HomeMy WebLinkAbout1975-10-22 382 Bozeman, Montana 22 October 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 22 October 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Com- missioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, City Manager Fryslie, Ass't City Manager Wolf, City Attorney Berg and the Clerk. Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had. I Minutes of the regular meeting held on Wednesday, 15 October 1975 were corrected and approved as read. Absence of Commissioner Lehrkind It was moved by Commissioner Vollmer, seconded by Commissioner Taylor, that in compliance with Section 11-3245, R.C.M., 1947, the absence of Commissioner Lehrkind be authorized, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Taylor, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. R~ No.. 1762 - Final Assessment SID No. 543, Paving & Storm Drain, Villard Street North Tracy Avenue - N. lJillson Avenue ,$21,1611-.50 This was the time and place set for public hearing on levying final assessment for construc- tion of paving Villard Street between North Tracy Avenue and North Willson Avenue in the total amount of $21,164.50. A letter received from Gilbert J. Vi cain protesting the assessment was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution No. 1762 provisionally passed and adopted on 15 October 1975, be finally passed. No one appeared to protest verbally and there being no protests on file, it was moved by Com- missioner Vandeventer, seconded by Commissioner Taylor, that Commission Resolution No. 1763 provisionally passed and adopted on 15 October 1975, be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. No one appeared to protest verbally and there being no protests on file, it was moved by Commissioner Taylor, seconded by Commissioner Vollmer, that Commission Resolution No. 17M, provisionally passed and adopted on 15 October 1975, be finally passed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none. Res._No. 1765 - Final Assessment SID No. 550, Watermains, Figgins Addition & Gr~b Third Adj.itioll.,,_,,:_,$67,523.91 This was the time and place set for public hearing on levying final assessment for the construction of watermains for Figgins Addition and Graf's Third Addition in the total amount of $67,523.91. No one appeared to protest verbally and there being no protests on file, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Commission Resolution No. 1765 provisionally passed and adopted on 15 October 1975, be finally passed. Hearing, Comm. Res. No. 1766 - Final Assessment SID No. 551, Sanitary Sewer Hai.ns, Graf Street Craf Street - He~nderson St. - $21,304.79 This was the time and place set for public hearing on levying final assessment for the construction of sanitary sewer mains on Craf Street and between Graf Street and Henderson Street in the total amount of $21,304.79. No one appeared to protest verbally and there being no protests on file, it was moved by Commission Vandeventer, seconded by Comrrlissioner Taylor, that Commission Resolution No. 1766 provisionally passed and adopted on 15 October 1975, be finally passed. No one appeared to protest verbally and there being no protests on file, it was moved by Commis- sioner Taylor, seconded by Commissioner Vollmer, that Commissioner Resolution No. 1767 provi- sionally passed and adopted on 15 October 1975 be finally passed. Open Bids - High V~locity Sewer Cleaner This was the time and place for opening sealed bids for the purchase of a high velocity sewer cleaner. It was moved by Commissioner Vandeventer and seconded by Commissioner Vollmer that the bids be opened and read and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Taylor, and Mayor Sedivy; those voting No, none. Open Bids_ - Sprinkling Irri.s.ation System Installation and Irrigation System Materials This was the time and place set for opening sealed bids for the purchase of labor and materials for irrigation systems in Lindley, Beall and Bogert Parks. It was moved by Com- missioner Vollmer, seconded by Commissioner Vandeventer, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, and Mayor Sedivy; those voting No, none. Total base bid - Materials Additive Alternate 1 Additive Alternate 2 5,300.00 1. 720.00 2,589.00 10,869.10 2,695.00 10,893.31 4,399.00 3,220.36 10,151.74 4,869.10 3,318.09 It was moved by Commissioner Vandeventer and seconded by Commissioner Vollmer that all bids be referred to the consulting engineer, Engineered Const., Inc., and the city engineer for tabulation, consideration and return it next week with a recommendation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Vollmer, Commissioner Taylor, and Mayor Sedivy; those voting No, none. 383 T 38J ~eni:Q!:" Citizens I Request - Hoving Nontana Hall Annex to Beall Park The Senior Citizens again appeared before the Commission to further discuss the moving of Montana Hall Annex to a portion of Beall Park. A letter received from William Penti11a, State Fire Marshall, was read, stating the Montana Hall Annex will meet the safety code if it is intended to be installed as a one-story structure. The Commission was informed that there will be money available for fixing up the building after it is moved to the new site. The senior citizens felt they probably have all the money necessary for remodeling the interior and many senior citizens would be willing to give their time. I A letter received from Martin Whalen stating the building will be completely vacated on 14 November for demolition or removal was read. There is $10,000.00 available for the removal of the building and filling in the hole or for destruction of the building. It was recomnlended that Westlake Park be considered as a possible site for the building. The City Manager also recommended that they consider the old Elks Building. The senior citizens much preferred the location of Beall Park. Several other interested persons expressed their concern, stating they would have to deal expeditiously because of the short time in which the building has to be removed. The Bureau of Outdoor Recreation would have to be contacted and the members asked the Commission for their endorsement in their correspondence to the Bureau of Outdoor Recreation. Mayor Sedivy and City Manager Fryslie stated they would like to help in any way possible and that they did not oppose the project but that they would have to work cautiously and go through the right channels in order not to cause a greater problem in the future. Commissioners Vandeventer and Vollmer were invited to attend a meeting with the Senior Citizens to be held on Thursday at 1:30 o'clock p.m. Mayor Sedivy thanked the senior citizens for the additional information and advised them that they would have to wait until they received word from the Bureau of Outdoor Recreation in regard to the proposed project. Application for Going Out of Business Bale License - W. T. Grant Company, 1525 w. Main Street An application received from W. T. Grant Company, 1525 ,~. Main Street, requesting a 30-day Going Out of Business Sale License in accordance with Ordinance No. 944, along with the required I of $50 was presented. It was moved by Commissioner Vandeventer and seconded by Commissioner Taylor that the application for the Going Out of Business Sale License in the amount of $50 be approved for W. T. Grant Company and the Director of Finance be instructed to issue the License, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Con[!.~mation of OJficer Nark Tymrak as Regular Policeman Effective 22 October 1975 The Police Chief reported that Police Officer Mark Tymrak had satisfactorily completed the required one-year probationary period and recommended that Police Officer Tymrak be confirmed as a regular officer of the Police Department effective 22 October 1975. The City Manager con- curred in the recommendation of the Police Chief, and it was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the confirmation of Police Officer Mark Tymrak be approved and he be congratulated upon completing the one-year probationary period. PU1"chase 50-Hcter Pool Shal1otoJ Area Insert - Recreation Department City Manager Fryslie requested authorization to purchase the 50-meter pool shallow area insert provided by Stadiums Unlimited for $2,405 with freight. It was moved by Commissioner Vandeventer, seconded by Commissioner Vollmer, that the Commission concur in the City Manager's recommendation and authorize the purchase of the 50~meter pool shallow area insert, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, I Commissioner Vollmer, Commisssioner Taylor, and Mayor Sedivy; those voting No, none. . Application for Raffle License - Lambda Chi A~pha The City Manager presented an application from Lambda Chi Alpha, along with the required $10.00 fee for a raffle license, for the purpose of holding a raffle on 25 October. Application for Raffle License - "L\lcy 5" Bowling Team The City Manager presented an application from the llLucy 5" bowling team along \-1i th the required $10.00 fee for a raffle license, for the purpose of holding a raffle on 30 December. ImproviQ8.. the High School Park Lot/S~,'imming Pool Area A letter received from the Superintendent of Schools requesting a meeting with the Commission to discuss an agreement for improving the high school parking lot/swimming pool area was presented. The Commission agreed to meet with the Board of Trustees sub-committee on 29 October 1975 follow- ing the regular Commission meeting.
