HomeMy WebLinkAbout1975-09-03 351 Bozeman, Montana 3 September 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 3 September 1975, at 1: 15 0' clock p4,m. Present were Commissioner Vollmer, Commissioner Vandeventer, Ooommissioner Taylor, Commissioner Lehrkind, Assistant City Manager Wolf, and City Attorney Berg. 1 Commissioner Vollmer appointed Mrs. Williams as Acting Clerk of the City Commission in the absence of Mrs. Harding. Commissioner Vandeventer opened the meeting with a prayer, and the following proceedings were had. Absence of Mayor Sedivy - Commissioner Vollmer, President Pro-tempore It was moved by COmmissioner Vandeventer, seconded by Commissioner Lehrkind, that the absence of Mayor Sedivy be authorized in compliance with Section 11-3245, R.C.M., 1947, and that Commissioner Vollmer be designated President Pro-tempore, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer; those voting No, none. Minutes of the regular meeting held on Wednesday, 26 August 1975, were approved as read. Request of Rental Developments, Inc., to Build Over Sanitary Sewer Line Following discussion, and upon the recommendation of City Attorney Berg, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the request of Rental Develop- ments, Inc., to build over a sanitary sewer line be tabled, and the motion was carried by the 1 following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer; those voting No, none. Consideration of Police Car Bid The Commission was referred to the opening of bids for five new police cars for the City of Bozeman on 26 August 1975. The Chief of Police recommended, and the Assistant City Manager concurred, that the bid from Bozeman Ford be refused on the grounds that it did not meet all of the specifications in the "Call for Bids," and that a new "Call for Bids" be published with bids to be opened on 24 September 1975. The new bids will be for the purchase or lease of five new police cars. Upon concurrence of the Assistant City Manager and the Chief of Police, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the bid from Bozeman Ford be refused and that the Clerk of the Commission be directed to publish another "Call for Bids" to be opened on 24 September 1975, for the purchase or lease of five new police cars, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer, and President Pro-tempore Vollmer; those voting No, none. I Hearings: (a) Resolution No. 1745 - Assessment of Street Lighting (b) Resolution No. 1746 - Assessment of Street Sprinkling upon the recommendation of the Assistant City Manager, it was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the hearings for Resolution Nos. 1745 and 1746 be continued for a period of one week, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, COmmissioner Vandeventer, Commissioner Taylor, and President Pro-tempore Vollmer, those voting No, none. 3 h.') .'1." t ;...J Request - B. S. H. S. Football Rally - 4 September 1975 The request from the Bozeman Senior High School for permission to hold its traditional annual snake dance and rally on 4 September 1975 was brought before the Commission. The Assistant City Manager recommended that the school coordinate their activities with the Police Department and recommended that the Commission approve this event. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that permission be granted to Bozeman Senior High School to hold their annual rally, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer, those voting No, none. Gerald and Betty Gates - Build!ng Permi~ Application The request of Gerald and Betty Gates for permission to build on a portion of Tract 19 in the Bozeman Creek Annexation which lies west of Bozeman Creek, containing more than one acre of land, was brought before the Commission. Mr. Gates presented the City with an intention to dedicate to the City a 16 l/2-foot strip of land the length of the property for use as public right-of-way in order to meet building requirements. Following a discussion, and upon recommendation of the Assistant City Manager, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the request of Gerald and Betty Gates be approved and that they be granted permission to build on a portion of Tract 19 in the Bozeman Creek Annexation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer, and President Pro-tempore Vollmer, those voting No, none. Repor!.~ The following reports were presented: Fire Chief Building Inspector The Assistant City Manager commented on the above reports and recommended they be accepted and ordered filed. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the reports be accepted and ordered filed. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer; those voting No being Commissioner Vandeventer. Bob Lupo - rrotest A~ainst Primary," Election The protest against the primary election from Bob Lupo was presented to the Commission. Commissioner Vollmer read the recommendation from City Attorney Berg, recommending that the City Commission let the election stand and not take judicial action. After further discussion the Assistant City Manager recommended that the Commission accept the recommendation of the City Attorney. It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, second with- drawn, and then seconded by Commissioner Taylor, that the recommendation of the City Attorney to let the election stand and not take judicial action. The motion was defeated by the following Aye and No vote: those voting Aye being Commissioner Lehrkind and President Pro-tempore Vollmer; those voting No being Commissioner Taylor and Commissioner Vandeventer. 1 1 I !e.9.ues~ to VacateP~rtion.2.f Alley - Block 9. Tracy's Second Additi<?!! The request from Martel Construction for permission to vacate a portion of the alley in Block C of Tracy's Second Addition was brought before the Commission. The Assistant City Manager recommended that the request be referred to the City staff for further study and then brought back to the Commission for action. 1 It was moved by Commissioner Lehrkind, seconded by Commissioner Vandeventer, that the request from Martel Construction for vacation of a portion of the alley in Block C of Tracy's Second Addition be referred to the City staff for review and their recommendation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vandeventer, Commissioner Taylor, and President Pro-tempore Vollmer; those voting No, none. Resolution No. 1749 - Flood Plain Commission Resolution No. 1749, stating that any person selling property within the flood plain must make the real estate agent or prospective buyer aware of such conditions, was presented, entitled: COMMISSION RESOLUTION NO. 1749 A RESOLtrrION OF THE CCltMISSION OF THE CI'IY OF BOZEMAN, MONTANA, REQUIRING NOTIFICATION OF ALL PROPERTY LOCATED WITHIN DESIGNATED FLOOD PLAINS OR FLOODWAYS IN THE CITY OF BOZEMAN, COUNTY OF GALLATIN, STATE OF MONTANA. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that Commission Resolution No. 1749 be passed and adopted, and the motion was carried by the following Aye and I No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer; those voting No, none. Citation for Pedestrian Safety Mrs. Beatrice Taylor, on behalf of the Automobile Association, presented to the Commission a plaque for no pedestrian fatalities in the City of Bozeman for three years. She commended the City Commission and the Police Department for being safety minded. Commissioner Vollmer accepted the plaque on behalf of the City Commission. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer, and President Pro-tempore Vollmer; those voting No, none.
