The Commission of the City of Bozeman met in regular session in the Commission Room,
Municipal Building, 29 October 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager
Fryslie, Ass't City Manager Wolf, City Attorney Berg and Acting Clerk.
Commissioner Vandeventer opened the meeting with a prayer and the following proceedings
were had.
Minutes of the regular meeting held on Wednesday, 22 October 1975, were corrected and
approved as read.
Consideration of Bids - )[1gh Velocity H-.Z9-raulic Se~.,er Line Cleaner
The Superintendent of Water and Sewer having completed tabulation of the bids for the pur-
chase of a High Velocity Hydraulic Sewer Line Cleaner recommended that Owenhouse Hardware of
Bozeman be awarded the bid on the basis of their low bid in the amount of $18,457.00.
The Commission concurred in the recommendation of the Superintendent of Water and Sewer,
also concurred in by the City Manager, and it was moved by Commissioner Vollmer and seconded by
Commissioner Vandeventer that Owenhouse Hardware of Bozeman be awarded the bid on the basis of
their low bid in the amount of $18,457.00. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner
Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
Considerations of Bids: (a) Sprinkling Irrigation System Installation
(b) Irrigation System Haterials
Engineered Construction, Inc., having completed tabulation of the bids for the sprinkler
systems in Lindley, Beall and Bogert Parks recommended that Mountain Supply Co. be awarded the
bid on the basis of their low bid in the amount of $13,689.37. It was also recommended that
the City reject the bid for trenching and installation on the basis that it is the sole bid
and not representative of competitive bidding.
The City Manager, having concurred in the recommendation of Engineered Construction, Inc.,
recommended the City Conuuission to do likewise.
It was moved by Comn1issioner Vollmer, seconded by Commissioner Vandeventer, that Mountain
Supply Co. be awarded the bid on the basis of their low bid in the amount of $13,689.37 with
the understanding that we may reduce the order for materials if need be. The motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Con~issioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
It was then moved by Commissioner Taylor and seconded by Commissioner Lehrkind that they reject
the bid for trenching and installation for this project, and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind,
Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.
Hearing, Conm1ission Resolution No. 1768 - Assess Garbage Collection ."}~Disposal
$116,228.02 - $37,264.86
This was the time and place set for public hearing on levying the Solid ~Jaste Collection
and Disposal Assessment in the total amount of $153,633.28. No one appeared to protest ver-
bally and there being no protests on file, it was moved by Commissioner Lehrkind, seconded by
Commissioner Vollmer, that Commission Resolution No. 1768 provisionally passed and passed on
22 October 1975 be finally passed. The motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer,
Commissioner Taylor, and Hayor Sedivy; those voting No, none.
Continuation - Senior Citizen Center Discussion
The Senior Citizens asked the City Commission that a meeting be arranged to include the
Senior Citizens' Planning and Finance Committees, the City Commission, the Park Board, Human
Resources Development Center and the Gallatin Council on Aging in order to discuss the problem
of Beall Park. Mayor Sedivy suggested meeting on 5 November at 7:30 o'clock p.m. in the Commis-
sion Room of the Municipal Building and the Commission concurred. It was understood that the
Commission would invite the members of the City offices involved.
A letter from Representative John Vincent to the Commission stated that from information
he received from Mr. Aasheim the building could be set on the park without adversely affecting
the BOR grant.
Mayor Sedivy thanked the senior citizens for their information.

~American Legion Club - Card Tables
(a) The City Manager presented an application from Phi Sigma Kappa, along with the required
$10.00 fee for a raffle license, for the purpose of holding a raffle on 31 October.
It was moved by Commissioner Vollmer and seconded by Commissioner Vandeventer that they
approve the application for the raffle to be held on 31 October, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.
(b) The City Manager presented an application from Bozeman Legal Secretaries Association,
along with the required $10.00 fee for a raffle license, for the purpose of holding a raffle
on 4 December.
It was moved by Commissioner Vandeventer and seconded by Commissioner Taylor that they
approve the application for the raffle to be held on 4 December, and the motion was carried by
the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner
Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none.
(c) The City Manager presented an application from the American Legion Club, along with
the required $500.00 fee gambling license, for the purpose of operating card tables at their
house.
It was moved by Commissioner Taylor and seconded by Commissioner Lehrkind that they approve
the application for operating card tables, and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner
Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.
ChaD:.~Order G-2 - Hunicipal Pool - $80lf.OO
Change Order No. G-2 on the construction of the Municipal Pool as prepared by Wayne Edsall,
Bozeman, to become a part of the original contract was presented as follows:
Furnish all labor and material to complete ceramic
floor tile in rooms #7 and #14 and extending to the
control counter in Room #5

The City Manager concurred tvith Wayne Edsall and recommended that Change Order G-2 be
accepted as presented. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer,
that the Change Order be approved and the Mayor and Clerk of the Commission be authorized and
directed to sign for the City, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer,
Commissioner Taylor, and Mayor Sedivy; those voting No, none.

COMMISSION RESOLUTION NO. 1769
A RESOLUTION PURSUANT TO STATUTORY PROVISIONS, SETTING OUT THAT THE CITY
COl1MISSION UNDERTAKES AND AGREES TO ISSUE ORDERS ANNUALLY AUTHORIZING
LOANS OR ADVANCES FROM THE REVOLVING FUND TO MAIZE GOOD ANY DEFICIENCY IN
PRINCIPAL AND INTEREST ACCOUNT TO THE EXTENT FUNDS ARE AVAILABLE AND TO
PROVIDE FUNDS FOR SUCH REVOLVING FUND BY MAKING TAX LEVY AND LOANS AS
THE COMMISSION DETERMINES NECESSARY.
to provide funds for a revolving fund, SID No. 553.
On the City Hanager's recommendation and the City Attorney's recommendation, it was moved
by Commissioner Vollmer and seconded by Commissioner Vandeventer that Commission Resolution
No. 1769 be passed and adopted, and the motion was carried by the following Aye and No vote:
those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor,
Commissioner Lehrkind, and Mayor Sedivy; those voting No, none.

There being no further business to come before the Commission at this time, it was moved
by Commissioner Vollmer and seconded by COmlllissioner Vandeventer that the meeting be adjourned,
and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy;
those voting No, none.
