HomeMy WebLinkAbout1970-07-29 21 Bozeman, Montana 29 July 1970 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 29 July 1970, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm- issioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedings were had: I Minutes of the Regular meeting held 22 July 1970 were read and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr- those voting No, none. Project Agreement HB-42 436 Funds - Highway Commission Seal Coating - 212(08): The Agreement HB-42 - 436, No. 212(08) between the Montana State Highway Department and the City of Bozeman for the construction, reconstruction, maintenance or repair of miscellaneous streets and alleys, including seal coat street improvements in the amount of $36,200.00 to be paid to the contractor directly by the Montana State Highway Department was presented. tn concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Agreement HB-436, 212(08) be approved and that the Mayor and the Clerk of the Comm- ission be authorized to sign the Agreement for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Authority to Purchase Fire Hose - 600 feet by 3 inch - $1,500.00: The fire department has an apparent need for 600 feet three inch fire hose at an approximate cost of $1,500.00. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the purchase be authorized and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr' those voting No, none. Authority to Attend International Fire Chief Association Meeting: The Western International Fire Chiefs Association have scheduled their seventy-fifth annual conference to be held in Seattle, Washington, 6-13 August 1970 and Fire Chief Huber requested auth- I ority to attend the conference. The Commission concurred with the Fire Chief, also concurred in by the City Manager, and it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that Fire Chief Huber be authorized to attend the conference and, it being in the public interest his expenses be paid from the General fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. Promotion of Police Officers: 1) Sgt. Earl G. Smiley, Jr., to Captain: 2) Police Officer George Tate to Sergeant: Following a thorough review of the three sergeant's files. the Chief of Police addressed a letter to the City Manager recommending the promotion of Earl G. Smiley, Jr., to Captain, effective 1 August 1970. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, tha t the City Commission concur in the promotion of Police Sergeant Earl G. Smiley, Jr., to Captain effective 1 August 1970 as announced by the City Manager and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. A letter dated 27 July from Chief of Police Robert K. Johnson and addressed to the City Manager, recommending the promotion of Police Officer George Tate to Sergeant effective 1 August 1970 was presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Commission concur in the promotion of Police Officer George Tate to Sergeant effective 1 August as announced by the City Manager and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Land Fill Dump Use Fees: Montana State University - Suhr HaulJn~('rvice: I Following an extensive study of the City of Bozeman Landfill Dump, it was apparant that the operating costs of the Landfill dump were far above the fee collected and it was determined that Suhr Hauling Service pay a fee of $700.00 per month and the Montana State University pay a fee of $300.00 per month, effective 1 August 1970 for use of the City of Bozeman Landfill Damp. The Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the Suhr Hauling Service pay the City of Bozeman a fee of $700.00 per month for use of the City of Bozeman Landfill Dump arid Montana State University pay a fee of $300.00 per month and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting NO, none. 22 proclamation - "Western Month" "Bozeman Roundup Iveek" 16-22 Augus t 1970: Mayor Langohr announced his proclamation of 16-22 August 1970 as "Bozeman Roundup Week" and August 1970 as "Western Month" in the City of Bozeman and urged all the citizens of this area to observe in an appropriate manner, such as wearing colorful and typical western attire on this special occasion, this tribute to the heritage of the "old West"j to support both the "Bozeman Roundup" and the Jaycee sponsored "Roundup" and to partake of the enjoyments of this feastive I occasion. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that this pro- clamation of the Mayor be endorsed and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Ordinance No. 899 - Amending Sidewalk Code: Ordinance No. 899 amending Section 9.36.010 and 9.36.020 of the Sidewalk Code of the Bozeman Municipal Code was presented as follows: ORDINANCE NO. 899 AN ORDINANCE AMENDING SECTION 9.36.010 AND 9.36.020 OF THE BOZEMAN MUNICIPAL CODEj PRESCRIBING A SIDEWALK WIDTH OF 10 FEET IN THE CEN- TRAL BUSINESS AND MOTOR BUSINESS DISTRICTj PROVIDING FOR VARIANCES IN THE WIDTH THEREOF BY THE CITY COMMISSIONj AND PROVIDING THAT ALL OTHER SIDEWALKS OF THE CITY OF BOZEMAN SHALL HAVE A MINIMUM WIDTH OF 5 FEET AND PROVIDING FOR TEMPORARY SIDEWALKS UPON PERMIT ISSUED BY THE CITY MANAGERj REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. Following a thorough discussion, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the proposed Ordinance be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none. Reports of Accounts - Water Department Unpayable Accounts to be Charged Off: It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the list of uncollec~ able water accounts accrued the last two years be declared uncollectable and charged off to bad debts and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner I Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none.
