HomeMy WebLinkAbout1976-02-11 I I I 431 Bozeman, Montana 11 February 1976 The Commission of the City of Bozeman met in regular session in the CommissionRoom, Municipal Building, 11 February 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Assistant City Manger Wolf, City Attorney Berg and the Clerk. Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meetingheld on Wednesday, 4 February 1976, were approved as read. Absence of Commissioner Lehrkind, 11 February 1976 Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the absence of Commissioner Lehrkind, from this meeting, be authorized in compliance with Section 11-3245, R.C.M., 1947. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer, and Mayor Vollmer; those voting No, none. Open Bids - Four Wheel Drive Vehicle - Water Department This was the time and place set for opening of sealed bids for the purchase of a 3/4 ton, four wheel drive pickup for the Water department. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none. The following bids were then opened and read: Bozeman Ford, Bozeman Robert F. Dye, Bozeman M & W G.M.C., Three Forks Rolfe & Wood, Bozeman $5,477 .52 5,233.00 5,340.00 5,592.24 The City Manager recommended that the bids be referred to the Water Department Superintendent for tabulation, consideration and a final recommendation on 18 February 1976. It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the bids he referred to the Water Superintendent for tabulation and recommendation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Park Recreation Program Recommendation - Tennis Court Proposal The Tennis Court proposal in the approximate amount of $30,000 having been studied for a period of one week was again presented for consideration. Following an extensive discussion, it was moved by Commissioner Vandeventer, seconded by Comm- issioner Sedivy, that the tennis court proposal and other priorities on the list be continued for a period of one week. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Commission Resolution No. 1778 - Creat SID 558. Paving Figgins Addition COMMISSION RESOLUTION NO. 1778 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 558 OF THE CITY OF BOZEMAN FOR THE ,PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, AND NECESSARY APPURTENANCES THERETO ON MORROW STREET, SPRING CREEK DRIVE, LANGOHR AVENUE BETWEEN ARNOLD STREET AND WESTRIDGE DRIVE, ARNOLD STREET BETWEEN LAN- GOHR AVENUE AND SOUTH THIRD AVENUE, AND WESTRIDGE DRIVE BETWEEN LANGOHR AVENUE AND SOUTH THIRD AVENUE IN THE FIGGIN' s ADDITION TO THE CITY OF BOZEMAN. as prepared by the City Attorney was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that Commission Resolution No. 1778 creating Special Improvement District No. 558, paving Figgins Addition to the City of Bozeman be passed and adopted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Comm- issioner Vandeventer and Mayor Sedivy; those voting No, none. Commission Resolution No. 1779 - Intent to Create SID No. 559 - Paving 15th Avenue, Babcock to Koch A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 559 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS; AND NECESSARY APPURTENANCES THERETO; ALSO CONSTRUCTION AND INSTALLATION OF NECESSARY STORM DRAINAGE PIPE, INLETS, MANHOLES, DITCHES, AND APPURTENANCES NECESSARY TO STORM DRAINAGE ON SOUTH FIFTEENTH AVENUE BETWEEN WEST BABCOCK STREET AND WEST KOCH STREET IN THE CITY OF BOZEMAN, MONTANA. 432 prepared by the City Attorney as directed by the City Commission was presented. The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that Commission Resolution No. 1779 declaring it to be the intention to create Special Improvement District No. 559 for the purpose of paving and storm drain construction on South Fifteenth Avenue between West Babcock Street and West Koch Street in the City of Bozeman be passed and adopted, and Wednesday, 10 March 1976, be the date set for a public hearing, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Proposed Compliance Schedule - Sewage Treatment Improvements A proposed compliance schedule for the purpose of upgrading the SDS plant in order to achieve EPA funding and concur with future effluent limitations was presented. It was pointed out by James Cummings, Consulting Engineer for Thomas, Dean & Hoskins, Inc., that they felt they could meet time table providing there was no delay on the part of the EPA or the State Department of Environmental Science and Health. The City Engineer suggested that the City might agree to the time table with the condition that the door be left open for the City of Bozeman to appeal to the State Board of Health to remove the 3.5 milligrams per liter of Amonia Nitrogen from the waste discharge permit. Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the Commission comply with the compliance schedule and leave the door open to qualify the approval. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, and Mayor Vollmer. Commissioner Taylor voted No. Commission Meeting Agenda Preparation - Request to accomodate Bozeman Daily Chronicle Deadlines The Bozeman Daily Chronicle requested that the City Commission alter the deadline for receiving items for the Agenda from Noon on Tuesday to 5:00 o'clock P.M. on Monday. The purpose for the change is to receive a copy of the Agenda in time to inform the public by publishing same in Tuesday's addition. Commissioner Vandeventer went on record as saying he was mctlt pleased to receive the Agenda on Tuesday. Mayor Vollmer stated the Commission would invite all the help they could get from the news media concerning altering the policy for receiving items for the Agenda. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission al~er the policy for receiving items for the Agenda from noon on Tuesday to 5:00 o'clock p.m. on Monday but that the Commission have the prerosative to add to the agenda if so desired during the COmmission meeting. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. Application for Gambling Licenses - a) Rocking 'R' Card Room, 2 Card Tables - $500.00 b) Five Rivers Red Cross Chapter - Raffle - $25.00 The City Manager presented an application from the Rocking IR' Card Room along with the required fee of $500.00 for the purpose of operating two card tables at the Rocking 'R' Card Room. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission concur in the recommendation of the City Manager and approve the application for the gambling license, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Sedivy and Mayor Vollmer; those voting No, none. The City Manager presented an application from the Five Rivers Red Cross Chapter along with the required fee of $25.00 for a raffle license for the purpose of holding a raffle on 3 March. It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the application for a raffle license be approved and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Beer & Wine License Application - Mr. Woody's, 1211 East Main Street. The City Manager presented an application and the appropriate fee for a Beer and Wine License for the year 1976 for Mr. Woody's, 1211 East Main Street. Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission approve the above application for the Beer and Wine License. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Sedivy, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. I I I I I I Sanitary Sewer Line Easement - Mary Palffy An Easement and Right of Way Agreement by and between Mary Palffy and the City of Bozeman for the purpose of installing, operating, using, repairing, replacing, maintaining and removing a sani- tary sewer and appurtenances and for such other rights of access and incidental thereto upon and across the southwest portion of the City of Bozeman and consisting of a strip of land thirty feet in width being fifteen feet on either side of the center of Section 12, Township 2 South, Range 5 East, M.P.M., was presented. The Commission concurred with the recommendation of the City Manager, and it was moved by Comm- issioner Taylor, seconded by Commissioner Vandeventer, that the Right-of-Way Agreement, having been executed by the property owners, be approved and the Mayor and Clerk be authorized to sign for the City. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Authority to Call for Bids - Street Sweeper with Trade-In - Open 3 March 1976 The Street Department has need for a new Street Sweeper and the City Manager requested author- ization to call for bids for a three cubic yard street sweeper with trade in. It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the purchase of the Street Sweeper be authorized and the Clerk of the Commission be authorized to issue a "Call for Bids" for the purchase to be received and opened on Wednesday, 3 March 1976, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none. Request to Conduct VFW Buddy Poppy Sale, 14-15 May 1976 A letter received from the V.F.W. Auxiliary No. 903, requesting permission for the members of Major Drennan Auxiliary to sell "Buddy Poppies" on 14-15 May 1976, was presented. It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that permission to conduct the fund drive be granted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none. Reports: The following reports were presented: Librarian Building Inspector Police Court Fire Chief The City Manager commented on the reports and recommended they be accepted. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the reports be accepted. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commiss- ioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none. Claims for January Claim No. 22592 thru 22804 and 05634 thru 05838 inclusive were presented. It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the claims be approved as presented, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
