HomeMy WebLinkAbout1976-06-10 I I I 10 June 1976 The Commission of the City of Bozeman met in special session in the Commission Room, Municipal Building, Thursday, 10 June 1976, at 7:00 p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Acting City Manager Wolf, City Attorney Berg and the Clerk. Discussion on Boundaries for Establishing a Formula for Method of Assessment Bozeman Parking Commission & Downtown Development Association The purpose of the special meeting was to further study the boundaries to determine the city's position as to the matter of assessment of Federal properties and to acquire further financial information for the purpose of creating the down- .town parking SID as requested by the Bozeman Parking Commission and the Bozeman Downtown Development Association. Many property owners and interested persons were present to discuss the boundaries. It was explained that there was no assessment made against Federal properties, therefore, changing the boundaries to exclude Federal properties from the district would not affect the assessment or the formula as presented. Following a thorough discussion of the boundaries for the off-street parking facilities for the purpose of creating a parking special improvement district, the City attorney advised the group that Section 11-2206, R.C.M., 1947, states that at any time within fifteen days after the date of the first publication of the notice of the passage of the resolution of intention, any owner of property liable to be assessed for said work may make written protest against the proposed dis- trict, or against the extent or creation of the district to be assessed, or both. Such protest must be writing, and be delivered to the Clerk of the Commission not later than five (5) o'clock p.m. of the last day within said fifteen days period, and said clerk shall endorse thereon the date and hour of its receipt by her. If the Commission finds that such protest is made by the owners of more than fifty (50) 'percent of the area of the property to be assessed for said improvements, no further proceedings shall be taken. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the special meeting be adjourned, and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. / . :~ /f!rt -6' ?V. ~ 0 < <-cJ O''-(J S_W-r-VOLLMER, ayor ATTEST: 49f}
