The Commission of the City of Bozeman met in regular session in the Commission Room, Munici.pal
Building, 26 August 1970, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm~
issioner Sedivy, City Manager Fryslie, Ass't City Manager Keyes, Acting City Attorney Angel and the Clerk.
Commissioner Morrow opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 19 August 1970 were read and it was moved by Commissioner
Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was I
carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner
Morrow and Mayor Langohr; those voting No, none.
Open Bids - 20,000 lb. G.V.H. Dump Truck: Street Department:
This was the time and place set for opening bids on a new 20,000 pound G.V.W. Dump Truck for
use by the Street Department. The affidavit of publication of the "Call for Bids" was presented. It
was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bids be opened and read
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none.
The following bids were then opened and read~

Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Comm~
issioner Morrow, that the bids be referred to the City Engineer and the Street Superintendent for
checking and recommendation to be made to the Commission at their next meeting on Wednesday, 2 Sept-
ember 19~0 and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Open Bids Bituminus Distributo~ - Street Department:
This was the time and place set for opening bids on a trailer mounted Bituminous Distributor
for use by the Street Department. The affidavit of publication of the "Call for Bids" was presented.
It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bid of Industrial
equipment Company of Billings be opened and read and the motion was carried by the following Aye and I
No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr.j those
voting No, l'lone.

Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by
Commissioner Morrow, that the bid of the Industrial Equipment Company be referred to the City En-
gineer and the Street Superintendent for checking and recommendation to be made to the Commission at
their next meeting on Wednesday, 2 September 1970, and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr;
those voting No, none.
Open Bids - Gasoline, Diesel and Kerosene SUJU?,ly for One Year to 30 June 197,1:
This was the time and place set for opening bids from Gasoline, Diesel fuel and Kerosene
suppliers to furnish the City of Bozeman approximately 50,000 gallons of regular gasoline, approxi-
mately 10,000 gallons of No. 2 Diesel and approximately 1,000 gallons Kerosene to 30 June 1971
The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the bids be opented and read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Sedivy and Mayor Langohrj those voting No, none.

Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by
Commissioner Morrow, that the bids be referred to the City Engineer and the Street Superintendent

,:.!.~,-?ee Vehicle Safety Check - 11-12 September 1970:
A request from the Jaycees for permission to hold a ten-point Vehicle Safety Check Program
on Main Street in front of the Willson School on 11-12 September was presented. I t was moved by
Commissioner Morrow, seconded by Commissioner Sedivy, that the ten-point Vehicle Safety Check Pro-
gram be approved contingent upon approval of school authorities at Willson School and that Mayor
Langohr's proclamation proclaiming 7-13 September as Bozeman Safety Check Week as requested by Bozeman
I Jaycees be endorsed and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Morrow, Commissioner Sedivy, and Mayor Langohr; those voting No, none.
License Bond :~umbi~g, Everett Egbert:
In compliance with Chapter 16 of the Bozeman Municipal Code, the Plumher bond of Everett
Egbert, Bozeman, was presented. The City Manager stated the Building Inspector had recommended the
approval of the above mentioned bond and the City Attorney had approved the bond as to form, It
was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the bond be approved and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Morrow and Mayor Langohrj those voting No, none.
~~ques t to Soil Conservation for Flood Plain Survey of East Gallatin River:
During the last meeting of the East Gallatin Water Resources Committee the Committee recommended
that the City of Bozeman and the Gallatin County Jointly request the soil conservation service to
conduct a Flood Plain Survey for the East Gallatin River Watershed.
Following a discussion, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy,
that Mayor Langohr be authorized and directed to sign the letter addressed to the Soil Conservation
Service for the City of Bozeman requesting that such a survey be undertaken at the earliest possible
time and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.

The City Manager commented on the reports and recommended the approval thereof. I t was moved
by Commissioner Morrow, seconded by Commissioner Sedivy, that the reports be approved and ordered
filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Application for Beer Li"ens~:
The application for a one-half year City Beer License, together with the required fee from
Thomas Deibele of Tom's Junior Super Store and from Andrew A. Perlinski of the Town and Country
Grocery, Bozeman, was presented. The City Manager and the Chief of Police stated that they had no
information relative to either business that would warrant disapproval of the application. It was
moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the above application be approved
therewith and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.
Discussion - North Seventh Avenue (U.S. Highway No. 10) Traffic Regulations:

Approximately 110 people were present for a discussion with the City Commission and Paul Poirer,
Traffic Engineer, and Leon Schneider, Ass't. Traffic Engineer for the Montana State Highway Department,
concerning traffic controls along North Seventh Avenue to accomodate pedestrian crossing for young
school children as well as other pedestrian and vehicular traffic movement.
Mayor Langohr opened the discussion with comments explaining the background of previous efforts
to improve pedestrian crossing conditions along North Seventh Avenue.
Attorney Richard Andriola acted as spokesman for the group of concerned parents and following
I a lengthy discussion of the subject, Mr. Poirer assured those present that a traffic survey in the
area will be conducted in early October 1970 and if the results warrant installation of electric
signals they could be in place in the summer of 1971.
Considerable discussion was also entered into concerning the possibility of establishing adult
crossing guards as an interum measure. Mr. Milton Negus, Superintendent of Schools expressed his
interest on behalf of School District No. 7 in cooperating with the City to insure safe pedestrian
crossings for school children along north seventh avenue when it is determined what the best course
of action will be.

Tl1bulat ion of Elec tion Returns - Spec~al Primary El:.ction held 25 August 1970:
Under the provisions of Section 11-3217, R.C.M. , 1947, and this being the first legal day
after the Clerk of the Commission had received the returns of the Special Municipal Primary Ele-
ction held Tuesday, 25 August 1970, the Clerk of the City Commission aided by the City Commission
proceeded to canvass the said returns. The results of the canvass were as follows:

It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the Clerk of the
Commission issue certificates of nomination to each person nominated by a plurality of votes and that

dates for the office of Commissioner of the City of Bozeman at the regular municipal election to be
held Tuesday, 3 November 1970, and the motion was carried by the following Aye and No vote: those
