The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 6 January 1971, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow,
Commissioner Sedivy, Commissioner Grabow, Commissioner Volmer, City Manager Fryslie, Ass't. City
Manager Keyes, Ass't. City Attorney Andriolo and the Clerk.
Commissioner Morrow opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held Wednesday, 30 December 1970, were approved as read.
Seat Commissioners William E. Grabow and James W. Vollmer to December 31,. 197~:
Mayor Langohr called attention to the fact that this is the first meeting of the Commission to
be attended by Commissioners William E. Grabow and James W. Vollmer thus increasLng the Commission
to five from three members. Terms of the new Commissioners will expire 31 December 1973. On behalf
of the entire City Administration, Mayor Langohr made appropriate expressions of welcome to the new
Commissioners and pledged full cooperation to ensure continued harmony and productive effort from
the City Commission.
Ordinance No. 903 - Vacate Portion of Alley Block 2, Durston's Second Suhdivision:
Ordinance No. 903 prepared by the City Attorney, vacating a portion of the alley in Block 2,
Durston's 2nd Subdivision was presented, entitled:

It was moved by Commissioner Sedivy, seconded by Conmlissioner Morrow, that Ordinance No. 903
be provisionally passed and adopted and the motion was carried by the following Aye and No vote:

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO
CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE-
MENT DISTRICT NO. 498 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION
OF AN EIGHT (8) iNCH CAST IRON WATERMAIN ON NORTH SEVENTEENTH BETWEEN
WEST BEALL AND DURSTON ROAD. THE CONSTRUCTION AND INSTALLATION OF
SAID WATERMAIN TO INCLUDE TRENCH EXCAVATION AND BACKFILL, INSTALLATION
OF CAST IRON PIPE, NECESSARY WYES AND TEES, PIPE BEDDING MATERIAL AND

Ordinance No. 904 prepared by the City Attorney amending, Section 1304.010 of the Bozeman Municipal
Code and adopting the 1970 edition of the Fire Prevention Code recommended by the American Insurance

association and repealing all ordinances and parts of ordinances in connection with Self Service
Gas Stations was presented.
Following a review of the ordinance prepared by the City Attorney, the Commission concurred
with the recommendation of the City Manager, that the ordinance be taken under advisement for a week
to be presented on Wednesday. 13 January 1971.

A letter received from Albertson's, Inc., of Boise, Idaho, requesting the vacation of the por- I
tion of Juniper Street between North Fifth and North Seventh Avenue, the north-south and east-west
Alley between Tamarack Street and Juniper Street and that portion of the north-south Alley lying
south of the east-west Alley lying between Juniper Street and Hemlock Street all located in Block
3 and 4 of North Seventh Addition was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Grabow, that the request be accepted
and approved and the City Attorney be instructed to draw the resolution of intention reserving unto
the City of Bozeman utility easements for existing water and sewer mains and proposed water main
extensions, an easement for an existing sanitary sewer main and natural gas installations in said
portion of alley and making the vacation contingent upon the proposed new shopping facility being
actually constructed by Albertsons and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vollmer, Commissioner Grabow, Commissioner Morrow, :ommissioner Sedivy,
and Mayor Langohr; those voting No, none.

In compliance with Chapter 15 of the Bozeman Municipal Code, the Certificate for the Electrical
Bond of Central Electric, Billings, was presented. The City Manager stated the Building Inspector
had recommended the approval of the bond which has been approved as to form by the Ass't. City
Attorney. It \018S moved by Commissioner MorroW, seconded by Commissioner Vollmer, that the above
mentioned bond be approved and the motion was carried by the following Aye and No vote~ those voting

A letter received from the Board of Railroad Commissioners whereby the Board adopted a policy
of granting suspensions of MRC Certificates only on a yearly basis was presented.
Followi.ng a discussion, it was moved by Commissioner Grabow, seconded by Commissioner Morrow,
that the Board of Railroad Commissioners be requested to continue the present suspension of the City
of Bozeman MRC Certificate No. 3029 for a period of one year from 1 January 1971m avoid the can-
cellation of the certificate and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Grabow, Commissioner MorroW, Commissioner Sedivy, Commissioner Vollmer
and Mayor Langohr; those voting No, none.

The City Manager checked on the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be directed to issue
warrants in payment. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that

the claims be approved and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Morrow, Commissioner Sedivy, Commissioner Vollmer, Commissioner Grabow and

The City Manager reported that the five year guarantee on the Model TSOO Galion Grader purchased
for the Street department in January of 1966 has expired and requested authorization to call for bids
for a new grader with a guaranteed maximum repair parts cost for a five year period or a new purchase
price.
Following a discussion, it was moved by Commissioner Grabow, seconded by Commissioner MOrrow,
that the call for bids for the grader be authorized at a total cost guaranteed buy-back bid with
alternate bid without guaranteed repair or buy back and that the Clerk of the Commission be directed
to issue a "Call for Bids" for the purchase, bids to be opened on Wednesday, 27 January 1971, and
the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner
Grabow, Commissioner Morrow, Commissioner Sedivy, Commissioner Vollmer and Mayor Langohr; those
voting No, none.
