HomeMy WebLinkAbout1975-08-13 I I I 33ri Bozeman, Montana 13 August 1975 The Commission of the City of Bozeman met in regular session in the Commission Room, Municipal Building, 13 August 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vandeventer, Commissioner Taylor, CommissionerVollmer,cCommissioner Lehrkind, City Manager Frys1ie, City Attorney Berg and the Clerk. Commissioner Vandeventer opened the meeting with a prayer and the following proceedings were had. Minutes of the regular meeting held on Wednesday, 6 August 1975, were approved as read. Minutes of the special meeting held on Monday, 11 August 1975, were approved as read. Appropriation Ordinance No. 955 for Final Adoption - Fiscal Year 1975-1976 The affidavit of publication of the annual Appropriation Ordinance for the fiscal year ending 30 June 1976 was presented with Appropriation Ordinance No. 955, entitled: ORDINANCE NO. 955 AN ORDINANCE APPROPRIATING MONIES FOR EXPENDITURES DEEMED NECESSARY AND IN ACCORDANCE WITH BUDGETARY REQUIREMENTS FOR MAINTENANCE ETC., OF THE MUNICIPAL GOVERNMENT OF THE CITY OF BOZEMAN, MONTANA, FOR THE FISCAL YEAR ENDING 30 JUNE 1976. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF BOZEMAN The City Manager stated that no moneh had been appropriated for the Ambulance Service, the Museum of the Rockies or the Parking Commission. Following a discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioper Vandeventer, that they increase the allocation for the maintenance of the Ambulance from $40.00 to $140.00 per month. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commiss- ioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. There being no other changes in the Ordinance since it had been provisionally passed the 23rd day of July, 1975, and a public hearing hav'ng been held on 6 August 1975, it was moved by Commiss- ioner Vandeventer, seconded by Commissioner Taylor, that Appropriation Ordinance No. 955 be finally passed and adopted and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Open Bids - Tractor Mower - Park Department (Hydrostatic Driven Rotary Lawn Mower) This was the time and place set for the opening of bids for a Hydrostatic Driven Rotary Lawn Mower for the Park Department. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. The following bids were then opened and read: Turf Aid Distributing Co., Billings $5,479.50 The bid of Turf Aid Distributing Co., of Billings being the only bid submitted, the Commission concurred in the recommendation of the City Manager, and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that Turf Aid Distributing Co., of Billings, Montana be awarded the bid for the New Hydrostatic Driven Rotary Lawn Mower for $5,479.50, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Taylor and Mayor Sedivy; those voting No, being Commissioner Vandeventer. . Opening of Bids - Babcock-Mendenhall Curb Project This was the time and place set for the opening of bids for the Curb project on Babcock and Mendenhall Streets. Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the bids be opened and read, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No being None. The following bids were then opened and read: Tom Haggerty General Contractor, Bozeman $194,884.55 w. D. Construction, Bozeman 217,714.75 The Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the bids be referred to the City 33G engineer and the consulting engineers for final tabulation, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Sale of Bonds - SID No. 547 - Storm Drain - Durston Road, $70,000.00 SID No. 553 - Storm Drain - Figgins Addn., $100,000.00 The City Manager stated that, according to the affidavit of publication, this was the time and place set for the bond sale of Special Improvement District Nos. 547 and 553. The Mayor and City Manager outlined the procedure for conducting this bond sale and stated that the amount of bonds to be sold for each district would be the same as the advertised amount and announced that the City was ready to conduct the bidding on the bonds of SID No. 547 in the amount of $70,000.00. A sealed bid submitted by D. A. Davidson and Company, Great Falls, Montana, along with a good faith check in the amount of $3,500.00 as prescribed by the "Notice of Sale", and bidding 8.00% plus a premium of $17.00 was opened and read. It was then announced that the City was ready to conduct oral bidding. First National Bank of Bozeman, having presented their good faith check in the amount of $3,500.00 as prescribed by the Notice of Sale and being the only oral bidder, bid 8;00% plus a premium of $10.00 as the lowest effective interest rate accruing to the City of Bozeman. The City Manager stated the bid of 8.00% plus the premium of $10.00 by the First National Bank was acceptable, and it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that the sale of the bonds for Special Improvement District No. 547 be awarded to The First National Bank at 8.00% plus the premium of $10.00, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commiss- ioner Vandeventer and Mayor Sedivy; those voting No, none. It was then moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the City was ready to conduct the sale of the bonds for Special Imprivement District No. 553 in the amount of $100,000.00, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. A sealed bid submitted by D. A. Davidson and Company of Great Falls, along with a good faith check in the amount of $5,000.00 as prescribed by the "Notice of Sale", and being the only bid submitted, bid 8.00% plus a premium of $23.00. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that D. A. Davidson and Company of Great Falls, be awarded the bid for the sale of the bonds at 8.00% plus a premium of $23.00, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor and Mayor Sedivy; those voting No, none. Consideration of Construction Bids - SID Nos. 547 and 553 The engineers representing consultants, Thomas, Dean and Hoskins, Inc., having completed their study of the bids submitted by Intermountain Construction, Bozeman, in the amount of $116,995.00 for the construction of SID No. 547, Trunk Storm Drain on Durston Road from North Eleventh to North Eighteenth Avenue and SID No. 553, Storm Drains on Langohr Avenue and a portion of Westridge Drive in Figgins Addition, and having prepared a final tabulation of the bid, recommended that the bid be awarded to Intermountain Construction Company on the basis of their low bid and the bid security of the unsuccessful bidders be returned. The Commission concurred with the recommendation of the engineers, also concurred in by the City Manager, and it was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that Intermountain Construction Company, Bozeman, be awarded the bid in the amount of $116,995.00 and that the bid security of the unsuccessful bidders be returne~ and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Ordinance No. 956 - Adoptionof Uniform Plumbing Code Ordinance No. 956 adopting the Uniform Plumbing Code was presented as follows: ORDINANCE NO. 956 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA, ADOPTING TIlE UNIFORM PLUMBING CODEJ 1973 EDITION AND 1974 AMENDEMENTS, AMENDING SECTIONS 20,15, THE REST RELATING TO BOND REQUIREMENTS AND SECTION 20,16, THEREOF, RELATING TO SEWER AND WATER LINE CONNECTIONS AND REPEALING ORDINANCE NO. 885 OF THE CITY OF BOZEMAN. Ordinance No. 957 - Adoption of Uniform Mechanical Code Ordinance No. 957 adopting the Uniform Mechanical Code was presented as follows: Ordinance No. 957 AN ORDINANCE OF THE CITY OF BOZEMAN, MONTANA ADOPTING THE UNIFORM MECHANICAL CODE, 1973 EDITION; REPEALING ORDINANCE NO. 914 OF THE CITY OF BOZEMAN AND ALL OTHER ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH. Following a discussion, it was moved by Commissioner Taylor, seconded by Commissioner Lehrkind, that Ordinance No. 957 be passed and adopted, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none. Right of Way Easements: a) Annie May Figgins, b) Montana National Bank as Trustee c) William E. Gilbert, d) Bozeman School District No.7. Easement and Right of Way Agreements from Annie May Figgins, Montana National Bank as Trustee, William E. Gilbert and Bozeman School District No.7, for the purpose of installing, operating, using, repairing, replacing, maintaining, and removing a storm sewer and appurtenances and for such other rights of access and incidental rights thereto upon and across various properties located within the City of Bozeman at no cost to the City of Bozeman, were presented. Following a discussion, the Commission concurred with the recommendation of the City Manager, and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the Right of Way Agree- ments, having been executed by the property owners, be approved and the Mayor and Clerk of the Comm- ission be authorized to sign for the City, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Vandeventer, Commissioner TayLor and Mayor Sedivy; those voting No, none. License Bond - Plumber and Gas Fitter - Western Plumbing and Heating In compliance with Chapter 16 of the Bozeman Municipal Code, the Plumber and Gas Fitter Bond of Western Plumbing and Heating was presented. The City Manager stated the Building Inspector had recommended approval of the bond and the City Attorney had approved the bond as to form. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the above bond be approved, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Application for Temporary Beer License - Bozeman Softball Association A request from the Bozeman Softball Association for permission to obtain a City Beer License for the weekend of 16-17 August, along with the required fee was presented. It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the Bozeman Softball Association, having met all requirements, be granted a license to sell beer at the Recrea- tion Complex, and the motion was carried by the following Aye an~ No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. Change Order No. G1 - Swimming Pool - Edsall Construction, $1,390.00 Change Order No. 1P - Swimming Pool - Bruce Anderson Co., Inc., $31,905.33 Change Order No. G-l and 1-p on the construction of the New Municipal Pool as prepared by William E. Grabow of BGS Architects, Bozeman, to become a part of the Original Contract were presented as fa llows : Edsall Construction - Bozeman Bruce Anderson Co, - Bozeman Change Order No. &-1, Furnish labor and Material - $ 1,390.00 " " No. l-P, " " " II "31,905.33 The City Manager concurred with William E. Grabow of BGS Architects, and recommended that Change Order No. G-1 and I-P be accepted as presented. Naming of Three Softball Fields - New Recreation Complex It was moved by Commissioner Vandeventer, seconded by Commissioner Taylor, that the three soft- ball fields at the New Recreation Complex be named after Gary Richards, Clayton Linebarger and Ingolf Johnson, and the motion was carried by the following Aye and No vote: those voting Aye being Comm- issioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No being Commissioner Taylor. Request for Change to Subdivision Regulations - Charles R. Swart The request from Charles R. Swart, requesting the City of Bozeman to reconsider those portions of the local subdivision regulations which deal with the use of the examing land surveyor, and to delete those portions requiring the use of an examining land surveyor on all ~lats and certificates of survey within the jurisdiction of the City Commission, having been taken under advisement and a public hearing scheduled for Wednesday, 13 August, was again presented. Following a discussion, it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, I I I I that the request for the hearing be denied. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer, Commissioner Taylor and Mayor Sedivy; those voting No being Commissioner Vandeventer. Consideration of Construction Bids - Babcock and Mendenhall Curb Project The engineers representing consultants, Thomas, Dean and Hoskins, Inc., and the engineering staff, having completed their study and having prepared a final tabulation of the bids submitted, recommended that both bids be rejected. The City Commission concurred in the recommendation of the engineers, also concurred in by the City Manager, and it was moved byCommissioner Vandeventer, seconded by Commissioner Taylor, that the Commission reject the construction bids submitted and readvertise for the construction of the Babcock and Mendenhall Curb Project again in 1976. The motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those voting No, none. It was moved by Commissioner Vollmer, seconded by Commissioner Vandeventer, that the claims be approved as presented, and the motion was carried by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Vandeventer, Commissioner Taylor, Commissioner Lehrkind and Mayor Sedivy; those voting No, none. Reports - Held for Review Commissioner Vandeventer recommended that all reports be given to the Commission for a week's review and presented for discussion the following week.
