The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal
Building, 27 August 1975, at 1:15 o'clock p.m. Present were Commissioner Vollmer, Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, City Manager Fryslie, Assistant City
Manager Wolf, City Attorney Berg and the Clerk.
Commissioner Lehrkind opened the meeting with a prayer and the following proceedings were had.
Minutes of the regular meeting held on Wednesday, 13 August 1975, were approved as corrected.
Minutes of the regular meeting held on Wednesday, 20 August 1975, were approved as read.
Absence of Mayor Sedivy - Commissioner Vollmer , President Pro-tempore
Upon recommendation of "the City Manager, it was moved by Commissioner Vandeventer, seconded by
Commissioner Taylor, that the absence of Mayor Sedivy be authorized in compliance with Section 11-3245,
R.C.M., 1947, and that Commissioner Vollmer be designated President Pro-tempore, and the motion was
carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer,
Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer; those voting No, none.
Mike Sinnard - Lions Club Project
Mike Sinnard appeared before the Commission on behalf of the Bozeman Lions to explain the
Lions Club Project for fifth and sixth graders.
The Commission thanked Mr. Sinnard for his presentation and stated the Commission would assist
in this project when and wherever possible.
Open Bids__.:..R()l"~Cars
This was the time and place set for opening bids for the purchase of five police cars to be used
by the Police Department. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor,
that the bids be opened and read, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and President
Pro-tempore Vollmer; those voting No, none. The following bid was then opened and read:

The Commission concurred with the recommendation of the City Manager, and it was moved by
Commissioner Taylor, seconded by Commissioner Lehrkind, that the bids be referred to the Chief of
Police and City Staff for tabulation, and recommendation to be made to the Commission at their next
meeting and the motion was carried by the following Aye and No vote: those voting Aye being
Commissioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer and President Pro-tempore
Vollmer; those voting No, none.
HRDC Presentation - Low.Ren1:_Ho\1~i.!!&
Nell Avery and Bill Phillips, representatives of the Human Resource Development Council, appeared
before the Commission to further report on a Local Housing Agency and to advise the Commission they
plan to work very closely with the Planning staff. They also state that HRDC can work with the
Housing Agency through the City Commission.

Ordinance No. 959 - Electrical Code
Ordinance No. 959 adopting the "National Electrical Code, 1975 Edition, published by the
National Fire Protective Association" was presented, entitled:

Commission Resolution No. 1745, levying assessment in the total amount of $19,404.84 for the
various lighting districts for the year 1975, was presented.

It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the resolution
be provisionally passed and adopted and Wednesday, 3 September 1975 be set as the date for public

Commission Resolution No. 1746, levying assessment in the total amount of $6,591.11 for street

the motion was carried by the following Aye and No vote: those voting Aye being Commissioner
Vandeventer, Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer; those
voting No, none.
Canvass Returns - Primary Election
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that a special
meeting be called to be held on Tuesday, 2 September 1975 at 7:30 o'clock for the purpose of
canvassing the election returns. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Ooommissioner Lehrkind, Commissioner Vandeventer, and
President Pro-tempore Vollmer; those voting No, none.

The City Manager commented on the above reports and recommended they be accepted and ordered
filed. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the reports
be accepted and ordered filed. The motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Lehrkind, and President Pro-tempore Vollmer;
Commissioner Vandeventer voted No.
Certificate of Completion on SID No. 5~,- Sanitary Sewer Ice Pond Road
The certificate of the engineers of Thomas, Dean & Hoskins, Inc., on Special Improvement District
No. 545, stating the Sanitary Sewer construction of the Sanitary Sewer improvements on Ice Pond Road
by Mike Boyland Excavating has been completed in accordance with the terms and stipulations given in
the plans and specifications for such work was presented.
The City Manager concurred in the recommendation of the engineers and recommended that the
project be accepted and approved by the City Commission and final payment made. This final acceptance
does not relieve the contractor of the responsibility for negligence in faulty materials or workman-
ship within the extent or period provided for by law. The Contractor has furnished a performance

bond equal to the contract bid to guarantee materials and workmanship for a one (1) year period com-
mencing upon final acceptance.
It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that as recommended the
project be accepted as completed, and the motion was carried by the following Aye and No vote: those
voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vandeventer, and President
Pro-tempore Vollmer; those voting No, none.
Certificate of Completion on_SID No. 548 ~ First Phase Paving, ,9raf's Third Addition
The engineers of Thomas, Dean & Hoskins, Inc., on Special Improvement District No. 548 stating
the pavement and storm drain improvements in Grafls Third Addition by Long Cbnstruction Company has
been completed in accordance with the terms and the stipulations given in the plans and specification
for such work was presented.
The City Manager concurred in the recommendation of the engineers and recommended that the project
be accepted and approved by the City Cbmmission and final payment made. This final acceptance does

COMMISSION RESOLUTION NO. 1747
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, DECLARING IT TO BE THE
INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT
TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 557 FOR THE PURPOSE OF CONSTRUCTION
AND INSTALLATION OF A SANITARY SEWER LINE TO SERVE A PORTION OF THE BOZEMAN CREEK
ANNEXATION TO THE CITY OF BOZEMAN, MONTANA, MORE SPECIFICALLY DESCRIBED AS FOLLOWS:
AN EIGHT INCH SANITARY SEWER AND NECESSARY APPURTENANCES IN AN EASEMENT THROUGH
TRACTS 11 AND 12 OF THE BOZEMAN CREEK ANNEXATION TO BOZEMAN, MONTANA. THE CONSTRUC-
TION AND INSTALLATION OF SAID SANITARY SEWER IS TO INCLUDE ALL TRENCH EXCAVATION

New Rest Room Facilities for Lindley Park - Open Bids 17 September 1975
Plans and Specifications for the purpose of installation of new rest room facilities in Lindley
Park as prepared by BGS Architects, was placed before the Commission.
Upon recommendation of the City Manager, it was moved by Commissioner Taylor, seconded by
Commissioner Lehrkind, that the plans and specifications as presented be approved and that the Clerk
of the Commission be authorized and directed to publish a "Call for Bids" for the installation of the
