The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 24 December 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Ass't
City Manager Wolf, City Attorney Berg, and the Acting Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 17 December 1975, were approved as read.
Absence of the Clerk of the Commission
In the absence of the Clerk of the Commission, it was moved by Commissioner Vollmer, seconded
by Commissioner Vandeventer, that Mrs. Diane Krupinsky be appointed as Acting Clerk of the Commission,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy;
those voting No, none.
Request to Vacate Alley - Juniper to Aspen - 7th to 8th
The letter received from Robert Graf requesting that the City vacate the alley between
Juniper and Aspen Streets and the North 25 feet of Lot 12 in Block Two (2) of Durston Second
Subdivision having been tabled for a week for further information, was again presented before
the Commission.
Mr. Edmund P. Sedivy, Jr., attorney for Mr. Graf, presented the history of the above area
and suggested that vacation of this alley would be the best alternative for all concerned.
The City Manager agreed that vacating the alley between Juniper and Aspen Streets would
be satisfactory if utility easement is provided.
Following a discussion, it was moved by Commissioner Vandeventer, seconded by Commissioner
Lehrkind, that the City Attorney be instructed to draw up a resolution of intention to vacate the
alley between Juniper and Aspen Streets and the North 25 feet of Lot 12 in Block Two (2) of
Durston Second Subdivision. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Lehrkind, and Commissioner Vollmer;
those voting No being Commissioner Taylor; and those abstaining being Mayor Sedivy.
Confirmation of Police Officer - Michael Otterberg
The Police Chief reported that Police Officer Michael Otterberg had satisfactorily completed
the required one-year probationary period and recommended that Police Officer Otterberg be
confirmed as a regular officer of the Police Department effective 24 December 1975. The City
Manager concurred in the recommendation of the Police Chief, and it was moved by Commissioner
Taylor, seconded by Commissioner Lehrkind, that the confirmation of Police Officer Michael
Otterberg be approved and he be congratulated upon completing the one-year probationary period.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy;
those voting No, none.
Proposal to Apply to Community Development Grant - Land for Housing
The City Manager presented a preapp1ication to be submitted to the Department of Housing
and Urban Development through Helena requesting Federal Assistance for the purpose of securing
a site and clearning the site to construct a rent subsidy housing unit. The American Legion,
who is sponsoring this project, needs City Commission endorsement before submitting the pre-
application.
After some discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer, that endorsement of the preapplication be approved so that it could be submitted.
The motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No being Commissioner Taylor
and Commissioner Lehrkind.
Beer and Liquor Licenses
The City Manager presented the following applications and appropriate fees for Beer, Liquor
and Wine Licenses for the calendar year 1976.

The City Manager pointed out that the behavior of the patrons, Le., littering, malicious

acts and disorderly conduct, at the downtown night clubs will not be tolerated. At least one
ordinance will be adopted which will establish a numerical occupancy limit of persons at each
location with owners in control of their patrons. The Commissioners supported the City Manager's
statement.
Upon recommendation of the City Manager, it was moved by Commissioner Vollmer, seconded
by Commissioner Vandeventer, that they approve the above applications and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
Ad journment
There being no further business to come before the Commission at this time, it was moved
by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the meeting be adjourned,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy;
those voting No, none.
