The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 21 January 1976, at 1:15 o'clock p.m. Present were Mayor Vollmer, Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer, City Manager Fryslie, Ass't. City Manager Wolf, City
Attorney Berg and the Clerk.
Commissioner Sedivy opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 14 January 1976, were approved as read.
Open Bids - Sodium Silicofluoride (40,000 Ibs.)
This was the time and place set for opening bids for the purchase of 40,000 pounds of Sodium
Silicofluoride. The affidavit of publication of the "Call for Bids" was presented. It was moved
by Commissioner Taylor, sec;)fided by Commissioner Vandeven ter, that the bids be opened and read and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor,
Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those voting No, none.
The following bids were then opened and read:

The Commission concurred in the recommendation of the City Manager, and it was moved by Commiss-
ioner Vandeventer, seconded by Commissioner Sedivy, that the bids be referred to the Water Superin-
tendent and the Engineering staff for tabulation and final recommendation on Wednesday, 28 January,
1976, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Sedivy, Commissioner Taylor and Mayor Sedivy; those voting No, none.
Authorize Absence of Commissione~ Lehrkind, 21 January 1976
Upon recommendation of the City Manager, it was moved by Commissioner Sedivy, seconded by
Commissioner Taylor, that the absence of Commissioner Lehrkind, f~om this meeting, be authorized
in compliance with Section 11-3245, R.C .M., 1947, and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vande-
venter and Mayor Vollmer; those voting No, none.
Commissim Resolution No. 1777 - Intent to Annex 260 Acres (Approximately) Northeast of Bozeman
Hearing 25 February 1976
Commission Resolution No. 1777 declaring the City Commissions intention to extend the boundaries
of the said City of Bozeman so as to include approximately 260 acres and to be known as the Northeast
Annexation to the City of Bozeman, entitled:

Pro1ect Notice - HUD Grant for Acquisition of Housing Site $220,000
The City Manager presented a Project Notification and Review Form as required in the Montana
Clearinghouse Procedures Manual for Federal Funds Applications for the purpose of applying for Comm~
unity Block Grant Discretionary Funds in the amount of $220,000.00 for acquisition and installation
of Si~e Improvements (Designed to assist in eventual construction of new rental assisted apartment
housing for low-income elderly, handicapped and families now living in substandard housing).
Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Vandeventer,
that the Commission concur in the recommendation of the Bozeman City-County Planning Board, also
concurred in by the City Manager, and approve the HOD Application for Acquisition of Housing Site in
the amount of $220,000.00. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor Vollmer; those
voting No, none.

Zone Code - Mobile Home Parks and Subdivisions
A letter received from Dave Fackler, Associate Planner of the Bozeman City-County Planning
Board, requesting an interpretation of the classification of Mobile home subdivision, from the
City Commissioner, was presented.
The problem of interpretation arises in that mobile home parks are, at present, conditional
uses in the R.3, R-4, and R-5 zones, however, mobile home subdivisions are not a listed use in any
zone.
Following an extensive discussion, the Commission concurred in the recommendation of the City
Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the
City Commission interprete the Zoning Code Ordinance to include Mobile Home Subdivisions as well
as Mobile Home Parks in the Zoning Ordinance as requested by the City-County Planning Board. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none.
Recess - 2:15 o'clock p.m.:
It was moved by Commissioner Sedivy, seconded by Commiissioner Taylor, that the Commission
declare a recess for the purpose of meeting with the Board of Trustees of the Police Reserve. The
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Reconvened - 2:25 o'clock p.m:
A letter received from Chief of Police Robert K. Johnson, requesting that since he had completed
twenty years of service with the Bozeman Police Department, he be passed from the active to the Police
Reserve in accordance with Section 11-1818, R.C.M., 1947, was presented.
The Board of Trustees of the Police Reserve Board, at their meeting held during the recess,
recommended that Chief of Police Robert K. Johnson's request to be placed on the inactive Police
Reserve, beginning 1 February 1976, be approved by the City Commission.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that they concur in the
recommendation of the Board of Trustees of the Police Reserve Fund, that Chief of Police Robert K.
Johnson be passed from the active police to the inactive police reserve effective 1 February, and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer; those voting No, none.
Proposal by Thomas, Dean & Hoskins - Sanitary Sewer Line TV Inspection
A letter addressed to the City Commission, whereby Thomas, Dean & Hoskins, Inc., propose a
Step 1 grant extension for TV inspection of the collection system in the amount of $64,158.00, was
presented. The grant would cover both the work of the TV contractor and the analysis of the survey
of Thomas, Dean & Hoskins, Inc., and an additional study of ammonia conversion. Based upon the
original fee of $54,390.00 and the increased fee of $9,768.00, the total programed step 1 increase
would be $64,158.00 of which 75% ($48,118.50) would be a grant from EPA. The City's cost would be
$16,039.50.
Following a thorough discussion, the City Manager concurred in the recommendation of Thomas,
Dean & Hoskins, Inc., and recommended that the Commission authorize the execution of a TV inspection
contract and the additional work to be performed by Thomas, Dean & Hoskins, Inc., contingent upon
EPA concurrence and related grant commitments.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission
approve the proposal as set forth, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy, and
Mayor Vollmer; those voting No, none.
Authority to Purchase PUP Pickup Packer - Park Department
The Park department has need for a pickup packer and the City Manager requested authorization
to purchase a PUP Pickup Packer in the approximate amount of $3,866.00.
It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that the purchase of
the PUP Pickup Packer from Johnson Distributing, Great Falls, be authorized as an item of the 1975-
1976 budget, and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Vandeventer, Commissioner Sedivy, Commissioner Taylor and Mayor Vollmer; those voting No, none.
Proclamation: a) National Crime Prevention Week, 8-14 Feb. b) American Heart Month, Feb. 1976
Mayor Vollmer proclaimed the week of 8-14 February as "National Crime Prevention Week" in con-
currence with the Exchange Clubs throughout the nation and urged all citizens of our community to

join the Exchangites with their enthusiastic participation in the activities scheduled not only for
this week, but also the entire year, and to be conscious of and to cooperate fully in protecting
persons and property by following the Exchange Club's Crime Prevention Slogan, namely: '~ets lock
up . . . . Lets Lock up Crime: 11
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission en~
dorse the Mayor's proclamation and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeventer and Mayor Vollmer, I
those voting No, none.
In accordance with the Heart Association, Mayor Vollmer proclaimed February as American Heart
month and urged all residents of Bozeman to support the 1976 Heart Fund campaign to be conducted
across the nation through gifts and voluntary services which will speed greater advances in the
conquest of this scourge, our nation's leading killer and disabler.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission
endorse the Mayor's proclamation, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy and Mayor
Vollmer; those voting No, none.

Authority to Attend IBM Executive Education Program - Commissioner Lehrkind & City Manager Pryslie
It was moved by Commissioner Vandeventer, seconded by Commissioner Sedivy, that Commissioner
Lehrkind and City Manager Fryslie be authorized permission to attend the IBM Executive Education
Program to be held in San Jose, California from 26 to 29 January 1976, and that the Assistant City
Manager be designated to perform the duties of the City Manager during this period and, it being in
the public interest their travel expenses be paid out of the appropriate fund. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Sed-
ivy and Commissioner Taylor and Mayor Vollmer; those voting No, none.
Pi Week, 1-7 February 1976
A letter received from the public relations chairman of Gamma Kappa Chapter of the Pi Kappa
Alpha Fraternity, requesting permission to sell pies from 1-7 February, with the proceeds to go to I
the March of Dimes to aid them in their fight against birth defects, was presented.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission
grant permission to the National Foundation of the March of Dimes to conduct their fund drive from
1-7 February, and the motion was carried by the following Aye and No vote: those voting Aye being
