The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 25 February 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Lehrkind,
Commissioner Sedivy, Commissioner 'Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant
City Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayeJ; and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 18 February 1976, were approved as read.
Hearing - Northeast Annexation - Commission Resolution No. 1777
During the regular session of the City Commission held on 21 January 1976, the Commission
regularly passed and adopted Commission Resolution No. 1777 declaring its intention to extend the
boundaries of the City of Bozeman so as to include 260 acres, more or less, to be known and designated
as the Northeast Annexation.
This being the date set for public hearing as set forth in said Commission Resolution No. 1777,
affidavit of publication of Notice and the Clerk's mailing certificate stating that all property
owners had been notified were presented.
The City Manager presented protests filed with the Clerk of the City Commission and signed by
resident freeholders amounting to 131.. A number of property owners were also present to discuss the
annexation, answer questions, and several persons were present to affirm their written protests to
the annexation.
Rolbert El1erd, Bill Cope and Frank Zweifel appeared on behalf of the Bozeman Livestock Market
Center to explain their reason for protesting this area and the burden it would add to the business
if it were annexed at this time. Mr. & Mrs. Lynn J. Haniuk also appeared to explain that it would
be a hardship on them if their parcel of land were annexed into the City as it would increase their
taxes.
Following an extensive discussion, it was moved by Commissioner Taylor, seconded by Commissioner
Vandeventer, that the Commission table action on the Northeast Annexation for a period of one month
for the planning board to study and evaluate, and the motion was carried by the following i."ye and No
vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind,
Commissioner Sedivy and Mayor Vollmer; those voting No, none.
Summit Engineering - Annexation of Approximately Fifteen Acres
A letter received from Mr. W. H. Clark, Vice President and Manager of Development Credit Corp-
oration of Montana, petitioning the City of Bozeman to annex Tracts 1 and 2, in the NE 1/4, Section
24, T2S, R5E, MPM., adjacent to the Montana State University campus, due south of the Museum of the
Rockies and consisting of approximately fifteen acres, was presented.
Following a discussion, the Commission concurred in the recommendation of the City Manager, and
it was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the Commission
acknowledge receipt of the petition and instruct the City Attorney to draw up a resolution of intent
to annex Tracts 1 and 2, in the NE 1/4, Section 24, T2S, RSE, MPM, to the City of Bozeman. The motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Comm-
issioner Lehrkind, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none.
Planning Board Recommendations for Annexation Review
A l~tter received from the Bozeman City-County Planning Board, recommending to the City Commiss-
ion thaUare now under consideration, not be approved until a full report is prepared by the Planning
Board and a recommendation presented to the Commission.
William Grabow, president of the Bozeman City-County Planning Board, appeared and advised the
Commission that the Planning Board would like some avenue of approval as to the growth study with
the hope that it would be a joint venture whereby the Planning Board and the City Commission would
establish a direction for which future community development should proceed.
Following a discussion, the City Manager concurred in the recommendation of the City-County
Planning Board that the City adopt a policy whereby all annexation be referred to the Bozeman City-
County Planning Board before they are passed upon by the City Commission
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the Commission
approve adoption of the above policy. The motion was carried by the following Aye and No vote;

Request to Conduct March of Dimes Walkathon - 24 April or 1 May 1976
A letter received from W. H. Hoff of the National Foundation of March of Dimes, requesting
permission to conduct a fund drive on Saturday, 24 April, weather permitting, or 1 May 1976, was
presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission
grant permission to the National Foundation of March of Dimes to conduct the fund drive on 24 April
or 1 May 1976. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind and Mayor
Vollmer; those voting No, none.
Interpretation of Zoning Code - Carpet Sales, B-2
A letter received from Joseph W. Sabol, requesting that the City Commission make an interpre-
tation of the uses allowed in a B-2 Zone to determine whether or not retail carpet sales would be
allowed in such zone, was presented.
Following a discussion, the Commission concurred with the recommendation of the City Manager,
and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission
make an interpretation to include carpeting and floor covering sales and installation in the B-2
Zone of the Bozeman Zoning Code. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner
Sedivy and Mayor Vollmer; those voting No, none.
Authority to Purchase Replacement Vehicle for Detective Division
The Police department has need for a new vehicle to be used by the Dectective Division, and
the City Manager requested authorization to purchase a 1976 4-door Pontiac LeMans from Robert F.
Dye, Inc., Bozeman, at an estimated cost of $3,400.00.
It was moved by Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the purchase
be authorized as a 1975-1976 budget item, and the motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Sedivy,
Commissioner Taylor and Mayor Vollmer; those voting No, none.
Application for Bingo License - Rosary High School
The City Manager presented an application from the Rosary High School, along with the required
$10.00 fee, for a Bingo License for the purpose of holding a Bingo Game on 6 March 1976.
It was moved by Commissioner Lehrkind, seconded by Commissioner Sedivy, that the City Approve
the application of the issuance of the Bingo License, and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Sedivy, Commissioner
Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Proclamation - Red Cross Membership Month
Mayor Vollmer proclaimed the month of March as Red Cross Membership Month in the City of Bozeman
as requested by the Five Rivers Chapter of the American National Red Cross.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission concur
in the Mayor's proclamation, and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Commissioner Lehrkind;
those voting No, none.
Report - Director of Public Service
The City Manager commented on the report of the Director of Public Service and recommended
acceptance thereof.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission
accept the report, and the motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Taylor, Commissioner Vandeventer, Commissioner Lehrkind, Gommissioner:Sedivy,
and Mayor Vollmer; Those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Lehrkind, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Lehrkind, Commissioner SediVY, Commissioner Taylor and Mayor Vollmer; those voting No,
none.
