HomeMy WebLinkAbout1970-10-28 55 Bozeman, Montana 28 October 1970 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 28 October 1970, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: I Minutes of the regular session held 21 October 1970 were read and approved as corrected. Application for Beer License - John D. Taggart, Conoco Travel Shoppe, 1325 E. Main Street: The application for a one-half year Beer License together with the required fee from John D. Taggart of the Conoco Travel Shoppe, 1325 East Main Street, Bozeman, was presented. The City Manager and the Chief of Police stated that they had no reason to believe that the business would warrant disapproval of the application. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the above application be approved therewith and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Declare Action Under Resolution No. 1444 and Ordinance No. 901 Invalid: The City Manager reported that it appears from the record that a clerical error occurred in the description of the subdivision whereby the City Commission desired to vacate an alley in that the alley was described as located in Block 3 of Tracy's Third Addition whereas it was the intention of the City Commission to vacate the alley in Block 3 of Bealls Third Addition and it further appears that Notice of Intention to create the alley was in fact served in the manner required by law on all lot owners of Block 3 of Beall's Third Addition but that no service has been made upon the owners of Lots abutting the alley in Block 3 of Tracy's Third Addition. Therefore the Commission acting upon the recommendation of the City Manager and the opinion of the City Attorney, that the City Commission has not acquired jurisdiction to vacate the alley in Block 3 of Tracy's Third Addition, it was moved by Commissioner MOrrow, seconded by Commissioner Sedivy, that Resolution No. 1444 and Ordinance No. 901 heretofore adopted by the Commission relative to the vacation of the Alley in Block I 3 of Tracy's Third Addition be invalidated and declared null and void and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy, and Mayor Langohr; those voting No, none. Commission Resolution No. 1445 - Intent to Vacate Alley in Block 3, Bealls Third Addn.-Hearing 18 Nov.: Commission Resolution No. 1445, set forth in full: A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DE- CLARING IT TO BE THE INTENTION OF SAID COMMISSION TO VACATE THE DEDICATED ALLEY IN BLOCK 3, BEALLS THIRD ADDITION TO BOZEMAN, MONTANA. prepared by the City Attorney as directed by the Commission was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that Resolution No. 1445 be passed and adopted and 18 November 1970 be set as the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow, and Mayor Langohr; those voting No, none. Petition for Paving Improvements - South 16th Avenue: A petition signed by property owners abutting on South Sixteenth Avenue requeSing the creation of a Special Improvement District for the construction of all necessary drainage, curbs and gutters, and paving on South Sixteenth Avenue was presented. Following a discussion, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the City Attorney, upon receiving the necessary information from the City Engineer, be instructed to prepare a Resolution of Intention initiating a Special Improvement District for the construction I of drainage, curbs and gutters, and paving on South Sixteenth Avenue and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Schedule of Charges - City Landfill: The City Manager reported that it has become necessary to increase the schedule of dumping individual loads and presented the following proposed schedule of dumping charges for the consider- ation of the Commission. 56 DUMPING CHARGES Description Amount Current Proposed Passenger Cars, Pickups, etc. Load $ .75 $1. 25 3/4 to 1-1/2 Ton Trucks Load 1.50 2.25 Over 1-1/2 Ton Trucks Load 3.00 4.00 I Car Bodies Each 5.00 Large Tree Stumps or Trunks Each 5.00 5.00 The City Manager also stated that there will be no car bodies or large metal objects dumped at the City Landfill under present policy. A general discussion was had and it was moved by Comm- issioner Sedivy, seconded by Commissioner Morrow, that the above dumping schedule be approved and put into effect 1 December 1970. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Ad;ournment: There being no further business to come before the Commission at this time, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissi er Sedivy, Commiss- ioner Morrow and Mayor Langohr; those voting No, none.
