The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 19 May 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Comm-
issioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Frys1ie, Assistant City
Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 12 May 1976, were approved as corrected.
Authorization - Absence of Commissioner Sedivy, 26 May 1976
Upon recommendation of the City Manager, it was moved by Commissioner Lehrkind, seconded by
Commissioner Taylor, that the absence of Commissioner Sedivy, from the meeting of 26 May 1976, be
authorized in compliance with Section 11-3245, R.C.M., 1947. The motion was carried by the following
Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner
V-andeventer and Mayor Vollmer; Commissioner Sedivy abstained.
Reconsideration Sign Code Variance - Burgess Enterprises
The request for a variance to the Sign Code from Burgess Enterprises for the purpose of placing
a rustic wood sign in front of their store located at 315 East Mains Street was presented for recon-
sideration.
After discussing the height project problems with the Building Official, the sign was scaled
down to meet all the requirements of the sign code except the wood in a Fire Zone 1. The sign would
be made of heavy timber mounted on 9" logs without any electricity on the sign. The Building Offic-
ial recommended approval thereof.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission grant
the variance as recommended by the Building Official, also concurred in by the City Manager. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting
No, none.
Continued Consideration - Hoadley Standard Curb Openings
Having continued consideration on the curb openings at Hoadley's Standard Service on Mendenhall
Street, for a period of one week for further investigation and legal counsel, was presented for dis-
cussion and a final decision.
Following discussion, the Commission concurred with the recommendation of the City Engineer,
also concurred in by the City Manager, and it was moved by Commissioner Taylor, seconded by Commiss-
ioner Vandeventer, that the Commission approve a curb cut of sixteen feet for the shop and forty feet
for the station, both on Mendenhall Street, along with a twenty-foot curb cut on Tracy Avenue. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor,
Commissioner Sedivy and Commissioner Lehrkind; those voting No, being Commissioner Va~deventer and
Mayor Vollmer.
Open Bids - Bituminous Plant Mix Material
This was the time and place set for opening bids for the purchase of 5,900 tons Bituminous plant
mix material to be used for street maintenance and reconstruction of which 4,780 tons is to be paid
out of Gas Tax HB-254 funds. The affidavit of publication of the "Can. for Bids" was presented.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be
opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor
Vollmer; those voting No, none.
The bid of Pioneer Ready Mix, being the only bid sutmitted, was then opened and read.

Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that the bid of Pioneer Ready Mix be referred to the Street and Sanitation
Superintendent and the City staff for checking and recommendation to be made to the Commission on
Wednesday, 26 May 1976. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor and
Mayor Vollmer; those voting No, none.
Petition - Beall Park. Special Meeting
Mr. Ivan Newham, representing a group from the Beall Park Area appeared before the Commission
to present a petition signed by approximately 485 persons who were interested in holding another
evening meeting for the purpose of discussing the Beall Park Project.

Several interested persons were also present to discuss the area in question.
Public meetings have been held over the past two years and decisions made which would now be
most difilcult and inconvenient to alter. It is, therefore, felt that the Beall Park project should
move forward.
Following an extensive question and answer period, the Commission acknowledged receipt of the
petition and referredft to the Recreation Board.
Sidewalk & Curb Program for 1976
The City Engineer completed his survey of Walks and Curbs within the City of Bozeman and re-
commendations for repair and/or installation for the 1976 season.
Following discussion, the Commission concurred with the recommendation of the City Manager, and
it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the City Engineers recommend-
ation for repair and/or installation of "Walks and Curbs" within the City for the year 1976 be taken
under advisement for a period of one week for the purpose of giving the Commission an opportunity to
make an on the ground inspection of the Walks and Curbs designated for 1976 repair and/or replacement
within the City of Bozeman.
Easement for Street - Figgins Addition
An Easement and Right of Way Agreement by and between Patrick R. and Sharrell A. Corey, 2718
Langohr Avenue, Bozeman, and the City of Bozeman for the purpose of installing, operating, using,
repairing, replacing, maintaining and removing streets thereto upon and across the South 10 feet
of Lot 13, Block 2 of the Figgins Addition to the City of Bozeman, was presented.
Upon concurrence of the City Manager, it was moved by Commissioner Taylor, seconded by Commiss-
ioner Vandeventer, that the Easement and Right of Way Agreement, having been executed by PatrickR.
and Sharrell A. Corey, be approved and the Mayor and Clerk of the Commission be authorized and dir-
ected to sign for the City. The motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy,
and Mayor Vollmer; those voting No, none.
Applications for Beer & Liquor License: United Commercial Travelers Gallatin Shrine Club
The City Manager presented an application from the United Commercial Travelers, along with the
required fee, for a retail City Beer License for the period of 21-23 May 1976.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the United
Commercial Travelers, having met all requirements, be granted a license to sell beer for the period
of 21-23 May 1976. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor an~ Mayor
Vollmer; those voting No, none.
The City Manager presented an application from the Gallatin Shrine Club, for permission to ob-
tain a beer and liquor license for the weekend of 21-23 May 1976, along with the required fee.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Gallatin Shrine
Club, having met all requirements, be granted a license to sell liquor on the weekend of 21-23 May,
1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer;
those voting No, none.
Proclamation - American Legion Auxiliary - "Poppy Day" 21 May 1976
In accordance wi th the American Legion Auxiliary, Mayor Vollmer proclaimed 21 May 1976, as "Poppy
Day" in the City of Bozeman and urged every citizen to give generous recognition to this program and
obtain and wear a Memorial Red Poppy on this day.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Mayor's proclama-
tion be endorsed, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor
Vollmer; those voting No, none.
Report - State Library Convention by Margaret Hileman
Margaret Hileman appeared before the Commission to report on the Annual Conference of the Montana
State Library Association held in Helena, 6-8 May 1976.
Mayor Vollmer commended Margaret Hileman on the completeness of her report and extended his
appreciation for her attendance at the meeting.

Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Taylor, seconded by Commissioner Vandeventer, that the meeting he adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor,
Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those
voting No, none.
