The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building. 14 January 1976. at 1:15 o'clock p.m. Present were Commissioner Lehrkind. Commissioner
Sedivy. Commissioner Taylor. Commissioner Vandeventer. Acting City Manager Wolf. City Attorney Berg
and the Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had

Hearing. Commission Resolution No. 1772 - Vacation of Ida Street. Mendenhall to Lamme
This was the time and place set in Commission Resolution No. 1772 for the hearing of protests
to vacating the alley between Mendenhall and Lamme Street which is an extension of Ida Street. Affi-
davit of publication of Notice and the Clerks certificate stating that all property owners had been
notified as required by law was presented. There were no written protests on file and no one appeared
to protest verbally.
A memorandum from the City engineer recommending denial of the vacation of the alley was read.
Mrs. Townsend was present to answer additional questions in regard to the closing of the alley.
Following an extensive discussion. the Acting Mayor declared the hearing closed and it was moved
by Commissioner Sedivy. seconded by Commissioner Taylor, that they concur in the recommendation of
the engineering staff and deny vacation of the alley between Mendenhall Street and Lamme Street which
is an extension of Ida Street. Those voting Aye being Commissioner Sedivy. and Acting Mayor Lehrkind.
those voting No being Commissioner Taylor and Commissioner Vandeventer. The motion failed for lack
of a majority.
It was then moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Comm-
ission continue action of the vacation of the alley between Mendenhall and Lamme Street which is an
extension of Ida Street until a full slate of Commissioners are present. The motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Taylor. Commissioner Vandeventer.
Commissioner Sedivy and Acting Mayor Lehrkind; those voting No. none.
Agreement with State Regarding Plumbing Inspection
The Acting City Manager presented an Agreement whereby the Board of Plumbers of the Department I
of Professional and Occupational Licensing. State of Montana. enter into an Agreement with the City
of Bozeman for the purpose of providing complete and effective regulations of the installation and
maintenance of plumbing and to enforce the plumbing code of the State of Montana.
The Building Inspector explained the Agreement as such and some of the options open to the City
of Bozeman in making the Agreement and recommended that the City Commission sign the Agreement author-
izing the Building department to make inspection inside of the City Limits and on a job by job basis
at the request of the State Plumbing Board. inspect installation in the three mile jurisdiction area.
It was moved by Commissioner Taylor. seconded by Commissioner Vandeventer. that the Commission
adopt the Agreement and inspect only inside of the City Limits. Those voting Aye being Commissioner
Taylor and Commissioner Lehrkind; those voting No being Commissioner Vandeventer. The motion failed
for lack of a majority.
After further discussion. it was move? by Commissioner Vandeventer. seconded by Commissioner
Sedivy, that the Commission sign the Agreement as recommended by the Building Inspector. Those voting
Aye being Commissioner Vandeventer and Commissioner Sedivy; those voting No being Commissioner Taylor.
and Commissioner Lehrkind. The motion failed for lack of a majority.
It was then moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission
continue action on adoption of the Agreement until all five members of the Commission are present.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Sedivy,
Commissioner Taylor, Commissioner Vandeventer. and Acting Mayor Lehrkind; those voting No. none.
Change Order No.2, SID 547 - Storm Drain & Sidewalk Subgrade Improvements, Durston Road & No. 16th
Change Order No.2 on SID No. 547 prepared by Thomas. Dean & Hoskins, Inc.. to become a part I

The Acting City Manager concured with the engineers and reccmmended that Change Order No.2 be
accepted and approved as presented.
It was moved by Commissioner Sedivy. seconded by Commissioner Taylor, that the Change Order be
accepted and approved and the Mayor and Clerk of Commission be authorized and directed to sign for
the City. and the motion was carried by the following Aye and No vote: those voting Aye being Comm-

Beer & Wine License - Lundy's Landing
The Acting City Manager presented an application and the appropriate fee for a Beer and Wine
License for the year 1976 for Lundy's Landing, 16 North Tracy Avenue, Bozeman, Montana.
Upon recommendation of the Acting City Manager, it was moved by Commissioner Vandeventer, se-
conded by Commissioner Sedivy, that the Commission approve the above application for Beer and Wine
License. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Sedivy, Commissioner Taylor and Acting Mayor Lehrkind; those voting No, none.
Raffle Applications - a) VFW Auxiliary 1 April 1976. b) Soroptimist International 7 February 1976.
The Acting City Manager presented an application from VFW Auxiliary along with the required fee
of $10.00 for a raffle license for the purpose of holding a raffle on 1 April 1976.
It was moved by Commissioner Sedivy, seconded by Commissioner Taylor, that the Commission approve
the application for the VFW Auxiliary raffle license, and the motion was carried by the following Ay-
and No vote: those voting Aye being Commissioner Sedivy, Commissioner Taylor, Commissioner Vandeven-
ter and Acting Mayor Lehrkind; those voting No, none.
The Acting City Manager presented an application from Soroptimist International along with the
required $10.00 fee for a raffle license for the purpose of holding a raffle on 7 February 1976.
It was moved by Commissioner Taylor, seconded by Commissioner Vandeventer, that the Commission
approve the application for the raffle license, and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Taylor, Commissioner Vandeventer, Commissioner Sedivy
and Acting Mayor Lehrkind; those voting No, none.

be accepted and ordered filed and the motion was carried by the following Aye and No vote: those

Mayor Lehrkind; those voting No, none.
Adjournment
There being no further business to come before the Commission at this time, it was moved by
Commissioner Vandeventer, seconded by Commissioner Sedivy, that the meeting be adjourned and the
motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande-
venter, Commissioner Sedivy, Commissioner Taylor and Acting City Mayor Lehrkind; those voting No,
none.
