The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 2 June 1976, at 1:15 o'clock p.m. Present were Mayor
Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, Acting City Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceed-
ings were had.
Minutes of the regular meeting held on Wednesday, 26 May, were approved as read.
Open Bids - 1976 Walks and Curbs
Bidding on the 1976 sidewalks and curbs having been continued for a period of
one week to allow competitive bidding was again presented. The affidavit of publica-
tion of "Notice to Bidders" was presented, and it was moved by Commissioner Lehrkind,
seconded by Commissioner Sedivy, that the bid of Robert A. Taylor Construction,
Bozeman, being the only bid submitted be opened and read. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;
those voting No, none.
Robert A. Taylor Construction, Bozeman $32,266.00
Upon concurrence of the Acting City Manager, it was moved by Commissioner Sedivy,
seconded by Commissioner Vandeventer, that the bid of Robert A. Taylor Construction
be referred to the engineering staff for tabulation and recommendation on Wednesday,
9 June 1976. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind, and
Mayor Vollmer; those voting No, none; and Commissioner Taylor abstained.
1976 Walk and Curb Program
Following the meeting of 26 June, the City Commission proceeded to make their
on-the-ground inspection of the Walks and Curb program within the City.
The Commission discussed the proposed program and it was moved by Commissioner
Lehrkind, seconded by Commissioner Taylor, that the Commission delete the north half
of Aspen Street between North Fifth and North Seventh Avenue from the sidewalk program
providing the property owners put in a barrier to solve or alleviate the water prob;
lems in a manner approved by the City. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No,
none.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the
Commission adopt the 1976 Walk and Curb program with the exception of Peach Street

between North Fifth and North Seventh Avenue, and that the replacement of walks and I
curbs as previously recommended but not shown on the map be included. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner
Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and
Mayor Vollmer; those voting No, none.

Open Bids - SID's 558, 559, 560, 563, and564- ~aving
This was the time and place set for opening bids for paving Special Improvement
District No. 558 - Figgins Addition, Special Improvement District No. 559 - Paving
South 15th Avenue from Babcock to Koch Street, Special Improvement District No. 560 -
Paving Graf Street and Colter Avenue in Graf's Third Addition, Special Improvement
District No. 563 - Paving Lamme Street from Church to Wallace Avenue and Special
Improvement District No. 564 - Paving Cutting Street in a portion of Figgins Second
Addition. Affidavit of publication of "Notice to Bidders" was presented. It was
moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be
opened and read, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Sedivy, and Mayor Vollmer; those voting No, none.
The bid of Long Construction Company, Billings, Montana, being the only bid
submitted was then opened and read:
Long Construction Company, Billings $326,805.00
The Commission concurred with the recommendation of the Acting City Manager,
and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that
the bid be referred to the engineers representing Thomas, Dean and Hoskins, Inc.,
and the city engineering staff for final tabulation, consideration and recommendation
on Wednesday, 9 June, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none.
Hearing - Northeast Annexation
In accordance with the City Attorney's recommendation, the Northeast annexation
had been continued for a period of twenty days for the purpose of receiving written
expression of approval or disapproval of the proposed annexation from resident free-
holders of the territory as provided for in Section 11-522, R.C.M., 1947.
Having received no expression of approval or disapproval, the City Attorney
was instructed to draw up an ordinance annexing the area.

The Acting City Manager commented on the reports and recommended they be accepted
and ordered filed.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the
reports be accepted and ordered filed. The motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No,
none.
Canvass Returns - Election of Alternative Form of Government 1 June 1976
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that a
special meeting be called for Monday, 7 June 1976, at 7:00 o'clock a.m. for the
purpose of canvassing the election returns of the Alternative Form of Local Govern-
ment voted on on 1 June 1976. The motion was carried by the following Aye and No

vote; those voting Axe being Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lerhkind, and Mayor Vollmer; those voting No, none.
Curb Cuts - Hoadley Standard on Mendenhall Street
Attorney Joseph P. Gary, representing George Hoadley of Hoadley's Standard
Service, appeared before the Commission to request a compromise in George Hoadley's
request to have the city construct wider curb openings at the service station.
Following an extensive discussion, it was moved by Commissioner Sedivy,
seconded by Commissioner Vandeventer, that the Commission adjust the curb cut to
twenty-six feet for the shop and a forty-five foot opening for the station, both
on Mendenhall Street, and increase the curb on Mendenhall Street by an additional
five feet. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Vandeventer, and Mayor Vollmer; those
voting No being Commissioner Taylor and Commissioner Lerhkind.
Adjournment
There being no further business to come before the Commission at this time,
it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that
the meeting be adjourned, and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer,
Commissioner Lehrkind,
