HomeMy WebLinkAbout1976-05-12 472 Bozeman, Montana 12 May 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 12 May 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis- sioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following pro- ceedings were had. Minutes of the regular meeting held on Wednesday,S May 1976, were approved as read. Continued Hearing - Resolution No. 1786 - Intent to Create SID 561, Paving S. 20th Resolution No. 1790 - Create SID 561 Action having been continued on Commission Resolution No. 1786, Special Im- provement District No. 561 for a period of one week for review, was presented. Several property owners were again present to affirm their protests. Mr. Bob Smith of the University Mall was also present and explained that lack of ade- quate streets for egress and ingress, particularly in a shopping center, causes considerable problems. Following further discussion, the Mayor declared the hearing closed, and there not being sufficient protests filed, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission concur with the recommendation of the City Manager, and Commission Resolution No. 1790, entitled: COMMISSION RESOLUTION NO. 1790 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NO. 561 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO; ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAIN- AGE PIPE, DITCHES, AND APPURTENANCES NECESSARY TO STORM DRAINAGE ON SOUTH 20TH AVENUE FROM COLLEGE STREET NORTH TO 106 FEET SOUTH OF WEST BABCOCK STREET, WEST OLIVE, WEST KOCH, AND WEST DICKERSON STREETS BETWEEN SOUTH 19TH AVENUE AND SOUTH 20TH AVENUE AND THAT PORTION OF WEST KOCH STREET LYING BETWEEN BLOCKS 1 AND 2 OF KIRK SUBDIVISION NO.4 TO THE CITY OF BOZEMAN. as prepared by the City Attorney be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No being Commissioner Vandeventer. ,.. Consideration"of Bids - 3/4 Ton Pickup for Sanitation Department The Street and Sanitation Superintendent having completed tabulation and study of the bids submitted, and having prepared a final tabulation of the bids, recom- mended that the bid be awarded to M & W GMC of Three Forks, on the basis of their low bid in the amount of $4,395.00, it equaling or exceeding all specifications in the "Call for Bids." Upon concurrence of the City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that M & W GMC of Three Forks be awarded the bid for the 3/4 ton GMC pickup tr.uck for the Sanitation Department on the basis of their low bid in the amount of $4,395.00 with trade. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmerithose voting No, none. Consideration of Conditional Use permit.- Donald Frye, Jr., and Douglas Lutz This was the time and place set for a public hearing to consider the request of Donald Frye, Jr., and Douglas Lutz for a conditional use permit to convert an existing structure located at 2005 North Rouse Avenue and formerly used as the old Bozeman Suzuki Motorcycle shop into a bar and restaurant. After consideration of the Planning staff's report, comments of the petitioners as well as the comments of the Zoning Commission members, the Zoning Commission voted unanimously to recommend approval of the conditional use permit with the following conditions attached. 1) That signing be strictly limited to the two signs anticipated by the applicant as outlined in the Planning staff report. 2) That landscaping, to include: low lying shrubs and two ten gallon trees set in decorative rock and barrier work outlined in the Planning staff report and shown on the staff work-up of the plan (enclosed) be included in the development. 3) That all required signing, paving, landscaping, and barrier work be completed within five months of the issuance of the conditional use permit. The Mayor declared the hearing closed and it was moved by Commissioner Vande- venter, seconded by Commissioner Lehrkind, that the Commission concur with the recommendation of the Zoning Commission and approve the conditional use application with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Taylor, and Mayor Vollmer; those voting No, none. 473, 47,1 Consideration of Conditional Use Permit - Robert & Natalie Jenkins The request of Robert & Natalie Jenkins of Livingston to construct a warehouse for truck storage on a tract of land in the East half of the Northwest quarter of Section 6, Township 2 South, Range 6 East, and located at 1521 North Rouse Avenue, having been contiriued for a period of one week, was presented for final action. After consideration of the Planning staff's report, update report and the petitioner's comments, the Zoning Commission voted unanimously to recommend approval of the conditional use application with the following conditions: 1) The example "A" plan (enclosed) will govern the development to include: a) A 35-foot setback from North Rouse Avenue to facilitate future street improvements. b) A minimum of eight parking spaces as outlined on the plan. 2) That signing be strictly limited to a flush, non-illuminated building sign. Sign to be located on Rouse Avenue frontage of the building with a total sign area not to exceed 100 square feet. 3) That landscaping anticipated by the applicants as outlined in the Planning staff report, with the inclusion of two ten gallon size trees (or equivalent size) and protective barriers or bumper curbs along driveway and parking area to protect land- scaping,be part of the final development. 4) That all required paving, landscaping, and barrier work, be completed within five months of the issuance of the conditional use permit. Following a thorough discussion, i t"was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission concur with the recommendation of the Zoning Commission and approve the conditional use application with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis- sioner Vandeventer, and Mayor Vollmer; those voting No, none. Consideration of Zoning Amendment - C& S Upholstery, UpsholsteryShops in B-2 Action having been continued on the request of Gary Schaffer, representing C & S Upholstery of Bozeman, to amend the Zone Code to allow upholstery shops as permitted use in the B-2 (Community Highway Business) district of the City, for a period of one week was presented for discussion and final action. After consideration of the Planning staff report and comments from the peti- tioner, the Zoning Commission voted unanimously to recommend approval of the Zoning code amendment to allow upholstery shops as a permitted use in the B-2 districts. The City Commission concurred with the Zoning Commission's recommendation, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Bozeman Area Zoning Code be amended to allow upholstery shops as a permitted use in the B-2 districts. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Hearing, Amend Zone Code - Sections 2.57, 2.63, 2.64, and 2.65 This was the time anu place set for a public hearing to consider a request from the Bozeman City-County Planning staff to amend sections 2.57 (UNIT EFFICIENCY), I I I I I I 47~ e) Section 2.63, 2.64, and 2.65, and to create a new Section 2.65A of the Bozeman City Zoning OrdLnance. These sections deal with definitions of an efficiency unit with a floor area of at least 450 square feet and with definitions of required yard areas. After consideration of the Planning staff's report and comments from the audience as well as those of the Zoning Commission members, the Zoning Commission voted to unanimously recommend approval of the zone code amendments to read as follows: 2.57 Unit, efficiency - An efficiency is an apartment unit with unseparated area for sleeping and/or cooking with a floor area of at least 450 square feet. 2.63 Yard, Front - "Front yard" shall mean an open space extend- ing the full width of the lot between a building and the front lot line, perpendicular to and measured from the front lot line. 2.64 Yard, Rear - "Rear Yard" shall mean an open space between a building and a rear lot line, extending the full width of the lot, perpendicular to and measured from the rear lot line, except for any portion thereof, which overlaps a street side yard. . 2.65 Yard, Side - "Side Yard" shall mean an open space extending from the front yard to the rear yard between a building and the nearest side lot line, perpendicular to and measured from the side lot line. ~2.65A,Yard, Street side - "Street side yard" shall mean an open space extending from the front yard to the rear lot line between a building and the nearest side street lot line, perpendic- ular to and measured from the side street lot line. Mayor vollmer declared the hearing closed, and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission concur with the recommendation of the Zoning Commission and approve the Zone Code Amendments. Hearing Amend Zone Code - Section 9, 10, and 11 This was the time and place set for a public hearing to consider a request by the City-County Planning staff to amend the lot area requirements of Sections 9 (R3 residential-medium density), 10 (R4 residential-medium density apartments), and Section 11 (R5 residential-high density) of the Zoning Ordinance. The staff's purpose in seeking this amendment was to bring the lot area requirements of the zoning code more into line with recommended densities outlined in the Bozeman Area Master Plan. The Zoning Commission, after much deliberation and consideration voted to table this amendment indefinitely and seek a joint meet- ing with the Bozeman City-County Planning Board to work towards a final recommenda- tion on this amendment. The Mayor declared the hearing closed, and it was moved by Commissioner Vande- venter, seconded by Commissioner Lehrkind, that the Commission concur in the recom- mendation of the Zoning Commission to table Sections 9, 10 and 11 for further study. '47G Hearing - Amend Zone Code, Delete Section 22.3 This was the time and place set for a public hearing to consider a request from the Bozeman City-County Planning Staff to amend the Section 22.3 of the Bozeman Zoning Ordinance. After consideration of the staff report, and comments from members of the audience, the Zoning Commission voted unanimously to recommend approval of the Zone code amendment which would eliminate Section 22.3 from the Bozeman Zoning Ordinance. The Mayor declared the hearing closed, and it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission concur with the recommendation of the Zoning Commission and delete Section 22.3 of the Bozeman Zoning Ordinance. The motion was carried by the following Aye and No vote: those voting Aye being Commis- sioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Consideration of Ordinance No. 961 Ordinance No. 961 as prepared by the City Attorney to amend Chapter 3.08, Section 3.12.050 of the Bozeman Municipal Code to include Bond Requirement-Recourse against Bonds, in the City of Bozeman, was presented. Following an extensive discussion and having had Chamber of Commerce approval, the City Manager recommended adoption thereof. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Ordinance No. 961 be passed and adopted and in full force and effective immediately upon its passage and adoption, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commis- sioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Citizen Discussion - Leash and Garbage Code Many concerned citizens appeared before the Commission in regard to the leash law and the garbage code. Mrs. Kenneth Baldwin and Mr. Stanley Lemon, acting as spokesmen for the group, expressed their concern of dogs and other animals running at large and the garbage problem that exists in the City of Bozeman and pleaded for assistance in clearing up these two concerns. Following an extensive question and answer period, Commissioner Vandeventer moved that a new fine schedule be set up for the police judge as follows: First offense - $10.00 Second offense - $25.00 Third offense - $50.00 Each offense thereafter - an additional $50.00 That the Police Judge supply the Commission with a list of all dismissals and why. It was seconded by Commissioner Lehrkind, that the Commission approve the fine schedule, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Hearing - Resolution No. 1787 - Northeast Annexation During the regular session of the City Commission held on 7 April 1976, the Commission regularly passed and adopted,Commission Resolution No. 1787, declaring I I I I I I 477 its intention to extend the boundaries of the City of Bozeman, so as to include 260 acres, more or less, to be known and designated as the Northeast Annexation. This being the date set for public hearing as set forth in said Commission Resolution No. 1787, as provided for in Section 11-520, R.C.M., 1947, affidavit of publication of Notice and the Clerk's mailing certificate stating all property owners had been notified were presented. The Mayor declared the hearing open and the City-County Planning staff explained the report accompanied by a slide presentation of the Northeast Annexation. Several property owners were also present to discuss the annexation and one affirmed his written protest. Following further discussion, the Mayor declared the hearing closed. In accordance with the City Attorney's recommendation, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the City Commission of the City of Bozeman will receive written expression of approval or disapproval of the proposed annexation from resident freeholders of the territory to be annexed for a period of 20 days as provided for in Section 11-522, R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Request for Variance to Sign Code - Burgess Enterprises A letter received from Larry W. Burgess of Burgess Enterprises, Inc., requesting a variance to put a rustic wood sign in front of their store located at 315 East Main Street was presented. The sign will have lettering carved into the wood and attached to a 911 log beam which is attached to the steel I-beam in front of the shop. The Commission concurred in the recommendation of the Building Official, also concurred in by the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission deny the request due to the clearance problems coupled with the original request for a variance to erect -a wood sign. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Curb Cuts - Hoadley Standard A request from George Hoadley of Hoadley's SLandard Service on Mendenhall Street, for a variance in his curb drop on Mendenhall Street was presented. Mr. Hoadley is asking for a fifty-foot drop into his station to facilitate traffic flow. He is also asking for an additional 24-foot drop for a shop and private driveway between Mendenhall Street and the alley. The City Engineer recommended a curb cut variance of 16 feet for the shop and 40 feet for the station, both on Mendenhall Street along with a 20-foot curb cut variance on Tracy Avenue. Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner vandeventer, that the Commission table action on the Curb Cut Variance 478 for a period of one week for further investigation and legal counsel. Raffle License Applications: a) Muscular Dystrophy bT Nat'l Women's Polltical Caucus The City Manager presented an application from the Muscular Dystrophy Associa- tion and the National Women's Political Caucus with the required fee for the pur- pose of holding a raffle. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission approve the applications for the raffle license for the above and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Co~nissioner Taylor, and Mayor Vollmer; those voting No, none. Proclamations - a) VFW POPPv Davs, 13-15 May 1976, b) Boy Scouts of America SOAR - 22 May 1976, c) Older Amerlcans Month - May Mayor Vollmer proclaimed 13-15 Mayas "Buddy Poppy" days in Bozeman in accor- dance with a request from the Veterans of Foreign Wars and urged every citizen of this community to recognize the merits of this cause by contributing generously to its support through the purchase of poppies on these two days. Mayor Vollmer proclaimed 22 Mayas "SOAR" (Save Our American Resources) in accordance with a request from the Boy Scouts of America and urged every citizen of this community to join the Boy Scouts in this worthwhile project to clean up our city and surrounding community. It was moved by Commissioner Sedivy, seconded by Cowmiosioner Taylor, that the Mayor!s proclamation Le endorsed, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting NO, none. In accordance with the President of the united States, Mayor Vollmer proclaimed the month of Mayas "01der Americans Month" and urged all people to observe this month by focusing on the achievements of the older persons and supporting programs to make the last days of life the best days for the increasing number of older Americans. Upon recommendation of the City Manager, it was moved by Commissioner Vandevente~ seconded by Commissioner Lehrkind, that the plans and specifications as presented be approved and that the Clerk of the Commission be authorized and directed to publish a "Call for Bids" for the construction of Special Improvement District No's. 558, 559, 560, 563 and 564 with an opening date of 2 June 1976, and to advertise for tile sale of bonds in the approximate amount of $170,000.00 for SID 558, $110,000.00 for SID 559, $43,000.00 for SID 560, $30,000.00 for SID 563 and $44,000.00 for SID 561 to be received on 9 June.
