HomeMy WebLinkAbout1976-03-31 450 Bozeman, Montana 31 March 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 31 March 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 24 March 1976, were approved as read. Hearing. Conditional Use Permit - Retail Tire Shop at 125 North Wallace Avenue This was the time and place set for a public hearing to consider the request of John Lee for a Conditional Use permit to use the building on Lots 15-18. Block H of Rouses First Addition for a re- tail tire shop. The property is located at 125 North Wallace Avenue. The Zoning Commission having held a public meeting and having considered information supplied by the staff report voted unanimously to recommend approval of the conditional use application subject to the following conditions. 1) That all parking, paving, fencing and landscapinR improvements. outlined on the plan and in the staff report, be installed within nime months of of the time a conditiorial use permit is iSliiued. 2) That the building sign be of the flush design anticipated by the applicant. 3) That the applicant's specific fencin~and landscaping designs be reviewed. and approved by the Planning staff before a building permit is issued. *Landscaping improvements outlined in the applicant's plan were as follows: a) That the yard on the west side of the 'building be intended as a clean area. b) That the remaining required yard areas be improved with landscaping. Mayor Vollmer declared the hearing closed and it was moved by Commissioner Lehrkind. seconded by Commissioner Sedivy, that the Commission concur with the Zoning Commission's recommendation and I I approve the conditional use permit application for Mr. John Lee with the above conditions. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy. ~ Commissioner Vandeventer and Mayor Vollmer; those voting No, none. Commissioner Taylor abstained. I Consideration of Bids - One Two-Wheel Drive Pickup for Park Department After tabulation and checking the bids submitted for the purchase of a 1976 Two-Wheel drive pickup for the Park department, the Park superintendent recommended that the bid of Robert F. Dye, Inc., Bozeman. in the amount of $4,469.34 be accepted as the lowest bid and meeting or exceeding the specifications as contained in the "Call for Bids." The Commission concurred in the recommendation of the Park Superintendent also concurred in by the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Robert F. Dye. Inc., be awarded the bid for the 1976 Two-Wheel Drive Pickup in the amount of $4,469.34 it being the lowest bid' and equaling or exceeding all specifications in the "Call for Bids" and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy. Comm- issioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Consideration of Bids - Hydrostatic Driven Rotary Lawn Mower The Cemetery Superintendent having checked all bids received for the purchase of a new Hydrostatic Driven Rotary Lawn Mower for the Cemetery Department, recommended that the bid of Turf Aid Distri- buting Co., of Billings. on a 1976 Model Excel Hustler 272A complete with 72" mower deck, less trade of one Deines 48" Mower in the amount of $4,000.00, be accepted as the best bid submitted and equaling or exceeding all specifications contained in the "Call for Bids." Of the two lower bids submitted, this is the first time the Heston has been introduced in the State of Montana and the City of Bozeman would be the proving ground for this particular model. Also the Hustler is 600# heavier than either of the two lower bidded brands and has a more efficient drive system. At the present the City has several machines similiar to the Hustler and therefore would not have the increased expense of carrying extra maintenance parts. The City Manager strongly agreed with the Cemetery Superintendent and recommended the purchase of the 1976 Model Excel Hustler 272A. It was moved by Commissioner Taylor. seconded by Commissioner Vandeventer. that the Commission reject the two lower bids and accept the bid of Turf Aid Distribut- ing Co., of Billings, on a 1976 Model Excel Hustler 272A complete with 72" mower less trade of one Deines 48" Mower in the amount of $4,000.00 as being the best bid submitted and equaling or exceeding the specifications as contained in the "Call for Bids." The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor. I I I I 451 Zoning and License Interpretation - Steam & Massage Shop (Jackie Duke) The request from Jackie Duke for a zone classification for the purpose of opening a combination shop of steam and massage in the City of Bozeman, having been tabled for a period of one week for study, was again presented. MS. Duke was present to explain the steam and massage shop and to answer any questions that might arise. Following a discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission make an interpretation to include steam and massage shops in the B-2 and B-3 Zone of the Bozeman Zoning Code. The motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Northeast Annexation - Continuation It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that upon recommendation of the City Attorney, action on the Northeast Annexation be continued pending adoption of a resol- ution pursuant to Section 11--520, R.C.M., 1947. The motion was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. Sanitary Sewer Line Easements: (a) Ronald & Delores Walker (b) Hubert 11. Reid Easement and Right of Way Agreements from Ronald and Delores Walker and Hubert M. Reid, for the purpose of installing, operating, using, repairing, replacing, maintaining and removing a sanitary sewer and appurtenances and for such other right of access and incidental rights thereto upon and across various properties located within the City of Bozeman, was presented. Following a discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the easement and right of way agreement, having been executed by the property owners, be approved and the Mayor and Clerk of the Commission be authorized and directed to sign for the City, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Agreement - Traffic Project M-1206 (2) Unit 2, (One-Way Couplet) An agreement by and between the Department of Highways of the State of MOntana and the City of Bozeman whereby the State proposes to construct certain improvements on a specific highway in and through the City of Bozeman, said construction being known as Federal Aid Project No. M1206(2) UNIT 2, the Babcock and Mendenhall Streets was presented. The proposed construction will be over and upon Babcock Street and Mendenhall Street and a por- tion of North 11th Avenue and a portion of South 8th Avenue and Rouse Avenue between Babcock Street and the signalization of the intersections of South 8th Avenue and Main Street; North 7th Avenue with Main Street and Mendenhall Street; and South Willson Avenue with Main Street and Babcock Street. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Agreement be entered into by the Commission and that the Mayor and Clerk of Commission be directed to sign the Agreement for the City of Bozeman, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Comm- issioner Sedivy and Mayor Vollmer; those voting No, none. Variance to Sign Code - Cactus Records, North Willson Avenue A letter received from the owners of Cactus Records of North Willson Avenue, requesting a var- iance to the Sign Code to construct a 3'8" X 4'8" sign on the Baxter Hotel on the corner of North Willson and West Main Street, was presented. Following an extensive discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the request for a variance to the sign code be approved. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm- issioner Lehrkind, Commissioner Taylor, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Reports The City Manager commented on the report of the Director of Public Service and recommended the same be accepted and ordered filed. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the report of the Director of Public Service be accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. 4h.)'J ~ ~ Extension of Time on Raffle License ~ Five Rivers Red Cross Chapter ^ letter received from Mary Holter of the Five Rivers Red Cross Chapter, Bozeman, requesting an extension of time on the raffle drawing from 3 March to 1 April, was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission approve the extension of time on the raffle drawing from 3 March to 1 April as requested, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none.
