorney be instructed to prepare a resolution creating the district: COMMISSION RESOLUTION NO. 1456 A RESOLUTION OF mE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 500 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRU- CTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT TOGETHER WITIl INTREGAL CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTANCES THERETO, ALSO CONSTRUCTION AND RECONSTRUCTION OF NECESSARY DRAINAGE INLETS AND OTHER APPURTENANCES TO THE STORM DRAINAGE SYSTEM ON THAT PORTION OF WEST BEALL FROM NORm 1WENTIEm AVENUE EAST TO ALLEY WEST OF NORTH EIGHTEENTH AVENUE. prepared by the City Attorney was presented. In concurrence wi th the recommendation of the City I Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Vollmer, that the Resolution be passed and adopted to Create Special Improvement District No. 500 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vollmer, Commissioner Morrow, Commissioner Grabow and Mayor Langohr; those voting No, none. Hearing, Reso'lution No. 1452 - Paving Portion of So. 16th, Resolution No. 1457 Creating SID 501: This was the time and place set in Commission Resolution No. 1452 to hear protests to the creation of Special Improvement District No. 501. Affidavit of publication of Notice and the Clerk's mailing certificate stating that all property owners had been notified as required by law were presented. There being no written protests on file and no one having appeared to protest, Commission Resolution I I I 85 No. 1457 creating Special Improvement District No. 501, entitled: COMMISSION RESOLUTION NO. 1457 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 501 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND IN- STALLING AN ASPHALT-CONCRETE TYPE PAVEMENT, TOGETIlER WITH INTREGAL CON- CRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES THERETO, ON A PORTION OF SOUTH SIXTEENTH AVENUE. PREPARED BY THE City Attorney was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded by Commissioner Sedivy, that the Resolution be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow and Mayor Langohr; those voting No, none. Reports: The following reports were presented: Police Chief (Annual) Building Inspector Librarian Fire Chief (Annual) Fluoridation Police Judge The City Manager commented on the above reports and recommended the approval thereof. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Grabow, Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Claims: Claim No. 10077 thru 10355 Inc., were presented on the various funds as follows: Band $ 30.82 Planning Board $ 1,765.14 Cemetery 2,426.56 Police Reserve 2,262.70 Garbage 6,778.19 SDS 5,491.91 General 33,817.01 Street 9,353.50 Library 4,146.80 Water 19,853.50 Park 5,767.64 Dr. Education 1,090.36 Parking Meter 2,297.07 Fire Relief 7,775.79 PERS 1,838.56 New Sewer Const. 1,254.66 $105,950.20 The City Manager checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and theDirector of Finance be directed to issue warrants in payment. It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Grabow, Commissioner Sedivy, Commissioner Morrow, aod Mayor Langohr, those voting No, none. Commend the Police Department and David E. Beardsley donating Space at Winter Fair for Booth: It was moved by Commissioner Sedivy, seconded by Mayor Langohr, that a letter be addressed to Chief of Police Johnson commending him and his department on the most impressive educational booth and the initiative displayed in this project and that a letter be addressed to Mr. David E. Beardsley of Long's Tire Service conveying our sincere appreciation for his generosity in donating the space forthis booth to the Police Department. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Grabow, Commissioner MOrrow, Commissioner Vollmer and Mayor Langohr; those voting No, none. Discussion of Labor Employment Policies: Business Representative of Teamster Local No. 53: Mr. Virgil Buettner, Business Representative of Teamster Local No. 53 appeared before the Commission to review action taken by the City Manager resulting in the lay-off of an employee of the City Water Department due to budget and fiscal problems. Mr. Buettner expressed the view that another employee with less seiority should have been dismissed. Following considerable discussion of the matter, Mayor Langohr thanked Mr. Buettner for his appearance, however no action was taken a t this time.
