HomeMy WebLinkAbout1975-11-05 1 1 I Bozeman, Hontana 5 November 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 5 November 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, City Attorney Berg, and Acting Clerk. Commissioner Lehrkind opened the meeting wi th a prayer and the follOtl7ing proceedings were had. Minutes of the regular meeting held on Wednesday, 29 October 1975, were approved as read. Hearing - Howard V. Billips - Zone Change from RS-l to R-4 This was the time and place set for a public hearing to consider the application of Howard V. Billips for a zoning change from RS-l to R-4 for a tract of land located on West Lincoln approxi- mately 500 feet east of South 19th Avenue. The Bozeman Zoning Commission, having reviewed the report of the Planning staff, recommended approval of the zone change from "RS-1 to R-4". Upon the City Manager's recommendation and the Bozeman Zoning Commission's recommendation, it was moved by Commissioner Vollmer and seconded by Commissioner Vandeventer, that they approve the zone classification change from RS-l to R-4, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Easement - Sanitary Sewer - Lot 3, Block 4, Thompson Third Addition An Easement and Right of Way Agreement from Christ the King Luthern Church for the purpose of installing, operating, using, repairing, replacing, maintaining, and removing a sanitary sewer thereto upon and across their property lying within the City of Bozeman, County of Gallatin, State of Montana, was presented. The City Manager recommended that the City enter into the Agreement, and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Easement Agreement be entered into by the City and the Mayor and Clerk of the Commission be authorized and directed to sign for the City and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Mayor Sedivy; those voting No, none. ~plications for Gambling Licenses: (a) MSU Bouling Teams - Raffle (b) Thomas A. Bates - Card Tables (c) American Legion Club - Keno Board (a) The City Manager presented an application from MSU Bowling Teams, along with the required $10.00 fee for a raffle license, for the purpose of holding a raffle on 10 December. It was moved by Commissioner Taylor, seconded by Conmissioner Lehrkind, that they approve the application for the raffle to be held on 15 December, and the motion was carried by the follow- ing Aye and No Vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commis- sioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. (b) The City Manager presented an application from Thomas A. Bates for Molly Brown, 703 W. Babcock, along with the required $500.00 fee, for the purpose of operating card tables. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they approve the application for operating card tables, and the motion was carried by the fol1Otl7ing Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vande- venter, Commissioner Taylor, and Mayor Sedivy; those voting No, none. (c) The City Manager presented an application from the American Legion Club along with the required $250.00 fee, for the purpose of operating a Keno board. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that they approve the application for the Keno board, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none. Application for,Beer License - Teepee Gas Co. A request from the Teepee Gas Co. for permission to obtain an off-premise City Beer License, along with the required fee, was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Teepee Gas Co. be granted a license to sell beer, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. 389 390 Authority to Purchase Pick~ Truck - Park Recreation Department The Park Recreation Department has need for a one-half ton pickup, and the City Manager requested authorization to purchase a 1975 GNC one-half ton pickup truck from Robert F. Dye, Inc., Bozeman, at an estimated cost of $3,997.43. The City Manager pointed out that the Department's budget included $4,500.00 for such a truck. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the purchase be authorized, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, and Mayor Sedivy; those voting No being Commissioner Taylor. R~.E9LS-"l: Librarian The City Manager commented on the report of the Librarian and recommended it be accepted and ordered fi led. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the report be accepted and ordered, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Conwissioner Lehrkind, Comn1issioner Vollmer, and Mayor Sedivy; those voting No, none. Appointment~. Mayor Sedivy announced his appointments for two vacancies as follows: Park and Recreation Board Gary Tshache Planning Co~nission John Johnson It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that they concur with the Mayor's recommendation and the motion was carried by the following Aye and No vote; those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor; those voting No, none. Canvass Returns - Hunicipa1 Election The City Manager pointed out that the Commission must have a special meeting this following Monday to canvass the election returns. It was agreed to meet Monday at 7:30 o'clock p.m. for this purpose. Recess There being no further business to come before the Commission at this time, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that this meeting be recessed until 7:30 o'clock p.m. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. * * * * * * * * * * * * * The Commission of the City of Bozeman reconvened the previously recessed meeting at 7:30 o'clock p.m. in the Commission Room of the }lunicipal Building. Senior Citizens' Request for a Portion of Beall Park The matter of a request from the Senior Citizens to move the Montana Hall Annex building to a portion of Beall Park for the purpose of utilizing it as a senior social center was again discussed. Considerable comment was offered supporting the request by representatives of the senior citizens. Petitions protesting the proposal were filed by approximately 175 property owners and residents of the area surrounding Beall Park. Also a protest from approximately 70 young persons Was filed. Individuals representing each of the protesting groups were also present and made oral presentations. Following lengthy discussion, it was moved by Commissioner Taylor and seconded by Commissioner Lehrkind that the City Commission deny the Senio~ Citizens' request for use of a portion of Beall Park upon which to place Montana Hall Annex Building; but that the City Commission do offer the granting of a site for this same purpose appropriately located within Westlake Park and that the City will install water and sewer facilities if all of the legal and regulatory prerequisites can be resolved. The motion t-laS carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Commissioner Vandeventer; those voting No being Mayor Sedivy.
