Montana 20 August 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 20 August 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy. Commissioner Vollmer, Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Taylor, City Manager Fryslie, and Assistant City Manager Wolf. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Mayor Sedivy waived the reading of the minutes of the regular meeting held on Wednesday. 13 August 1975, until next week. Assistant City Manager Appointed Acting Clerk of the Commission In the absence of the Clerk of the Commission, it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Assistant City Manager Wolf be appointed ActingC1erk of the Comm- ission, and the motion was carried by the following Aye and No vote: those voting Aye being Commiss- ioner Vollmer, Commissioner Vandeventer. Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Hearing. Resolution No. 1743 - Intent to Create STID No. 556, Lighting No. So. ,~l1ey, Bl!( 1 Brunton Palffy This was the time and place set for the hearing on Resolution No. 1743. the intent to create SILD No. 556 for the lighting of the North-South alley in Block 1 of the Brunton, Pal1Ey Rearrange- ment of a portion of Durston Subdivision. There was a written protest on hand representing approximately 16 percent of the district, and no other persons were present tovoice opinions in favor of or in opposition to the creation of such a district. The hearing was closed, and in concurrence with the recommendation of the City Manager, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Commission intend to create SILD No. 556 and that City Attorney Berg be instructed to prepare Resolution No. 1745 creating the district, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, and Mayor Sedivy; those voting No, none. Request to Build over Sanitary Sewer Line - Northgate Shopping Center A request for permission to build over a sanitary sewer line in the Northgate Shopping Area was brought before the Commission. Following a brief discussion, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the matter be tabled for a period of one week so that the Commission may obtain in- formation from the City Attorney, and the motion was carried by the followingAye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Repo!.t: Director of Public Service The City Manager commented on the report of the Director of Public Service and recommended that it be accepted and ordered filed. It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the report be accepted and ordered filed and the motion was carried by the following Aye and No vote: those voting Aye being Con~issioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No. none. Sidewalk Extensions and Abatements The following property owners requested sidewalk George Allen 523 North Church Avenue C. W. Sparks 511 North Wallace " N. E. Svejkovsky - 115 North Third " A thorough discussion followed, and it was moved by Commissioner Lehrkind, seconded by Commiss- variances as set forth: Leroy Ebright Hersel D. Moore - 206 North Montana 512 North Wallace ioner Vollmer, that the Commission concur in the recommendation of the City Engineer, also concurred in by the City Manager, and approve the above applications requesting sidewalk variances. and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. The following property owners requested sidewalk variances as set forth: Ray Tatarka 504 North Willson Ave E. L. Trent 304 North Black Avenue Herold E. Murdock - 404 North Seventh Avenue A thorough discussion followed, and it was moved by Commissioner Vollmer, seconded by Commiss- ioner Vandeventer, that the Commission concur in the recommendation of the City Engineer, also con- curred in by the City Manager, and deny the above application requesting sidewalk variances, and 3".40 I-J the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Adjournment There being no further business to come before the Commission at this time, it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the meeting be adjourned and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vande~ venter, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. 1 ~?'__~fU/4~ .
