HomeMy WebLinkAbout1970-07-15 16 Bozeman, Montana 15 July 1970 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 15 July 1970, at 1:00 o'clook p.m. Present were Mayor Langohr, Commissioner Morrow, Commw issioner Sedivy, City Manager Fryslie, Ass't. City Manager Keyes, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer/and the following proceedings were had: Minutes of the regular session held 8 July 1970 were read and it was moved by Commissioner I Morrow, seconded by Commissioner Sedivy, that the minutes be approved as read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. * Se~ Minutes of ~~acial M~6tinffi: pa~e 17 Cons~derat~on 0 ewa k ate ent R ~uests: E. Church Ave., A) A letter received from Zales Duncan, 21 East Beall Street and George Parsons, 304 North Black Avenue, requesting that the City Commission reconsider their decision to order installation of sidewalks in this area was again presented. Having examined the property and following a discuss- ion of the subject property, the Commission concurred with the recommendation of the City Manager and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the order to install sidewalks at the Duncan and Parsons property be revoked for this year, but that the City Engineer be instructed to make a full review of the situation of the sidewalks on East Beall Street and North Black Avenue next spring and a report be made to the Commission and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr; those voting No, none. B) The request from Kenneth Kent, 405 North Church~:Avenue and Steve Feller, 415 North Church Avenue was presented for further discussion following a week of additional study and an inspection of the area. Having inspected the property, the Commissioners found the sidewalks to be of a hazard- dous condition and it was moved by Commissioner MOrrow, seconded by Commissioner Sedivy, that the request of Kenneth Kent and Steve Feller be denied and that they be instructed to proceed wJth the installation of the sidewalks and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. I Appointment of Chief of Police - Robert J. Johnson: The City Manager announced his promotion of Captain Robert K. Johnson to Chief of Police for the Police Department of the City of Bozeman to be effective upon the retirement of Chief of Police Ron Cutting on 22 July 1970. The Commission concurred in the City Manager appointment and it was moved by Commissioner Sedivy, seconded by Commissioner Morrow, that the City Managers appointment of captain Robert K. Johnson to Chief of Police, effective 22 July 1970 be approved and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Sedivy, Commissioner Morrow and Mayor Langohr: those voting No, none Commission Resolution No. 1433 - Intention to Create SID No. 497 for Water Mains: South 11 th Ave.: COMMISSION RESOLUTION NO. 1433 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 497 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING A WATER MAIN AND CONSTRUCTION AND RECONSTRUCTION OF WATER SERVICE AND APPURTENANCES THERETO ON THAT PORTION OF sourn ELEVENrn AVENUE BETWEEN WEST MAIN STREET AND WEST CURTISS STREET. prepared by the City Attorney as directed by the Commission was presented. In concurrence with the recommendation of the City Manager, it was moved by Commissioner Morrow, seconded by Comm- issioner Sedivy, that the Resolution be passed and that 5 August 1970 be the date for public hearing and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. I Salary and Bond Ordinance No. 897: ORDINANCE NO. 897 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, FIXING THE MONTIlLY SALARY AND OFFICIAL BOND OF THE CITY MANAGER, THE HEADS OF DEPART:- MENTS, AND TIlE EMPLOYEES OF THE CITY COMMISSION AS REQUIRED BY LAW. Ordinance No. 897, the Annual Salary Ordinance covering salaries of the Heads of Departments and employees who are direct appointees of the Commission was presented. It was moved by Comm- issioner Sedivy, seconded by Commissioner Morrow, that Ordinance No. 897 be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner 17 Sedivy, CommisSioner Morrow and Mayor SediVYj those voting No, none. Final Plat Graf's Third Re-Arrangement, Blk 6, Kirk's 2nd Subdivision: The final plat of Block 6, Kirk's Second Subdivision, Graf's Third Rearrangement was pre- sented along with a favorable recommendation from the City-County Planning Board. Following s discussion, the City Manager in-concurrence with the recommendation of the City-County Planning Board recommended that the plat be approved. It was moved by Commissioner Morrow, seconded by I Commissioner Sedivy, that the plat be approved as recommended and the City Manager be authorized and directed to sign the Plat as Oirector of Public Service and the motion was carried by the following Aye and No vote: those vOUng Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. Request for Carnival License, Bozeman Police Protective Association - Intermountain Shows 5-8 August 1970: A letter received from Ron Green, President of the Bozeman Police Protective Association, requesting permission and authorization to obtain a City License to hold the Intermountain Shows Carnival in Bozeman 5-8 August was presented. It was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the above request be approved with a $50.00 license fee consideration as a charitable project and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. License Bond Continuation Certificate - Montana Power Company, Gas Fitter - Cotton House Moving: The continuation certificate for the renewal of the gas fitters license bond of the Montana Power Company was presented and in accordance with the provisions of Ordinance No. 785 the Build- ing movers bond as surety for a moving permit on Cotton House Moving Company, Helena, Montana was presented. The Building Inspector had recommended that the above bonds be approved and both bonds having been approved as to form by the City Attorney, it was moved by Commissioner Morrow, seconded by Commissioner Sedivy, that the bonds be approved and the motion was carried by the following Aye and No vote: Those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none I Presentation - Ordinance No. 898, Appropriation Ordinance, Fiscal Year 1971: Ordinance No. 898, the Appropriation Ordinance for the fiscal year 1971 was presented to the City Commission in accordance with R.C.M., 1947, Section 11-1406. Reports: The following reports were presented for June: Building Inspector Cemetery The City Manager commented on the reports and recommended their approval. It was moved by Commissioner Sedivy, seconded by commissioner Morrow, that the reports be approved and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Sedivy, Commissioner Morrow and Mayor Langohrj those voting No, none. Jaycee Roundup Parade: 10:00 A.M., Saturday 22 August, Permission to Have Judges Stand in Front of Rialto Theatre: A letter received from Gary Mills, Bozeman Jaycee Rodeo Chairman, requesting permission to hold a parade on Saturday, 22 August 1970, at 10:00 A.M., to begin at Buttreys Shopping Center and Pro- ceed down Main Street to Bogarts Grove was presented. They Also requested permission to have a judges st~ set up in front of the Rialto Theatre. It was moved by Commissioner Morrow, seconded by Comm- issioner Sedivy, that permission to hold the parade and set up the judges stand in front of the Rialto Theatre be granted and that the Chief of Police be contacted in regard to coordinating the details and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Morrow, Commissioner Sedivy and Mayor Langohrj those voting No, none. * Minutes of the special meeting held 14 July 1970 were read and it was moved by Commissioner I Morrow, seconded by Commissioner Langohr that the minutes be approved as read and the motion was carried. Thosevoting Aye being Commissioner Morrow and Mayor Langohrj those voting No, none.
