The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 5 August 1970, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow,
Commissioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and
the Clerk.
I Commission Sedivy opened the meeting with a prayer and the following proceedings were had:
Minutes of the regular meeting held 29 July 1970 were read and it was moved by Commissioner
Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the clerk.
Hearing Resolution No. 1433, Intention to Create SID 497:
This was the time and place set in Commission Resolution No. 1433 to hear protests to the creat-
ion of Special Improvement District No. 497. Affidavit of publication and Notice of the Clerks
mailing certificate stating that all property owners had been notified as required by law was pre-
sented. The City Manager presented protests filed with the Clerk of the City Commission and signed
by owners of property representing 56.1% of the proposed district.as determined by the City Engineer.
Several property owners were present to affirm the writaDprotests to the creation of Special Improve-
ment District No. 497. Following a thorough discussion and the City Commission having determined the
protests to be sufficient, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that
uhder the provisions of Section 11-2205, R.C.M., 1947, no further proceedings shall be had under
Commission Resolution No. 1433 and the motion was carried/by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
~~d Opening - Alley Improvements HB-436 Project 212(04):
This was the time and place set for receiving bids for construction of three blocks of Alley
between Tenth and Eleventh Avenue, Beall Street and Durston Road. Affidavit of publication of
"Notice to Bidders" was presented. One sealed bid was on file and it was moved by Commissioner Morrow,
I seconded by Commissioner Sedivy, that the bid be opened and read and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor
Langohr: those voting No, none.
The following bids were then opened
Long Construction Company - Billings - $7,100.00
The bid of Long Construction Company was referred to the engineers for final tabulation and
recommendation for the construction of the improvements.
Hearing Appropriation Ordinance No. 898 - Budget for Fiscal Year 1970-1971:
This was the time and place set for public hearing on the Appropriation Ordinance No. 898 for
the fiscal year ending 30 June 1971.
Affidavit of publication of Notice of hearing was presented. No one appeared to verbally
protest and the Clerk of the Commission stated no formal protests had been filed in oposition to
the adoption and passage of the pro~ed ordinance and accompanying annual appropriation budget. In
concurrence with the recommendation of the City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Morrow, that no protests having been teeeived the Clerk of the Commission
be authorized and directed to publish the Ordinance as required by law, Section 11-3319, R.C.M.,
1947 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Morrow and Mayor SedivYj those voting No, none.
Unnumbered Resolution, Authority to Purchase Road Oil S tate Highway Departmen t 1 Year 7/1/70 to 6/30/71:
An unnumbered resolution authorizing the purchase of not to exceed 25,000 gallons of Road Oil
I during the fiscal year - 1 July 1970 to 30 June 1971 - for use by the street department in repairing
pavement and for sealing certain sectioBs:;of existing pavement within the City from the Montana State
Highway Department was presented as follows:

WHEREAS the City of Bozeman will have need during the fiscal
year July 1, 1970 - June 30, 1970, for road oils for use in repair-
ing streets and for sealing certain sections of existing pavement
within the City, and
WHEREAS the City of Bozeman does not have proper facilities
for handling and storing the needed quantities of oils, and
WHEREAS the Montana State Highway Department does have storage
facilities and normally does have quantities of the required types
of oils stored in Bozeman from which it can supply the quantities
needed by the City of Bozeman,

NOW, THEREFORE, BE IT RESOLVED:
Tha't an emergency does exist relative to the procurement
of roadoils by the City of Bozeman and the City Manager is here-
by authorized to purchase from the Montana State Highway Depart-
men t , from its stocks in storage in Bozeman, approximately twenty-
five thousand '25,000) gallons of road oil, this to be purchased I
from time to time during the fiscal year july 1, 197.0 ~ June 30,
1971, as needed by the City of Bozeman for repair and sealing of
existing pavements, and these quantities of road oils to be
purchased at cost plus normal handling charges.
Passed and adopted by the City Commission of Bozeman, Montana
at a regular meeting of said Commission held on the Stn day of
August, 1970.

i\uthority to Call for Bids for Dump Truck - Estimated cost $S,300.00:
The Street Department has need for one 1971 Model 20,000 pound G.V.W. truck, cab and chassos
in the approximate amount of $5,300.00 with no-trade, bids to be opened 26 August 1970. It was
moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the purchase of the dump truck
be approved and the Clerk of the Connnission be directed to issue a "Call for Bids" to be opened
26 August 1970, for the purchase of the truck and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those
voting No, none.
i\uthority to Call for Bids for Oil Distributor - Estimated Cost $5,000.00:
The Street Department has need for one trailer mo~nted Bituminous Distributor at an approximate I
cost of $5,000.00. The City Manager stated that specifications for the vehicle have been prepared.
It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the purchase of the
Bituminous Distributor be approved and the Clerk of the Commission be directed to issue a "call for
Bids" for the purchase to be opened 26 August and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those
voting No, none.
Contract Documents for Execution, Seal Coat Project 212-(08):
The Construction Agreement HB-436, for the State Highway Project 212(08) for the purpose of
seal coating was presented. In concurrence with the recommendation of the City Manager, it was moved
by Commissioner Sedivy, seconded by Commissioner Morrow, that the contract documents be approved as
presented and that the Mayor and the Clerk of the Commission be authorized to sign the Contract
documents for the City of Bozeman and the Motion was carried by the following Aye add No vote: those
voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Request to Use Band Shell - 20-21 August "New Hen" Vocal Group:
It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the request for the
"New Men" from Seattle to stage performances in Bogerts Park 20-21 August 1970 be granted and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner
Sedivy and Mayor Langohr; those voting No, none.
Authority to Purchase Tractor Hml1er, Cemetery - $1,44~.26:
The Cemtery Department has need for a tractor mower costing approximately $1,443.26 and the City
Manager requested authority to purchase the mower. It was moved by Commissioner Sedivy, seconded I
by Commissioner Morrow, that the purchase of a John Deere Tractor in the approximate amount of
$1,443.26 be authorized and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none.
Authoritl to purchase I'later Meters - Approximately $1,100.00:
The City Manager reported that it would be desirable to purchase aniadditional supply of Water
meters at an approximate cost of $1,100.00. It was moved by Commissioner Morrow, seconded by Comm-
issioner Sedivy, that the purchase be authorized and the motion was carried by the following Aye and
no vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those
voting No, none

~::.~_hority to Call for Bids - Fuel Supply for one Year to 30 June 1971:
The Ci.ty Manager requested authority to call for sealed bids from Gasoline, Diesel Fuel and
Kerosene suppliers to furnish the City of Bozeman, for a period of one year through 30 June 19~1,
with approximately 50,000 gallons regular gasoline, 10,000 gallons No. 2 Diesel and 1,000 gallons
kerosene. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the request
be approved and the Clerk of the Commission be directed to issue a "Call for Bids" to be opened
I 26 August 1970 and the motion was carried by the following Aye and No vote; those voting Aye
being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none.
Consideration of Construction Bids: Construction of Alley Improvements HB-436:
The City Engineers having completed their study of the bid submitted for the construction of
Alley improvements between Tenth and Eleventh Avenue, BeaU Street and Durston Road, recommended that
the bid of Long Construction Company, Billings, in the amount of $7,100.00, it being the only bid
submitted be approved and Long Consruction be awarded contract for construction on the basis of their
bid in the amount of $7,100.00 contingent upon approval of the Montana State Highway Department.
It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the construction of
three blocks of alley between Tenth and Eleventh Avenue, Beall Street and Durston Road be awarded
to Long Construction Company contingent upon receiving the Montana State Highway's written approval
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.

The City Manager commented on the reports and recommended their approval. It was moved by
Commissioner Sedivy, seconded by Commissioner Morrow. that the reports be approved and ordered filed
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none.

The City Manager checked the claims and found them to be true and lawful claims against the
City of Bozeman and recommended they be approved and the Director of Finance be directed to issue
warrants in payment. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that
the claims be approved and the motion was carried by the following Aye and No vote: those voting
aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none.
