The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 15 October 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie,
Assistant City Manager Wolf, and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 8 October 1975, were approved as read.
Minutes of the special meeting held on Monday, 13 October 1975, were approved as read.
Heari~ Comm. Res. No. 1756- Final Assessment, SID No. 530, Paving & Storm Drain - 21st Avenue
West Beall to Durston Rd. - $97,050.77
This was the time and place set for public hearing on levying final assessment for construction
of paving North 21st Avenue between West Beall Street and Durston Road in the total amount of
$97.050.77. Affidavit of publication of Notice was presented. No one appeared to protest verbally
and there being no protests on file, it was moved by Commissioner Vollmer, seconded by Commissioner
Vandeventer, that Commission Resolution No. 1756 provisionally passed and adopted on 8 October 1975
be finally passed. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind,
and Mayor Sedivy; those voting No, none.
Hearing, Comm. Res. No. 1757 - Final Assessment, SID No. 535, Paving & Storm Drain - IL Hemlock St.
N. 7th Addition & Westlake's 4th Subdivision - $70,606.52
This was the time and place set for public hearing on levying final assessment for construction
of paving West Hemlock Street in the North Seventh Addition and Westlake's Fourth Subdivision in the
total amount of $70,606.52. Affidavit of publication of Notice was presented. No one appeared to
protest verbally and there being no protests on file, it was moved by Commissioner Vandeventer,
seconded by Commissioner Taylor, that Commission' Resolution No. 1757 provisionally passed and
adopted on 8 October 1975 be finally passed. The motion was carried by the following Aye and No
vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind,

$56,903.77. Affidavit of publication of Notice was presented. No one appeared to protest verbally
and there being no protests on file, it was moved by Commissioner Taylor, seconded by Commissioner
Lehrkind, that Commission Resolution No. 1758 provisionally passed and adopted on 8 October 1975 be
finally passed. The motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, and Mayor
Sedivy; those voting No, none.

This was the time and place set for public hearing on levying final assessment for construction
of paving the north two lanes of Kagy Boulevard between Seventh Avenue and Eleventh Avenue in the
total amount of $77,059.30. Affidavit of publication of Notice was presented. No one appeared to
protest verbally and there being no protests on file, it was moved by COMuissioner Lehrkind,
seconded by Commissioner Vollmer, that Commission Resolution No. 1759 provisionally passed and

of paving South Eleventh Avenue between Kagy Boulevard and West Lincoln Road and a portion of West
Lincoln Road in the total amount of $157,927.40. Affidavit of publication of Notice was presented.
No one appeared to protest verbally and there being no protests on file, it was moved by Commissioner
Vollmer, seconded by Commissioner Vandeventer, that Comnlission Resolution No. 1760 provisionally
passed and adopted on 8 October 1975 be finally passed. The motion was carried by the following

of $10,333.23. Affidavit of publication of Notice was presented. No one appeared to protest ver-
bally and there being no protests on file, it was moved by Commissioner Vandeventer, seconded by
Commissioner Taylor, that Commission Resolution No. 1761 provisionally passed and adopted on 8 October
1975 be finally passed. The motion was carried by the following Aye and No vote: those voting Aye
being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer,

This was the time and place set for opening sealed bids for the purchase of twenty portable
units of three frames, six tiers high of individual lockers and two frames, two tiers high of
individual lockers. Affidavit of publication of "Notice to Bidders" was presented. It was moved
by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the bids be opened and read, and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer,
Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting

referred to the Recreation Director and the City Engineer for tabulation, consideration and final

Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and
Mayor Sedivy; those voting No, none.
Proposal ,to place a Building on BC?ll Park - _Senior C~~izen~
William A. Phillips, a representative of the Human Resources Development Council, appeared
before the Commission on behalf of the Senior Citizens to present a proposal to relocate the Montana 1
Hall Annex on the northwest portion of Beall Park and to remodel the building for the development
of a senior center.
A number of Senior Citizens were also present in regard to the proposal and to express their
concern.
Letters received from Senator Ann Seibel, Representative John C. Vincent and the Gallatin County
Welfare Department expressing their support for the development of the Senior Citizens Center were
read by Mr. Phillips.
Following a thorough discussion, the Mayor thanked all who attended the meeting and stated
ultimate authority to approve the plan would have to come from the Board of Outdoor Recreation before
any park plans are modified.
Going Out of Business Sale License - Cattrell~~s Flooring, 225 E. Hendenhall
An application received from Cattrell's Flooring, 225 East Mendenhall Street, requesting a
thirty-day Going Out of Business Sale License in accordance with Ordinance No. 944, along with the
required fee of $50.00 was presented.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the application
for the Going Out of Business Sale License in the amount of $50.00 be approved for Cattrell's Floor-
ing and the Director of Finance be instructed to issue the License and the motion was carried by the
following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind,
Commissioner Vollmer, Commissioner Vandeventer, and Mayor Sedivy; those voting No, none.
Author~ to Call for Bids - Hydraulic SCHer, Line Cleaner - B~to be Opened 22 October 1975
The Water Department has need for a new Hydraulic Sewer Line Cleaner and the City Manager 1
requested that the purchase be authorized.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the purchase
as requested be authorized and the Clerk of the Commission be directed to issue a "Call for Bids"
for the purchase of the Hydraulic Sewer Cleaner, to be opened on 22 October 1975, and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Com~
missioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, and Mayor Sedivy; those voting No,
none.

March of Dimes Activities - 24-29 January 1975
A letter received from Mrs. Douglas Ferkin of the National Foundation March of Dimes requesting
permission to conduct a fund drive on 24-29 January 1976 was presented.
It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the Commission
grant permission to the National Foundation March of Dimes to conduct the fund drive and the motion
was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Com-
missioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and Mayor Sedivy; those voting
No, none.
Consideration of IHds - Coin Operated Lockers, Net-! Hunicipa1 Pool
The Recreation Director and the City engineers having completed tabulation of the bids for
the Coin Operated Lockers for the New Swimming Pool, recommended that Flexible Company of
Laudonvi1le, Ohio, be awarded the bid on the basis of their low bid in the amount of $29,991.64,
it being the lowest bid submitted and meeting or exceeding the llCali for Bids" as advertised.
The Commissioner concurred with the recommendation of the Recreation Director and City
Engineers, also concurred in by the City Manager, and it was moved by Commissioner Vandeventer,
seconded by Commissioner Taylor, that Flexible Company of Laudonvi11e, Ohio, be awarded the bid
on the basis of their low bid in the amount of $29,991.6lJ., it meeting or exceeding the "Call for

Reports
The City Manager commented on the report of the Police Judge and the Director of Public
Service and recommended they be accepted and ordered filed.

be accepted and ordered filed and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner

Claim
The City Manager having checked claim No. 21957 to Edsall Construction Company and covering
Estimate No.7, Bozeman Municipal Pool Contract in the amount of $50,529.02, found it to be a
true and lawful claim against the City and recommended it be approved and the Director of
Finance be instructed to issue a warrant in payment thereof.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the claim be
approved as presented and the motion was carried by the following Aye and No vote: those voting

Liquor License - Corner. Pocket, One Half Year
The City Manager presented an application from the Corner Pocket of 120 North 19th Avenue
along with the appropriate fee of $150.00 for a six month on-the-premise liquor license.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the applica-
tion for the on-the-premise liquor license in the amount of $150.00 for the Corner Pocket be
approved and the Director of Finance be instructed to issue a one-half year liquor license, and
the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Lehrkind, Commissioner Volllner, Commissioner Vandeventer, Commissioner Taylor, and Mayor Sedivy;
those voting No, none.
