The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 26 May 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Comm
issioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Frys1ie, Assistant City
Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayerand the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 19 May 1976, were approved as read.
Consideration of Bids for Bituminous plant Mix Material
The Street and Sanitation Superintendent and the City staff having completed their study ot the

bid of Pioneer Ready Mix, it being the only bid supmitted, recommended that Pioneer Ready Mix of
Bozeman be awarded the bid for the purchase of S,900 tons of Bituminous plant Mix @ $ll.J)5 per ton
for a total of $68,735.00 delivered.
TheCommission concurred with the recommendation of the Street and Sanitation Superintendent and
City staff, also concurred in by the City Manager, and it was moved by Commissioner Lehrkind, seconded
byCommissioner Sedivy, that Pioneer Ready Mix of Bozeman be awarded the bid for the purchase of the
Bituminous Plant Mix on the basis of his bid as stated above. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner
Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Open Bids for 1976 Walks and Curbs
This was the time and place set for receiving bids for the repairing and reconstruction of misc-
ellaneous sidewalks and curbs. Affidavit of publication of "Notice to Bidder" was presented.
Mr. Roger Terwilliger of T. & H. Contractors, Bozeman, stated he was not able to get his bid bond
in time to bid on the 1976 Walks and Curbs construction and asked if the opening of bids could be con-
tinued for a period of one week.
Upon advise of the City Attorney, it was moved by Commissioner Sedivy, seconded by Commissioner
Vandeventer, that the bidding on the 1976 sidewalks and curbs be continued for a period of one week
to allow competitive bidding. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer;
those voting No, none.
Commission Resolution No. 1794 - Provide for Coordination between City & County Civil Defense.
A resolution providing for coordination between the County of Gallatin Civil Defense and the
City of Bozeman during period of emergency was presented: entitled

ERTY IN THE CITY OF BOZEMAN, MONTANA.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that Commission
Resolution No. 1794 be passed and adopted and the motion was carried by the following Aye and No Vote:
Those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Comm-
issioner Sedivy and Mayor Vollmer; those voting No, none.
Proposal for County Support of Public Libraries
The City Manager presented the following proposal for county cooperation in support of public
libraries in Gallatin County for the period I December 1976 through 30 June 1977. The budget request
is to be paid by the County.
All public libraries in Gallatin County would be open to all residents of the county
without any fees.
Borrowers could return books charged out from any public library in the county to
any public library in the county. The receiving library would mail books to the
library owning the books.
Any public library in the county could request to borrow any books in the colle-
ction of any other public library in the county. Books would be sent to the re-
questing library by mail. Reference questions could also be referred by phone
from one libary to another.
Books would be mailed only to public libraries, not individuals.
All public libraries would govern their own libraries - decide on hours open, select
their own books and collect fines on their own books. Books returned from another
library would not be fined but would be sent to the owning library, which could note
fine on the borrower's card.
It should be understood that the above proposal does not intend to infringe upon
the discretion of the county government nor impose upon other libraries any pro-
gram not acceptable to them. We only provide this material in response to the
request of the Friends of the Library, as acknowledged by the City Commission.

Following discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeven-
ter, that the Commission concur in the recommendation of the City Manager and support the Friends
of the Library for County Cooperation in support of the public libraries in Gallatin County, and
that the Commission accept and approve Margaret Hileman's report as presented. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
Notice of Hearing - 30 June 7:30 p.m. Current HUD Flood Map
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commiss-
ion approve publication of the "Notice of Public Hearing" on the current HUD Flood map scheduled for
7:30 o'clock p.m. on 30 June 1976. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner
Taylor and Mayor Vollmer; those voting No, none.
Sanitary Sewer Easement - Marvin Cowdrey, Rearrangement Elks Club Property
An easement and right of way agreement by and between Marvin R. and Judy G. Cowdrey, and the
City of Bozeman for the purpose of installing, operating, using, repairing, replacing, maintaining
and removing a sanitary sewer line thereto upon and across Tract 5 of the Rearrangement of the Elks
Club property, SW~, Sec. 8, T2S, R6E, City of Bozeman, Gallatin County, Montana; and containing
a strip of land thrity feet wide, was presented.
Upon concurrence of the City Manager, it was moved by Commissioner Lehrkind, seconded by Comm-
issioner Sedivy, that the Easement and Right of Way Agreement, having been executed by Marvin R. and
Judy G. Cowdrey, be approved and the Mayor and Clerk of the Commission be authorized and directed to
sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor
Vollmer; those voting No, none.
Public Discussion - Leash Law
A number of concerned citizens again appeared before the Commission in regard to the leash law
and the garbage code.
Mrs. Kenneth Baldwin and Mr. Stanley Lemon expressed their concern in the lack of progress in
picking up stray animals and the small number of fines collected, and to continue their protest
against lax enforcement of City leash laws.
Bozeman Downtown Development Association & Bozeman Parking Commission - Request for Parking SID
A letter received from the Bozeman Downtown Development Association stating the Board of Dir-
ectors of the Bozeman Downtown Development Association, and the Bozeman Parking Commission had both
adopted a proposal for a Special Improvement District for the purpose of purchasing certain propert-
ies between North Tracy Avenue and the City Library with the expectation that a parking structure
would be constructed on the site but financed through a different proposal at an estimated cost of
$750,000.00, was presented.
The estimated cost should cover the land cost, administrative cost and provide for money for
consultants in getting the structure phase started.
Following an extensive discussion, it was moved by Commissioner Lehrkind, seconded by Commission-
er Sedivy, that steps be taken expeditiously to proceed with the intent to create a Special Improve-
ment District to provide for parking for the central business district as requested by the Bozeman
Downtown Development Association and the Bozeman Parking Commission. The motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Comm-
issioner Vandeventer and Mayor Vollmer; those voting No, being Commissioner Taylor.
Continued Discussion on Beall Park pro;ect
Mr. Ivan Newham, representing the group from Beall Park Area, was present and asked the Commiss-
ion to please reconsider holding another evening meeting for the purpose of discussing the Beall
Park project.
Mrs. David Kundert explained that Beall Park is pronounced "Bell" park. Mrs. Rosa M. Beall
donated the land to the City of Bozeman in 1919 to be used as a recreational park. In 1927 Mrs.
Ella Martin presented the City of Bozeman with the gift of a Community House to be placed at Beall Park.
After much discussion, the City Manager advised the group from Beall Park that a Park Recrea-
tion Board meeting will be held to hear from these people, at a date to be announced, and every
effort will be made to make the people aware of the time and place of the meeting.
Mayor Vollmer thanked the group for coroming and stated it would be a public meeting for the
purpose of hearing what is going to be done at Beall Park. In the meantime there will be no further
contracts let for improvements in Beall Park.

Request from Bozeman Tennis Court Club to Conduct Door to Door Fund Drive
A letter received from the Bozeman Tennis Club requesting permission to conduct a fund drive
on 1 June and to continue for a period of one week was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that permission be grant-
ed the Tennis Club to conduct their fund drive but that they be made aware of the fact that 1 June
is election night and it will not be in the best interest of their program. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vande-
venter, Commissioner Lehrkind and Mayor Vollmer; those voting No, being Commissioner Taylor.
Application for Beer License - Bozeman Softball Association
The City Manager presented an application from the Bozeman Softball Association for permission
to obtain a Beer license for the 18-31 May 1976, along with the required fee.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Bozeman
Softball Association, having met all requirements, be granted a license to sell beer from the 18-3l
May 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commiss-
ioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer;
those voting No, none.
Author! ty to Call for Bids - Seal Coat for Street Improvements
Plans and specifications for the construction of Seal Coat Street Improvements as prepared by
Thomas, Dean & Hoskins, Inc., consulting engineers, was placed before the Commission.
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by
Commissioner Taylor, that the plans and specifications as presented be approved and that the Clerk
of the Commission be authorized and directed to publish a "Call for Bids" for the construction of
Seal Coat Street Improvements with an opening date of 9 June. The motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner
Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none.
Leave of Absence for City Manager - 1-20 June 1976, Military Leave
The City Manager requested that he be granted leave of Absence from 1-20 June for the purpose
of attending National Guard Camp and that Assistant City Manager Wolf be designated as Acting City
Manager during this period.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the above re-
quest be granted and that Assistant City Manager Wolf be designated as Acting City Manager during
this period, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and
Mayor Vollmer; those voting No, none.
Appointment of Band Director for Municipal Band 1976 - Rolf Johnson
A letter received from Ralph C. Challender, Secretary-Treasurer of the Bozeman Municipal Band,
stating the City Municipal Band Board of Directors selected Rolf Johnson as the Director of the Band
for the 1976 season.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission
concur in the selection of Rolf Johnson as Band Director, and that the Commission approve the con-
cert schedule and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor and
Mayor Vollmer; those voting No, none.
Application for Bingo License - Fowler Beef & Swine. 4H Club
The City Manager presented an application from the Fowler Beef & Swine 4H Club along with the
required fee, for a Bingo License for the purpose of holding a Bingo Game on 29 May 1976.
It was moveed by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission
approve the application of the issuance of the Bingo License, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Comm-
issioner Taylor, Commissioner vandeventer and Mayor Vollmer; those voting No, none.
The Report - Director of Public Service
The City Manager commented on the report of the Director of Public Service and recommended
acceptance thereof.
