HomeMy WebLinkAbout1970-07-01 9 Bozeman, Montana 1 July 1970 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 1 July 1970, at 1:00 o'clock p.m. Present were Mayor Langohr, Commissioner Morrow, Comm- issioner Sedivy, City ,anager Fryslie, Ass't. City Manager Keyes', City Attorney Berg and the Clerk. Commissioner Morrow opened the meeting with a prayer and the following proceedin8s were had: I Minutes of the regular session held 24 June 1970 were read and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Hearing Resolution No. 1432, Intent to Vacate Alley - Block C, Blacks Addition Dawes Subdivision: This was the time and place set in Commission ResolutionNo. 1432 for hearing protests to vacat- ing a portion of the dedicated alley of Dawes Subdivision of portions of Block C, Blacks Addition and fractional Lot 17 of Lindley and Guy's Addition of the City of Bozeman. Affidavit of publication of Notice was presented together with signed acknowledgement of service of Notice from owners of ed all abutting property. Following a discussion of the vacation of the alley with interest property owners attending the meeting and there being no protests on file, the City Manager recommended that the City Attorney be instructed to prepare an ordinance vacating the subject alley. In concurrence with the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the vacation of a portion of the dedicated alley of Dawes Subdivision be approved and that the City Attorney be instructed to prepare the ordinance wacating the alley and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Sidewalks on Beall Street, Firth Avenue to Seventh Avenue: The petition requesting that the City Commission reconsider their decision to order sidewalks installed on both sides of Beall Street between North Fifth Avenue and North Seventh Avenue was pre- sented for further discussion following a week of addttional study and an inspection of the area. I After full consideration and having examined the circumstances and having examined the circumstances at property locations the City Commission concurred in the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that they abate the sidewalk orders on sidewalks installed on both sides of Beall Street between North Fifth Avenue and North Seventh Avenue for this year and review and reconsider the matter next year and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Recommendation & Request for Retirement: Officer Albert B. Krueger, Chief of Police C. R. Cutting: A letter dated 17 June 1970 from Police Officer Albert B. Krueger addressed to the City Manager and requesting that he be passed from the active police force to the police reserve in accordance with Section 11-1818, R.C.M., 1947, effective the first of July 1970 and that payment be computed as stated in Section 11-1821, R.C.M., 1947 was presented. The Board of Trustees of the Police Reserve Fund at their meeting held 24 June 1970 recommended the request be approved by the City Commission. The City Manager paid tribute to Mr. Krueger who has served the City of Bozeman Police Department in an extremely conscientious and courteous manner for the past twenty years and recommended that his request be granted effective 1 July 1970. The City Commission concurred in the recommendation of the City Manager and commented on the efficient and courteous manned in which he performed his duties as police officer. It was moved by Commissioner MOrrow, seconded by Commissioner Sedivy, that Police Officer Albert B. K.ueger be passed from the active Police Force to the Police Reserve in accordance with his request and the motion was carried by the following Aye and No vote: those voting Aye being I Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. A letter dated 17 June 1970 from Chief of Police C. R. Cutting addressed to the City Manager and requesting that he be passed from the active to the police reserve in accordance with Section 11-1818, R.C.M., 1947, effective t~e ~eDty-first of July 1970 and that payment be computed as stated in section 11-1821, R.C.M., 1947, was presented. The Board of Trustees of the Police Reserve Fund met on Wednesday, 24 June 1970 to consider the request of Chief Cutting and recommend approval of the request to the City Commission. The City Manager paid tribute to Chief Ron Cutting and commended him on the outstanding job he has done while in office by upgrading the Police department and in the initiative he has shown in all 10 assignments as well as the recognition he received on the article written by him that appeared in the FBI Law Enforcement Bulletin and the U. S. Congressional Record and in turn recommended that his request be granted. Mayor Langobr. Commissioner Sedivy and Commissioner Morrow also paid tri- bute to Chief Cutting for the outstanding services he has rendered to the City of Bozeman and for t the excellence of the police department that be has maintained. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow. that Chief of Police C. R. Cutting be passed from the active police force to tbe Police Reserve in accordance with his request and the motion was carried I by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Change Order No.2 - Sanitary Sewers, Felton Construction Company $1,022.50: Change Order No. 2 on the New Sanitary Sewer Construction, FWPCA. Project No. Mont-125, pre- pared by Thomas. Dean & Hoskins, Inc., to become a part of the original contract for construction of improvements in the project described was presented as follows: A. Description - Extend Sanitary Sewers to West property lines of South Eleventh Avenue. B. Purpose - To complete installation before construction of new secondary highway on South Eleventb Avenue. proposed by tbe Montana State Highway Commission. C. Cost - Total increase to Contract - ~ $1,022.50 The City Manager concurred with the engineers and recommended the Change-Order No. 2 be accepted aad approved as presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that Cbange-Order No. 2 be approved and the Mayor and the Clerk of the Commission be authorized to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commis.ioner Sedivy and Mayor Langohr; those voting No. none. Authorit to Purchase Co 2 300.00: 'the City Manager desirable to replenish the City's stock of copper tubing and requested authority to purchase t~ing in the approximate amount of $2,300.00. In con- currence with the recommendation of the City Manager. it was moved by Commissioner Sedivy. seconded by Commissioner Morrow. that the purchase of the copper tubing be approved and the motion was carried I by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Commissioner Morrow and Mayor Langohr; those voting No. none. Project Agreement HB-436, 212(06) & (07) - Montana Highway Department: The Agreement HB-436, 212(06) & (07) between the Montana State Highway Department and the City of Bozeman for the engineering costs involved for preparation of plans and documents for widening streets on South Willson Avenue and for preparing plans and specifications for improving three blooks of alleys and seal coating approximately 140,000 sq. yds. of street paving was presented. In concurr- ence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that tbe agreement HB-436. 212(06) & (07) be approved as presented and tbat the Mayor and the Clerk of the Commission be authorized to sign the Agreements for the City of Bozeman and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Authorization to Attend Chiefs & Fireman's Association Meeting: Chief Huber & Firefighter Wruck, Helena 15-18 July, 1970: The eighth annual MOntana State Fireman's Association Conference is scheduled to be held in Helena, 15-18 July 1970. Upon recommendation of the Fire Chief and the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that it being in the public interest, Fire Chief Huber and Firefighter Wruck be authorized to attend this conference and the expenses of the delegates incurred by such attendance be paid out of the General fund and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Commissioner Morrow and Mayor Langohr; those voting No, none. I Request for SID's - Water & pavement North Seventeenth Ave. & Beall St.: A request from the Western General Enterprises for the creation of a Special Improvement District for the installation of water lines and pavement on North Seventeenth Avenue was presented. Following a discussion. it was moved by Commissioner Morrow. seconded by Commissioner Sedivy. that the City Engineer and the City Attorney be instructed to prepare a resolution initiating a Special Improvement District for the installation of water lines and paving on North Seventeenth Avenue and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow. Commissioner Sedivy and Mayor Langohrj those voting No, none. . 11 Consideration of Bids: Awards of Walks and Curbs Construction: The City Engineer having completed his study of the bids for construction of Walks and Curbs (1970) recommended that W. D. Howell be awarded the bid on Schedule #1 as low bidder for the re- pairing and reconstruction of miscellaneous sidewalks in the amount of $4,068.00 and that Long Construction Company, Billings, Montana, be awarded the contract for the improvement of Schedule 12 I Curb and Gutters on the basis of their low bid in the amount of $2,850.00. The City Manager con- curred in the recommendation of the City Bngineer, and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the bids be awarded to W. D. Howell for the Sidewalk con- struction on the basis of his bid in the amount of $4,968.00 and to Long Construction for the Curb & Gutter construction on the basis of their bid in the amount of $2,850.00 and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner SediVY, Commiss- ioner Morrow and Mayor Langohr; those voting No, none. Reports: The following reports were presented for May and June: Librarian (May) Police Judge (June) Building Inspector The City Manager commented on the reports and recommended their appToval. I t was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Morrow, Commissioner Sedivy and Mayor Langohr; those voting No, none. Claims: Claim No's. 7879 thru 8141 inclusive were presented on the various funds as follows: Band $ 25.00 Planning Board $ 76.75 Cemetery 3,547.29 Police Reserve 1,532.70 Garbage 6,363.74 SDS 4,918.21 General 26,663.82 Street 14,359.86 Library 2,542.26 Water 12,817.69 Park 7,141.49 Dr. Education 446.80 Parking Meter 1,031.61 New Sewer Const. 235.00 PERS 1,857.01 To tal $83,559.23 I The City Manager checked the claims and found them to be true and lawful claims against the City of Bozeman and recommended they be approved and the Director of Finance be directed to issue warrants in payment. It was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the claims be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. Gallatin Garden Club - Civic Development project: Sears Award Grant - $300.00: It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the Gallatin Empire Garden Club be highly commended on their outstanding efforts and accomplishments in compiling the Civic Development Project booklet for the beautification of Kirk Park and that they be congratulated upon receiving the Sears Award Grant in the amount of $300.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Lengohr; those voting No, none.
