The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 24 March 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manager Wolf,
City Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 17 March 1976, were approved as read.
Absence of Commissioner Lehrkind authorized 24 March 1976
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by
Commissioner Taylor, that the absence of Commissioner Lehrkind, from this meeting, be authorized
in compliance with Section 11-3245, R.C.M., 1947, and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
venter and Mayor Vollmer; those voting No, none.
Open Bids - Hydrostatic Driven Rotary Lawn Mower
This was the time and place set for opening bids for the purchase of a new Hydrostatic Driven
Rotary Lawn Mower for the Cemetery Department. Affidavit of publication of the "Call for Bids"
was presented.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be
opened and read, and the motion was carried by the followingAye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting
No, none.
The following bids were then opened and read:
Gallatin Equipment Co., Bozeman $3,740.00
Midland Implement Billings 3,900.00
Turf Aid Distributing Co., Billings 4,000.00
Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by
Commissioner Sedivy, that the bids be referred to the Cemetery Superintendent for tabulation and
final recommendation on Wednesday, 31 March 1976. The motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor,
and Mayor Vollmer; those voting No, none
Open Bids - One Two Wheel Drive Pickup for Park Department
This was the time and place set for opening bids for the purchase of a 1976 two wheel drive
pickup for use by the Park department. Affidavit of publication of the "Call for Bids" was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the bids be opened
and read and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No,
none.

Upon recommendation of the City Manager, it was moved by Commissioner Taylor, seconded by
Commissioner Vandeventer, that the bids be referred to the Park Superintendent for tabulation and
a recommendation on Wednesday, 31 March 1976. The motion was carried by the following Aye and No
Vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy
and Mayor Vollm~ those voting No, none.
Authority to Call for Bids - Trenching to Install Sprinkler System, Open 14 April 1976
Plans and specifications for the purpose of digging of trenches to install the irrigation systems
in the City Parks was place before the Commission.
Upon recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by
Commissioner Sedivy, that the proposal as presented he approved and that the Clerk of the Commission
be authorized and directed to publish a "Call for Bids" for the digging of trenches for the install-
ation of some 16,000 feet of sprinkler pipe with an opening date of 14 April 1976. The motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commiss-
ioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none.
Authority to Call for Bids - Babcock and Mendenhall Curb Program, Opening 14 April 1976
Plans and specifications covering the construction of Curb and Gutter improvements on Babcock

and Mendenhall Streets as prepared by Thomas, Dean and Hoskins, Inc., consulting engineers, was
placed before the Commission.
The City Manager concurred with the consulting engineers and recommended that the plans and
specifications as presented be approved and that a "Call for Bids" for the construction of curbs
and gutters on Babcock and Mendenhall Streets be authorized.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the plans and speci-
fications be approved and the Clerk of the Commission be authorized and directed to publish a "Call
for Bids" for the construction of gutters on Babcock and Mendenhall Streets with an opening date of
April 14, and the motion was carried by the following Aye and No vote: those voting Aye being Comm-
issioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Petition SID Improvements - Bruce Mecklenburg, University Mall Joint Venture - South 20th, South 23rd
AND West Babcock St.
A petition received from Mr. Bruce Mecklenburg of the University Mall joint venture and located
South of Twentieth Avenue, South Twenty-Third Avenue and West Babcock Street in the City of Bozeman,
petitioning the City of Bozeman to create a Special Improvement District for the purpose of constru-
ction of storm drains and paving, was presented.
The Commission concurred with the recommendation of the City Manager, and it was moved by Comm-
issioner Taylor, seconded by Commissioner Vandeventer, that the Commission acknowledge receipt of the
request for a Special Improvement District and instruct the City Attorney to draw up a resolution of
intention to create the district as soon as the City staff furnishes the necessary information. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor,
Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
Commission Resolutiol No. 1782 - Intent to Create SID No. 560, Paving Graf's Third Addn. - Colter
Avenue and Graf Street, near 14 April
Commission Resolution No. 1782, declaring the intention to create special improvement district
No. 560 for the purpose of paving Graf Street and Colter Avenue in Grafls Third Addition as prepared
by the City Attorney was presented.

DECLARING IT TO BE TilE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO
CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE-
MENT DISTRICT NO. 560 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION
OF AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURB AND
GUTTER, AND NECESSARY APPURTENANCES THERETO; ALSO CONSTRUCTION AND
INSTALLATION OF NECESS^RY STORM DRAINAGE PIPE, DITCHES, AND APPURTENANCES
NECESSARY TO STORM DRAINAGE ON PORTIONS OF GRAF STREET, AND COLTER

The Commission concurred with the recommendation of the City Manager and it was moved by Comm-
issioner Vandeventer, seconded by Commissioner Sedivy, that Commission Resolution No. 1782 be passed
and adopted and 14 April be the date set for public hearing and the motion was carried by the follow-
ing Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commiss-
ioner Taylor and Mayor Vollmer; those voting No, none.
Authority to Attend Montana Park & Recreation Conference - Miles City, 1-2 April, G. White & D Wortman
The Montana Recreation and Park Association have scheduled a conference to be held in Miles
City, 1-2 April 1976 and the Recreation Director and Park Superintendent have requested authorization
to attend this meeting.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Dain Wortman and A.
Glen White be authorized to attend the conference and , it being in the public interest, their
expenses be paid from the Park fund, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and
Mayor Vollmer; those voting No, none.
Request to Open Shop - Steam, Massage, Manicure and Pedicure in Bozeman - Jackie Duke
A letter received from Jackie Duke requesting a zoning classification for the purpose of open-
ing a combination shop of steam, massage, manicure and pedicure in the City of Bozeman was presented.
Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeven-
ter, that the request be tabled for a period of one week for further study. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vande-
venter, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
Application for Gambling License - Headwaters Council of Campfire Girls. Bingo License - 23 April
The City Manager presented an application from the Camp Fire Girls along with the required fee

of $10.00 for the purpose of conducting a Bingo game to be held on 23 April, was presented.
It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the Commiss-
ion approve the application for a Bingo License, and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner
Taylor and Mayor Vollmer; those voting No, none.
Hearing, Northeast Annexation
It was moved by Commissioner Sedivy. seconded ~y Commissioner Taylor, that the Commission table
action on the Northeast Annexation for another week for additional study. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Ad;ournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Taylor, seconded by Commissioner Vandeventer, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor,
Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
