HomeMy WebLinkAbout1976-04-14 I I I 457 Bozeman, Montana 14 April 1976 The Commission of the City of Bozeman met in regular session in the CommissionRoom, Municipal Building, 14 April 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceed ings were had. Minutes of the regular meeting held on Wednesday, 7 April 1976, were approved as read. Open Bids, Trenching for Park Sprinkling Systems: This was the time and place set for opening bids for the purpose of digging trenches to ins tall the irrigation systems in the City Parks. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. The following bids were then opened and read: Bozeman Electric, Bozeman $4,800.00 Heisel Landscape and Nursery, Bozeman None Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Comm- issioner Taylor, that the bid of Bozeman Electric, Bozeman, be referred to the Park Superintendent for tabulation, and final recommendation on Wednesday, 21 April 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commiss- ioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Open Bids - Babcock-Mendenhall Curb Program This was the time and place set for opening bids for the construction of curb and gutter improve- ments on Ba~ock and Mendenhall Streets as prepared by Thomas, Dean & Hoskins, Inc., The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be opened and read, and the Motion was carried by the follow- ing Aye and No vote: those votingAye being Commissioner Taylor, Commissioner Vandeventer, Commiss- ioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those voting No, none. The follow bids where then opened and read: Concrete Specialities, Bozeman C. Reinhart & Sons, Boz 617, Idaho Falls Utility Builders, Box 1154, Great Falls $159,338.54 $190,918.30 $175,301. 50 The Commission concurred with the recommendation of the City Manager, and it was moved by Comm- issioner Vandeventer, seconded by Commissioner Lehrkind, that the bids be referred to the City Engin- eering staff and the consulting engineers representing Thomas, Dean, & Hoskins, Inc., for final tabulation, consideration and a recommendation on Wednesday, 21 April 1976, and the motion was carried by the following Aye and No vote: those votingAye being Commissioner Vandeventer, Commiss- ioner Lehrkind, Commissioner Sedivy, COmmissioner Taylor and Mayor Vollmer; those voting No, none. Open Bids - 20,000 Gallons Regular Gasoline This was the time and place set for opening bids for the purchase of 20,000 gallons regular gasoline. The affidavit of publication of the "Call for Bids" was presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Vollmer; those voting No, none. The following bids were then opened and read; Continental Oil Company, Bozeman $ .4575 Petes Husky, Bozeman .4325 Mike Power Exxon, Bozeman ./~134 Story Motor Supply, Bozeman .lf395 Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded, by Comm- issioner Taylor, that the bids be referred to the City staff for checking and recommendation to be made to the Commission on Wednesday, 21 April 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Hearing, Commission Resolution No. 1782 - SID 560, Paving Graf Street & Colter Avenue, Grafls 3rd Addn. This was the time and place set in Commission Resolution No. 1782, to hear protests to the creation of Special Improvement District No. 560 for paving construction on Graf Street and Colter Avenue in 458 Graf's Third Addition. Affidavit of publication of Notice and the Clerk's mailing certificate stating all property owners had been notifieci as required by law was presented. There were no protests on file and no one appeared to protest verbally. It was moved by COllunissioner Taylor, seconded by Commissioner Vandeventer, that the City Attorney be instructed to draw up the necessary resolution to create the district and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, COlllmissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Commission Resolution No.1789 - Annex Summit Engineering Property COMMISSION RESOLUTION NO. 1789 A RESOLUTION OF THE COMMISSION OF THE CITY OF BOZEMAN EXTENDING THE BOUNDARIES OF THE SAID CITY OF BOZEMAN, MONTANA, SO AS TO E~RACE AND INCLUDE A CERTAIN TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN AND HEREIN MORE PARTICU- LARLY DESCRIBED, WITHIN THE CORPORATE LIMITS THEREOF. I as prepared by the City Attorney was presented: It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that Commission Resolution No. 1789 annexing a tract of land belonging to Summit Engineering and containing approxi- mately five acres be passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Comnlissioner Sedivy, Comm- issioner Taylor and Mayor Vollmer; those voting No, none. Authority to Attend APWA Convention, Sheridan \\Iyoming, 12-14 May - Arthur Van't Hul The annual convention of the Rocky Mountain Chapter of the APWA is scheduled to be held in Sheridan, Wyoming, on 12-14 May and City Engineer Vanlt Hul requested authorization to attend the meeting. The Commission concurred with the recommendation of theCity Manager and it was moved by Commiss- ioner Lehrkind, seconded by Commissioner Sedivy, that the City Engineer attend the convention as re- quested and, it being in the public interest his expense be paid out of the appropriate fund. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. B:~;.SLuest to Reinstate $30,000.00 Tennis Court Commitment A letter received from Janet Swenson, Publicity Chairman of the Bozeman Tennis Club, requesting the City Commission to keep available, at least until 1 July 1976, the $30,000.00 that was designated I for public tennis courts. Following a discussion, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission aCknowledge receipt of the request, and that the request be referred to the Re- creation beard for their consideration and action on the proposed tennis courts. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Bicentennial Fourth of July Activities A letter received from James T. Paugh, Chairman of the Gallatin County Fourth of July Celebration Committee, requesting the City of Bozeman to allow the Fourth of July Committee to sell tickets to all cars as they come north on Grand Avenue between 700 and 800 blocks (between Cottonwood and Aspen Street) and at the corner of the intersection of Aspen and Black Street and just west of the inter- section of North Bozeman and Tamarack Streets. Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeven- ter, that a letter be addressed to Mr. Paugh, acknowledging receipt of their request and permitting voluntary charges to be made for cars on the streets but not compulsory. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Request to Place a Tree in Sidewalk at Hathhorn BUilding. 29-39 \\lest Main Street - Winidred S. Lovelace A letter received from Winifred S. Lovelace requesting permission to plant a tree especially selected and suitable for growing in front of the Hathhorn building at 29-39 West Main Street was presented. I Following discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that Winifred Lovelace be granted a variance of the City code to plant the tree in front of the Hath- horn building, 29-39 West Main Street on an experimental basis. The motion was carried by the follow- ing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commiss- ioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Gambling ~iccnse - (a) MSU Indian Club - Raffle, (b) AOP Sorority - Raffle! (c) Wommen Political Caucus - Raffle & Bingo. The City Manager presented an application from the MSU Indian Club and an application from the I I I 459 AOP Sorori~y with the required fee for the purpose of holding a raffle and an application from the Women Political Caucus along with the required fee for the purpose of holding a raffle and bingo game. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission approve the applications for the raffle license for the MSU Indian Club and the AOP Sorority and the raffle and bingo license for the Women Political Caucus. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Reports The following reports were presented: Librarian Police Judge . The City Manager commented on the reports and recommended they be accepted and ordered filed. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the reports be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer. Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Request to Conduct Sunrise Service at Old Elks Country Club A letter received from John C. Soderberg, requesting permission for the youth of Bozeman United Methodist, Christ the King Luthern and First Presbyterian Churchs to hold an Easter Sunrise Service at 6:00 o'clock A.M., Easter morning, directly behind the Old Elks Country Club, was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the request to hold the Sunrise Service as requested be granted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Lark P. & Jean V. Carter - Curb Cut Variance at 2508 Spring Creek Drive A letter received from Lark P. & Jean V. Carter, requesting a double curb cut to accomodate a circle drive at their home located at 2508 Spring Creek Drive, was presented. Following a discussion, and in concurrence with the recommendation of the City Engineer, also concurred in by the City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the curb variance be approved, but that the south entrance be moved north ten feet and both entrances be limited to twelve feet in width. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
