The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 3 March 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind,
Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor, City Manager Fryslie, Assistant
City Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 25 February 1976, were approved as read.
Open Bids - Street Sweeper with Trade-In for Street Department
This was the time and place set for opening bids for the purchase of a 1976 three cubic yard
street sweeper with a trade in for the Street Department. Affidavit of publication of the "Call for
Bids" was presented.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the bids he opened
and read, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vendeventer and Mayor
Vollmer; those voting No, none.
The following bids were then opened and read:

Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Comm-
issioner Taylor, that the bids be referred to the Street Superintendent and the engineering staff
for tabulation and final recommendation on Wednesday, 10 March 1976, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor,
Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No, none.
Alley Vacation - Block 2, Durston Second Subdivision
Hearing on Commission Resolution No. 1773, declaring it to be the intention of said Commission
to vacate the alleys in Block 2 of Durston's Second Subdivision to the City of Bozeman, having been
continued to give Mrs. Brunton the opportunity to check with the prospective buyer and possibly
withdraw her conditional protest was again presented.
Edmund P. Sedivy, Jr., attorney, appeared before the Commission on behalf of Mr. Robert Graf
and Attorney Warry W. Moran appeared on behalf of Mrs. Laura M. Brunton. Both attorneys discussed
the area in question.
Following an extensive discussion, Commissioner Taylor moved that the North 10 feet of the
existing dedicated North-South Alley in Lot 12, Block 2 of Durston's Second Subdivision, which
vacation is in addition to the North 165 feet heretofore vacated by Ordinance No. 903 and the North
ten feet of an alley way 25 feet in width along a centerline 177~ feet south of an paraDel to the
North line of said Block 2 from the West line of said Block 2 on North 8th Street to the east line
of the existing alley in said Block 2 of Durston's Second Subdivision. (It being the intention to
retain an East-West Alley 15 feet in width.) Commissioner Vandeventer seconded the motion and it was
unaUimQUS1~ ~assed. Commis$iQQer Sedivy abstained.
Pre11m1nar Plat - Sourdough K1dge 111, Block 1
The preliminary plat application of Mr. Kenneth Nordvedt, Jr., for the proposed Sou~dough Ridge
III subdivision, Block I located approximately one mile south of Kagy Boulevard and one quarter mile
east of Sourdough Road along with a recommendation from the Bozeman City County Planning Board was
presented.
Block I consists of 6.3 acres divided into 5 lots, averaging slightly more than one acre in size.
This block is part of the overall Sourdough Ridge III subdivision that totals 53 acres. The developer
is asking that the park requirement for Block I be postponed until the remainder of Sourdough Ridge III

subdivision be developed.
The Commission concurred with the recommendation of the Planning Board, also concurred in by
the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind,
that the Commission approve the preliminary plat subject to the following conditions:
1. All necessary corrections are made to the final plat as suggested in
the staff report.
2. The park requirements be satisfied. The respective governing bodies I
must approve the proposal suggested by the developer and should con-
sult the County Attorney as to the proper legal form of this agreement.
3. The subdivision is determined to be in the public interest.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Lehrkind, Commissioner Sedivy. CommissionerTaylor and Mayor Vollmer;
those voting No, none.
Application for Beer License - The Drover, 215 East Main Street
The City Manager presented an application and appropriate fee for an on the premise beer license
for the year 1976 for the Drover, 215 East Main Street.
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Comm-
issioner Taylor, that the Commission approve the above license application for the Drover, 215 East
Main Street, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor
Vollmer; those voting No, none.
Application for Gs,)lbling License: a) MSU Indian Club - Raffle 2 April b) Monforton School - Raffle
The City Manager presented an application from the Montana State University Indian Club 26 March
along with the required fee of $10.00 for a raffle license for the purpose of holding a raffle on
2 Apri l.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission
approve the application for a raffle license for the Montana State University Indian Club, and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Comm- I
issioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
The City Manager presented an application from the Monforton School along with the required fee
of $10.00 for a raffle license for the purpose of holding a raffle on 26 March.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission
approve the application for a raffle license for the Monforton school, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none.
Reports
The City Manager commented on the report of the Chief of Police and the Building Inspector and
recommended the two reports be accepted and ordered filed.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission accept
the reports and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Lehrkind, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor
Vollmer; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Sedivy, seconded by Commissioner Taylor, that the meeting be adjourned and the motion
was carried by the following Aye and No vote: those voting Aye' being Commissioner Sedivy, Commiss-
ioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor Vollmer; those voting No,
