HomeMy WebLinkAbout1976-05-05 I I I 467 Bozeman, Montana 5 May 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building,S May 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commis- sionerVandeventer, City Manager Fryslie, City Attorney Berg and the Clerk. Commissioner Lehrkind opened the meeting with a prayer and the following pro- ceedings were had. Minutes of the regular meeting held on Wednesday, 28 April 1976, were approved as corrected. Minutes of the Special meeting held on Friday, 30 May 1976, were approved as read. Open Bids - 3/4 Ton Pickup Truck for Sanitat~on Department This was the time and place set for opening bids for the purchase of a 1976 3/4 ton 8' Style Side Pickup Truck for the sanitation department. Affidavit of pUblica- tion of the "Call for Bids" was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commis- sioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. The bids were then opened and read: Bozeman Ford, Bozeman Robert F. Dye, Bozeman M & W. GMC, Three Forks 1976 Ford F250 Pickup With Trade 1976 GMC 3/4 Ton With Trade 1976 GMC 3/4 Ton With Trade $4,510.96 4,488.47 4,395.00 Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the bids be referred to the Street and Sanita- tion Superintendent for tabulation and a recommendation on Wednesday, 12 May 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Hearings: (a) Conditional Use - Donald Frye. Jr., IQl Conditional Use - Robert Jenklns (c) Zone Amendment - C & S Upholstery This was the time and place set for a public hearing to consider the request of Donald G. Frye, Jr., to use an existing structure located at 2005 North Rouse and formerly used as the old Bozeman Suzuki Motorcycle Shop. Since there was not a quorum at the Zoning Commission Meeting held on Tuesday, 27 April 1976, it was necessary for the Zoning Commission to continue action on the above request until Tuesday, 4 May 1976; therefore the material necessary to make a decision has not been received. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the hearing on the request of Donald G. Frye, Jr., pursuant to the requirements of the Bozeman Area zoning Code be continued for a period of one week, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. 468 This was the time and place set f,or hearing and considering the request of Robert Jenkins to construct a warehouse on a tract of land in the East Half of the Northwest quarter of Section 6, Township 2 South, Range 6 East, said land being located at 1521 North Rouse Avenue. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that since there was no recommendation from the Zoning Commission due to a lack of a quorum on 27 April the hearing be declared closed and action be delayed for a period of one week for a final decision. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. This was the time and place set for hearing and considering the request of Mr. Gary Schaffer of C & S Upholstery of Bozeman to amend the Zone Code to allow uphol- stery shops as a permitted use in the B-2 (Community Highway Business) districts of the City of Bozeman. Due to lack of a quorum at the Zoning Commission meeting, it was moved by Commissioner Lehrkind, seconded by Commissioner Taylor, that the Commission declare the hearing closed and delay action on the request for a period of one week. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Preliminary Consideration - Ordinance No. 96~, Regulating Transient Retail Merchants Ordinance 961, amending Chapter 3.08, Section 3.12.050 of the Bozeman Municipal Code, and regulating bond requirements-recourse against bond as required by tran- sient retail merchants was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the ordinance be continued for a period of one week for further study. The motion was carried by the following Aye and No Vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commis- sioner Sedivy, and Mayor Vollmer; those voting No, none. Proclamation - Salvation Army, 1-16 May in Connection with National Salvation Army Mayor Vollmer proclaimed the week of 10-16 Mayas "National Salvation Army" week in concurrence with the National Salvation Army and urged all residents of Bozeman to support the program. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission endorse the Mayor's proclamation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Authority to Travel to Seattle - Fire Battalion Chief Leland Lewis The Seattle Fire Department extended an invitation to Fire Battalion Chief Leland Lewis to attend the Fire Inspection, Arson, Fire Investigation, and F1ire Support Academy for a period of one week. The Fire Chief requested that Fire Battalion Chief Leland Lewis be authorized to attend the session and, it being in the public interest, his expenses be paid from the General fund. I I I I I I 469 It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that Fire Battalion Chief Leland Lewis be authorized to attend the session in Seattle, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Authority to Call for Bids ~ Bituminous Plant Mix, Open 19 May 1976 The Street Department and the Cemetery Department has need for 5,600 tons 1/2" Type IVa Crushed Gravel and 300 tons 1/2" Type IVa Bituminous Plant Mix, and the City Manager requested authorization to call for bids for the purchase of the Bituminous Plant Mix. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the purchase of the Bituminous Plant Mix be authorized, and the Clerk of the Commission be authorized and directed to issue a "Call for Bids" for the purchase, to be opened on 19 May 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commis- sioner Vandeventer, Commissioner Lehrkind, and Mayor Vollmer; those voting No, none. Hearing, Resolution No. 1786 - SID 561, Paving-South 20th Avenue Resolution No. 1790 - Creating SID 561 This was the time and place set in Co~nission Resolution No. 1786 to hear pro- tests to the creation of Special Improvement District No. 561, paving of South Twentieth Avenue. Affidavit of publication of Notice and the Clerk's mailing certificate, stating all property owners had been notified as required by law were presented. The City Manager presented protests filed with the Clerk of the City Commission and signed by owners of property representing 16% of the proposed dis- trict as determined by the City Engineer. Special property owners were present to affirm the written protest to the creation of the Special Improvement District. Following a thorough discussion, the Mayor declared the hearing closed and it moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that action be continued for a period of one week for the purpose of reviewing Special Improve- ment District No. 561, paving South 20th Avenue, and consideration of all opinions expressed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Con~issioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. Hearing, Resolution No. 1783 - SID 562, Paving South 23rd Avenue Resolution No. 1791 - Creating SID No. 562 This was the time and place set in Commission Resolution No. 1783 to hear pro- tests to the creation of Special Improvement District No. 562, paving of South 23rd Avenue. Affidavit of publication of Notice and the Clerk's mailing certificate, stating all property own~rs had been notified as required by law were presented. There were no protests on file and no one appeared to protest verbally. Following a discussion, the Mayor declared the hearing closed and it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that action on Special Improvement District No. 562 be continued for a period of one week for further study. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, COITmlissioner Vandeventer, and Mayor Vollmer; those voting No, none. 470 Hearing, Resolution No. 1784 .,.' SID 563 ,J;>aving Lamme St., Church to Wallace Avenue Resolution No. 1792 - Create SID 563 This was the time and place set in Commission Resolution No. 1784, to hear pro- tests to the Creation of Special Improvement District No. 563, paving Lamme Street from Church to Wallace Avenue. Affidavit of publication of notice and the Clerk's mailing' certificate, stating all property owners had been notified as required by law were presented. The City Manager presented protests filed with the Clerk of the Commission and signed by owners of property representing 16% of the proposed district as determined by the City Engineer. Mrs. Christine Henke, 205 North Wallace, was present to affirm the written protest to the creation of the Special Improvement District. Following a discussion, the Mayor declared the hearing closed and there not being sufficient protests, it was moved by Commissioner Sedivy, seconded by Com- missioner Taylor, that Commission Resolution No. 1792, entitled: COMMISSION RESOLUTION NO. 1792 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, .CREATI~G A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NO. 563 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO; ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPE, DITCHES, AND APPURTENANCES NECESSARY TO STORM DRAIN- AGE ON EAST LAMME STREET BETWEEN CHURCH AVENUE AND WALLACE AVENUE IN THE CITY OF BOZEMAN, MONTANA. as prepared by the City Attorney be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Vanaeventer ,Commissioner Lehrreind..,. _.,and M<:tyor 'Vollmer; '::those wOj:.ing No, Ilon~;Commission~r Taylor-abstained. Hearing, Resolution No. 1785 - SID 564, Paving Cutting Street Resolution No. 1793 - Creating SID 564 This was the time and place set in Commission Resolution No. 1785, to hear protests to the creation of Special Improvement District No. 564, paving of Cutting Street in Figgins Addition. Affidavit of publication of hearing and the Clerk's mailing certificate, stating all property owners had been notified as required by law were presented. There were no written protests on file and no one appeared to protest verbally. The Mayor declared the hearing closed and upon concurrence of the City Manager, it was moved by Conmissioner Taylor, seconded by Coromissioner Vandeventer, that Corrmission Resolution No. 1793, entitled: COMMISSION RESOLUTION NO. 1793 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IM- PROVEMENT DISTRICT NO. 564 OF THE CITY OF BOZEMAN FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO; ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAIN- AGE PIPE, DITCHES, AND APPURTENANCES NECESSARY TO STORM DRAINAGE ON CUTTING STREET, IN FIGGIN'S ADDITION TO THE CITY OF BOZEMAN. as prepared by the City Attorney be passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Mayor Vollmer; those voting No, none. i mission for use of the curb cut now located in between Lot 1 and Lot lIon Circle Drive was presented. The purpose of the curb cut is to use the same for a driveway entrance into a garage and newly constructed home. Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the request for the Curb Cut variance be denied in the above location. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, and Mayor Vollmer; those voting No, none.
