The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 3 March 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm-
issioner Sedivy, Commissioner Vollmer, Commissioner Grabow, City Manager Fryslie, Ass't. City
Manager Keyes, City Attorney Berg and the Clerk.
Commissioner Grabow opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 24 February 1971 were approved as read.
''Walk for Mankind" - Spurs, Fangs & Circle K of Montana State University - Fund Drive:
A letter received from the Spurs, Fangs and the Circle K of Montana State University requesting
the permission and the moral support of the City of Bozeman to conduct a ''Walk for Mankind" fund
drive on Saturday, 1 May 1971, was presented. The proceeds from the drive will be used for a uni-
versal medical relief organization and a local organization not yet selected. It was moved by
Commissioner Vollmer, seconded by Commissioner Sedivy, that permission be granted the Spurs, Fangs,
and Circle K of Montana State University to hold the "Walk for Mankind" fund drive as outlined on
Saturday, 1 May 1971, and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow and Mayor
Langohr; those voting No, none.
Zone Code Amendments: Protests:
A petition signed by twenty-four property owners protesting any zoning variance from existing
Zone A on the East 100' of Lot 8-A and the East 150' of Lot 8-B, Homesite Subdivision owned by Wayne
Edsall was presented. Several property owners were also present to discuss the zoning variance.
Mrs. Esther Nelson of Nelson's Mobile Home made the two following proposals.
1. That three dwellings owned by herself and fronting on North Seventeenth
Avenue be rezoned from the present motor business to A-Residence.
2. That the City of Bozeman should establish a residence zoning for mobile
homes rather than permitting mobile homes only in motor business and
industrial zones as is now provided for in the Zoning Code.
Mayor Langohr advised the group that this matter was not on the agenda for official action
but that their comments were appreciated and a date will be set for a public hearing on the matter
before the City Commission in the near future.
Proclamation - Girl Scout Week, 7-13 March 1971:
Mayor Langohr announced his proclamation designating the week of 7-13 March 1971 as Girl Scout
Week recognizing fifty-nine years of service to girls aged seven through seventeen and urged all
citizens to support this worthy youth organization. It was moved by Commissioner Grabow, seconded
by Commissioner Vollmer, that the Mayor's proclamation be endorsed and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer,
Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Ordinance No. 904, Fire Code for Adoption:
Ordinance No. 904 amending Section 1304.010 of the Bozeman Municipal Code for the purpose of
prescribing regulations governing conditions hazardous to life and property from fire or explosion,
the provisions thereof shall be controlled within the limits of the City of Bozeman and within three
miles of the City Limits of the City of Bozeman, Montana, was presented, entitled:
ORDINANCE NO. 904
AN ORDINANCE AMENDING SECTION 1304.010 OF THE BOZEMAN MUNICIPAL
CODE AND ADOPTING THE 1970 EDITION OF THE FIRE PREVENTION CODE
RECOMMENDED BY THE AMERICAN INSURANCE ASSOCIATION; AMENDING
SUBSECTION (f) OF SECTION 16.75 OF SAID CODE, MAKING THIS ORD-
INANCE EFFECTIVE WITHIN THREE (3) MILES OF THE CITY LIMITS OF
THE CITY OF BOZEMAN AND REPEALING ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH.
Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow,
that Ordinance No. 904 amending Section 1304.010 of the Bozeman Municipal Code be passed and adopted
and the motion was carried by the following Aye and No vote: those voting Aye beiQgGommissioner
Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer and Mayor Langohr; those voting
No, none.
Variance from Curb Opening Code - Gallatin Manor:
A request from the Gallatin Manor 'for permission for a variance from twenty-feet to twenty-two
feet for each of the three curb openings located at 1702 to 1830 on West Beall Street was presented.
Following a discussion, it was moved by Commissioner Grabow, seconded by Commissioner Vollmer,
that a variance of an additional two feet for each of the three curb openings located on Beall

street as requested by the Gallatin Manor be granted and the motion WaS carried by the following
Aye and No vote: those voting Aye being Commissioner Grabow, Commissioner Vollmer, Commissioner
Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Authority to Call for Bids for SID No. 498, No. 17th Ave, between Beall & Durston Water Main
To be Opened 24 March 1971:
Plans and Specifications covering the proposed improvement in Special Improvement District
No. 498 for the construction of water mains on North Seventeenth Avenue between West Beall and
Durston Road, prepared by Thomas, Dean & Hoskins, consulting engineers, were placed before the
Commission. In concurrence with the consulting engineers, the City Manager recommended that the
plans and specifications as presented be approved and that a call for construction bids and a sale
of the district bonds in the maximum amount of $18,300.00 be authorized. It was moved by Commiss-
ioner Grabow, seconded by Commissioner Vollmer, that the plans and specifications be approved
and the Clerk of the Commission be directed to publish a "Call for Bids" for the construction of
the improvements for the district with an opening date of 24 March 1971, and to advertise for bids
for the sale of the bonds of District No. 498 in the approximate amount of $18,300.00 to be received
31 March 1971 and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Grabow, Commissioner Vollmer, Commissioner Sedivy, Commissioner Morrow and Mayor
Langohr; those voting No, none.

The City Manager commented on the reports and recommended the approval thereof. It was moved
by Commissioner Vollmer, seconded by Commissioner Sedivy, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Vollmer, Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow; ahdMayor Langohr;
those voting No, none.

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be directed to issue
warrants in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that
the claims be approved and the motion was carried by the Following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Morrow, Commissioner Grabow, Commissioner Vollmer,
Mayor Langohr and those voting No, none.
License Bonds - Epcon Company - $2,000.00 Sign Code: Wm. L. Lynas - $5,000.00 Plumber & Gas Fitter:
In compliance with Chapter 14 and 16 of the Bozeman Municipal Code, the Sign Bond of Epcon
Company and the plumbing and gas fitter bond of William S. Lynas was presented. The City Manager
stated the Building Inspector had recommended approval of the above mentioned bonds and the City
Attorney had approved the bonds as to form. It was moved by Commissioner Morrow, seconded by
Commissioner Grabow, that the aforementioned bonds be approved and the motion was carried by the
following Aye and No Vote: those voting Aye being Commissioner Morrow, Commissioner Grabow, Comm-
issioner Vollmer, Commissioner Sedivy and Mayor Langohr; those voting No, none.
