The Commission of the City of Bozeman met in regular session in the Commission
Room, Municipal Building, 12 November 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy,
Commissioner Vollmer, Commissioner Vandeventer, Conmissioner Taylor, Commissioner Lehrkind,
City Manager Fryslie, City Attorney Berg and the Acting Clerk.

Commissioner Vollmer opened the meeting with a prayer and the following proceedings were
had.
Minutes of the regular meeting held on Wednesday, 5 November 1975, were approved as read.
Minutes of the special meeting held on MOnday, 10 November 1975, were approved as read.

This was the time and place set for a public hearing to consider the request for a zone
change from RS-l to R-3 a 22+ acre tract and a RS-1 to R-1 a 29+ acre tract located along South
Third Avenue approximately 3/4 of a mile south of Kagy Boulevard.
The Zoning Commission voted to accept the recommendation of the Planning staff and to
recommend to the City Commission that the zone change requests of Carter Williams be approved.
Mr. Carter Williams, along with Mr. Rick Hayfield and Mr. James Cummings, made their
presentations in support of the zone change. Owners of property affected either directly or in-
directly by the proposed rezoning presented a petition signed by 92 residents in opposition to
the rezoning. The residents were also present to voice their opposition.
Following a thorough discussion by both parties and after the Commissioners received answers

to their questions, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, to
deny the rezoning proposal to both tracts of land, and the motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner
Vandeventer, and Mayor Sedivy; those voting No being Commissioner Vollmer.

The City Manager commented on the above reports and recommended they be accepted and
ordered filed.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the
reports be accepted and ordered filed and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor,
Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.

The City Manager checked the claims and found them to be true and lawful claims against
the City of Bozeman and recommended they be approved and the Director of Finance be instructed
to issue warrants in payment.

It was moved by Commissioner Taylor, seconded by Ornnmissioner Lehrkind, that the claims be
approved as presented and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vande-
venter, and Mayor Sedivy; those voting No, none.
Engineer's Certificate and Reconnnendation of Final Acceptance - SID 530, 535, 536, 537, 538 & 542
Pavement and Storm Drain Improvements
The Certificate of Completion of the pavement and storm drain improvements by Bozeman Sand
and Gravel as prepared by James A. Cummings, project Engineer, was presented. Because of an
overrun on time, the amount of $4,770.00 was withheld from thecontractDranda claim for additional
engineering was submitted to the City of Bozeman by Thomas, Dean & Hoskins, Inc.
The City Manager concurred in the recommendation of the Project Engineer and recommended
that the project be accepted and approved by the City Commission. This final acceptance does
not relieve the contractor of responsibility for negligence or faulty materials or workmanship
to the extent and period provided by law. It was moved by Commissioner Vandeventer, seconded by
Commissioner Taylor, that as recommended, the project be accepted as completed, and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Taylor, Commissioner Vollmer, Commissioner Lehrkind, and Mayor Sedivy; those voting
No, none.
Proclamation - American Education Week, 16-22 November 1975
Mayor Sedivy proclaimed the week of 16-22 November as "American Education Week" and urged
all Bozeman citizens, young and old, to seek involvement in the numerous facets of the education
system in Bozeman and to re-affirm their interest in the aims and achievements and needs of
the school age youth. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind,
that the proclamation as requested be endorsed and the motion was carried by the following Aye
and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner
Vollmer, and Commissioner Vandeventer; those voting No, none.
Application for Gambling Licenses: (a) Bozeman Junior High School, 26 November Raffle
(b) Steven Kattell, 6 December Raffle
(a) The City Manager presented an application from Bozeman Junior High School, along with
the required $10.00 fee for a raffle license, for the purpose of holding a raffle on 26 November.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they approve
the application for the raffle to be held on 26 November, and the motion was carried by the fol-
lowing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, and Mayor Sedivy; those voting No, none.
(b) The City Manager presented an application from Steven Kattell, along with the required
$10.00 fee for a raffle license, for the purpose of holding a raffle on 6 December.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they approve
the application for the raffle to be held on 6 December, and the motion was carried by the fo1low-
ing Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer,
Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
Claims Against the City - Arnold Van Dyke and Harold Murdock
City Attorney Berg presented a claim fron Arnold Van Dyke against the City of Bozeman for
$149.37. Mr. Berg also presented a claim from Harold Murdock against the City of Bozeman for
$549.64. Attorney Berg requested more time to study these claims.

It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the claims
be delayed for one week to give legal counsel more time to study, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner
Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none.
