HomeMy WebLinkAbout1976-03-17 I I I Bozeman, Montana 17 March 1976 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 17 March 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Acting City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 10 March 1976, were approved as corrected. Hearing, Proposed Amendment to Planning Board Subdivision Regulations This was the time and place set for a public hearing to consider the proposed amendment to Section 10.4, Design Standards, of the Bozeman City-County Planning Area Subdivision Regulations. Said Amendment, if adopted will require all subdivision streets within the City of Bozeman to be paved. Subdivision streets in the jurisdictional area but not within the City limits shall be sub- ject to the same surfacing requirements for City subdivisions where the lots are serviced by community sewer and/or water systems. Streets in the jurisdictional area without community sewer and/or water systems shall include the two gravel-course section as indicated. After reviewing and considering the staff report, the Planning Board voted to unanimously recommend approval of the proposed amendment to Section 10.4, Design Standards, of the Bozeman City- County Planning Area Subdivision Regulations. Following an extensive discussion, it was moved by Commissioner Lehrkind, seconded by Commiss- ioner Sedivy, that the Commission concur with the recommendation of the Bozeman City-County Planning Board's recommendation to approve the proposed amendment to the Bozeman City-County Planning Area Subdivision Regulations. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. Hearing, Lawrence Zwiefelhofer, Zone Change from AS to M-l on a Ten Acre Tract The request from Lawrence Zwiefelhofer, to consider a recommendation from the Zoning Commission to rezone from AS to M-l a ten acre tract of land in the SE~, SE~, of Section 8, T2S, R6E, MPM., bounded on the north by U.S. 10, on the south by Interstate 90 and on the east by Denny's Sport City, was called for hearing. The Zone Change would allow the property to be spli t into two (2) five acre tracts and to. allow a proposed car body shop on the property. The Bozeman City-County Planning Board having reviewed the report of the Zoning Commission, voted unanimously to recommend approval of the Zone Change from AS to M-l as requested. The Commission concurred with the recommendation of the Zoning Commission, also concurred in by the City-County Planning Board, and it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission approve the zone classification change on a ten acre parcel of land located east of Bozeman on U.S. 10 from AS to M-l. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande- venter, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Certificate of Substantial Completion - Edsall Construction, Lindley Park Restrooms. A certificate of substantial completion of the Lindley Park rest rooms constructed by Edsall Construction Co., of Bozeman was presented. This final acceptance does not relieve the contractors of the responsibility for negligence in faulty materials or workmanship within the extent or period provided by law. Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vande- venter, that the certificate of the BGS Architects on the construction of the Lindley Park restrooms be accepted and the contractor will complete or correct the work on the list of items appended within forty-five days from the issuance of the certificate. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Application for Gambling License - Arnold Air Society AFROTC - Raffle 11 April 1976 Tha Acting City Manager presented an application for the Arnold Air Society AFROTC along with the required fee of $10.00 for a raffle license for the purpose of holding a raffle on 11 April 1976. It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission approve the application for the raffle license, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, Commissioner Sedivy; and Mayor Vollmer; those voting No, none 445 44G Proclamation .. MSU Scholarship Week, 21-27 March 1976 Mayor Vollmer proclaimed the week of 21-27 March 1976 as "Montana State University Scholarship Week" with full recognition that scholarships are a vital and important factor in the continuing educational processes at Montana State University. It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission endorse the Mayor's proclamation. The motion was ca~ried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, and Commissioner Vandeventer; those voting No, none. Reports The Acting City Manager commented on the library report and recommended it be accepted. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor. that the Library report be accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor. Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none. Amendment to Ordinance - Business License for Transient Retail Merchants It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commiss- ion instruct the City Attorney to draw up an amendment to the Ordinance concerning business license for transient retail merchants and that the City Attorney leave the amount of money blank as far as the license fee, bond limitation and the penalties are concerned. The motd.on was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Con~issioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none.
