HomeMy WebLinkAbout1976-06-09 I I I 493 9 June 1976 The Commission of the City of Bozeman met in regular sessions in the Commission Room, Municipal Building, 9 June 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lerhkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Acting City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 2 June, were approved as read. Minutes of the special meeting held on Monday, 7 June, were approved as read. Consideration - Construction Bids for 1976 Walks and Curbs The engineering staff having completed tabulation and study of the bid sub- mitted by Robert A. Taylor Construction, for the construction, replacement, and repair of the 1976 Walks and Curbs, and having prepared a final tabulation, recom- mended that the bid be awarded to Robert A. Taylor Construction on the basis of his bid in the amount of $32,266.00, it being the only bid submitted and equaling or exceeding all specifications in the "Call for Bids". Upon concurrence of the Acting City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Robert A. Taylor Construction be awarded the bid for the 1976 Walk and Curb Construction on the basis of their low bid in the amount of $32,266.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lerhkind, Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none; and Commissioner Taylor abstained. Consideration of Bids for paving SID No. 558, 559, 560, 563 and 564 The engineers representing consultants, Thomas, Dean & Hoskins, Inc., having completed their study of the bid submitted by Long Construction of Billings, for the paving improvements in Figgins Addition - SID No. 558, South Fifteenth AVenue from Babcock to Koch Street - SID 559, Graf Street and Colter Avenue in Graf's Third Addition - SID No. 560, Lamme Street from Church to Wallace Avenue - SID 563, and paving Cutting Street in a portion of Figgins Second Addition - SID 564; and having prepared a final tabulation of the bid, recommended that the bid be awarded to Long Construction Company, on the basis of their bid in the amount of $326,805.00, it being the only bid submitted and equaling or exceeding all specifications in the "Call for Bids". The Commission concurred with the recommendation of the engineers, also con- curred in by the Acting City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Long Construction Company be awarded the bid for the paving construction for SID's 558, 559, 560, 563, and 564 in the amount of $326,805.00 contingent upon the sale of the Bonds. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Com- missioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. 49J Open Bids for Seal Coat Improvement This was the time and place set for opening bids for the construction of Seal Coat Street improvements. The affidavit of publication of "Notice to Bidders" was presented, and it was moved by Commissioner Taylor, seconded by Commissioner Vande- venter, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandevente~ Commissioner Lehrkind, commissioner Sedivy, and Mayor Vollmer; those voting No, none. The following bids were then opened and read: Bozeman Blacktop - Three Forks Bozeman Sand & Gravel - Bozeman $31,681.50 38,970.00 The Commission concurred with the recommendation of the Acting City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the bids be referred to the engineers representing Thomas, Dean & Hoskins, Inc., and the city engineering staff for final tabulation, consideration and recom- mendation on Wednesday, 16 June 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lerhkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Bond Sale: a) SID No. 558 - $170,000.00 c) SID No. 560 - $ 43,000.00 e) SID No. 564 - $ 44,000.00 b) SID No. 559 - $110,000.00 d) SID No. 563 - $ 30,000.00 The Acting City Manager stated that according to the affidavit of publication, this was the time and place set for the bond sale of Special Improvement Districts 558, 559, 560, 563 and 564. The Mayor and Acting City Manager outlined the procedure for conducting this bond sale and stated the amount of bonds to be sold for each district would be the same as the advertised amount. The Clerk announced there were no sealed bids for the purchase of the bonds for SID's 558, 559, 560, 563 and 564. The Mayor announced that the City was now ready to conduct the oral bidding for the purchase of the bonds, and it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the City proceed with the oral bidding of SID 558 in the amount of $170,000.00. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. The following bidders having presented their good faith checks ,as prescribed by the Notice of Sale, then began oral bidding. The final best oral bid was as follows: Bob Bleck John Easley Grande & Company, Seattle D. A. Davidson & Co., Helena 7.35% plus $250.00 7.35% plus $300.00 It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the sale of the bonds for Special Improvement District No. 558 in the amount of $170,000.00 be awarded to D. A. Davidson, Great Falls, in the amount of 7.35% plus $300.00. The motion was carried by the following Aye and No vote: those voting Aye being Commission Sedivy, Commissioner Taylor, Commissioner Vandeventer, Com- missioner Lehrkind, and Mayor Vollmer; those voting No, none. Davidson & Co., Helena First National Bank 7.35% plus $300.00 7.25% It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the sale of the bonds for Special Improvement District No. 559 in the amount of $110,000.00 be awarded to First National Bank, Bozeman, in the amount of 7.25%. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those votin~~o, none. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the City proceed with the oral bidding of SID 563 in the amount of $30,000.00. Ordinance No. 962 - Hearing on Formula for Parking SID 565 Resolution No. 1795 - Intent to Create SID 565 It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Ordinance No. 962 establishing a formula for the method of assessment of property in Special Improvement District No. 565 for the acquisition of offstreet parking facilities and Commission Resolution No. 1795 for the purpose of creating the Parking SID be tabled pending a special meeting of the Commission, to be held on Thursday, 10 June 1976, at 7:00 p.m. for the purpose of further financial informa- tion and a continued study of the boundaries to determine the position of the City as to the matter of assessment of the Federal properties. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Recommendation of Park Recreation Board - Beall Park The Park Recreation Board, having held a special meeting for the purpose of bringing the Beall Park group up to date on what is to be done at Beall Park, recommended the following proposal for the consideration of the City Commission: 1. That the proposal submitted by the public representatives regarding Beall Park changes be approved by the Commission. 2. That if new grass is installed, no skating at Beall Park this year but recommend the Commission approve skating at Beall Park next year. 3. That Bogert Park plans remain as submitted and the suggestions recommended by the public be taken under advisement. a. Consider moving pavillion north. b. When dollars become available, provide restrooms and warming area for skaters. 4. That no changes be made at Lindley Park. Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission approve the proposal as recommended by the Park Recreation Board, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. SID Request - Water Service at 19th and Lincoln Road - MSU A letter received from M. F. Whalen, Director, Division of Physical Plant, Montana State University, petitioning the City of Bozeman to create a Special Im- provement District for the purpose of construction of water lines at 19th Avenue and Lincoln Road was presented. I I I I I I 497 The Commission concurred with the recommendation of the Acting City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission instruct the City Attorney to draw up the resolution of intention to create the district for the water lines at 19th Avenue and Lincoln Road as soon as the city staff furnish the necessary information. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Com- missioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Change Order No. 1 - Curb and Gutter Improvements Change Order No. 1 on Curb and Gutter improvements on Mendenhall and Babcock Streets, as: prepared by Thomas, Dean & Hoskins, Inc., to become a part of the original contract for construction of improvements in the project was presented: A. Remove grass boulevard in front of commercial buildings and properties as designated by the owner and approved by the City. B. Cost: $3,942.00 The Acting City Manager concurred in the recommendation of the engineers and recommended Change Order No. 1 be accepted and approved as presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Change Order No. 1 be accepted and the Mayor and Clerk of the Commission be autho- rized and directed to sign for the City, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Flag Day Parade - 14 June 1976 A letter received from Fay Mourich, Chairman, of the Flag Ceremony Committee, requesting permission to conduct a mini parade in connection with Flag Day on 14 June 1976 was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that permission to hold the mini parade be granted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Application for Beer License - Bozeman Softball Association A request from the Bozeman Softball Association for permission to obtain a City beer license for the weekends of 12-14, 12-21 and 26-28 June, and 10-12 and 24-26 July 1976 was presented along with the required fee. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Softball Association, having met all of the requirements, be granted a license to sell beer on the dates as stated above. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. Appointment to Park Recreation Board - Walt Russell Mayor Vollmer announced his appointment of Walt Russell to the Park Recreation Board to replace John D. Robinson who resigned as of 1 February 1976. 498 It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission concur in the Mayor's appointment, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Commissioner Taylor; those voting No, none.
