The Commission of the City of Bozeman met in regular session in the Commission Room. Municipal
Building, 6 August 1975, at 1:15 o'clock p.m. Present were Mayor Sedivy, Commissioner Vollmer.
Commissioner Vandeventer. Commissioner Lehrkind, City Manager Fryslie, Assistant City Manager Wolf,
City Attorney Berg and the Clerk.
Commissioner Vollmer opened the meeting with a prayer and the following proceedings were had:

This was the time and place set for opening bids for the installation of trunk storm drain
on Durston Road from North 11th to North 18th Avenue SID No. 547, and for the construction of
Storm Drains on Langohr Avenue and a portion of Westridge Drive in Figgins Additio~ SID No. 553.
Affidavit of publication of "Notice to Bidders" was presented. It was moved by Commissioner Vollmer.
seconded by Commissioner Vandeventer. that the bids be opened and read and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner
Vandeventer. Commissioner Lehrkind and Mayor Sedivy; those voting No, none.
The following bids were then opened and read:

The Commission concurred with the recommendation of the City Manager and it was moved by
Commission Vandeventer. seconded by Commissioner Lehrkind, that the bids be referred to the
engineers representing Thomas. Dean & Hoskins, and the City engineering staff for final tabulation.
consideration and recommendation on Wednesday. 13 August 1975. and that the bid security checks
be returned to all but the three lowest bidders.
The motion was carried by the following Aye

This was the time and place set for public hearing on the appropriations Ordinance No. 955
for the fiscal year ending 30 June 1976. Affidavit of publication of Notice of Hearing was
presented. No formal protests had been filed in opposition to the adoption and passage of the
proposed ordinance and accompanying annual appropriation budget. Several persons interested in
the proposed budget were present to discuss same and express their feelings.
Following a thorough discussion. the Mayor declared the hearing on Ordinance No. 955 closed
and it was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer. that the Clerk of
the Commission be authorized and directed to publish the ordinance as required by law. Section
11-3319. R.C.M.. 1947 and the motion was carried by the following Aye and No vote: those voting
Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner Vandeventer and Mayor Sedivy;
those voting No, none.

A letter received from Charles R. Swart requesting the City of Bozeman to reconsider those
portions of the local subdivision regulations which deal with the use of the examining land surveyor,

and to delete those portions requiring the use of an examining land surveyor on all plats and
certificates of survey within the jurisdiction of the City Commission, was presented.
Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner Lehrkind,
that the request for checking plats and certificates of survey be taken under advisement and a

public hearing scheduled for Wednesday, 13 August 1975. The motion was carried by the following
Aye and No vote: those voting Aye being Commissioner Vollmer, Commissioner Lehrkind and Mayor Sedivy;
those voting No being Commissioner Vandeventer.

The City Manager presented an application from the KXXL Softball Team, along with the required
fee. for a raffle to be held on 8 August 1975.
Upon recommendation of the City Manager. it was moved by Commissioner Vandeventer, seconded
by Commissioner Lehrkind. that they approve the application for the Raffle to be held on 8 August
1975 and the motion was carried by the following Aye and No vote:

Applicat~~on for Temporary Beer License - C.allatin Empire Lions club
A request from the Gallatin Empire Lions Club for permission to obtain a City Beer License
for the weekend of 9-10 August 1975. along with the required fee was presented.
It was moved by Commissioner Lehrkind. seconded by Commissioner Vollmer, that the Gallatin
Empire Lions Club, having met all requirements. be granted a license to sell beer at the North

Grand Park on the weekend of 9-10 August. and the motion was carried by the following Aye and
No vote: those voting Aye being Commissioner Lehrkind, Commissioner Vollmer. Commissioner
Vandeventer and Mayor Sedivy; those voting No, none.
Proposal to Name Fields at Recreation Complex (new)
A letter adressed to the Bozeman Recreation Director from the Bozeman Softball Association,
with a proposal for naming of two softball fields at the New Recreation Complex. was presented.
Larry Aasheim, President of the Bozeman Softball Association was also present and stated
that the complex should never have become a reality without the time and efforts of Gary Richards
and Clayton Linebarger and the Softball Association would like to acknowledge their efforts
by naming two of the fields after Gary Richards and Clayton Linebarger.
It was also felt that since Ingolf Johnson was a pioneer of the Softball era the third field
should be named after him.
Following a discussion, it was moved by Commissioner Vollmer, seconded by Commissioner
B. P. Hennessy - Rainbow Motel. 510 North Seventh Avenue
Katheryn A. Miller 210 North Church Avenue
Montie Stanhope, Color World of Montana - 201 East Mendenhall
Vandeventer. that the Commission acknowledge receipt of the request and report, and that action
be continued for a period of one week. The motion was carried by the following Aye and No vote:

The following property owners requested sidewalk variances as set forth:

A thorough discussion followed and it was moved by Commissioner Vandeventer, seconded by
Commissioner Lehrkind, that the Commission concur in the recommendation of the City Engineer,
also concurred in by the City Manager, and approve the above applications requesting sidewalk
variances and the motion was carried by the following Aye and Novate: those voting Aye being
Commissioner Vandeventer, Commissioner Lehrkind, Commissioner Vollmer and Mayor Sedivy; those
voting No, none.

The City Manager requested authorization to call for bids for the purchase of five police
cars to be used by the Police Department and to be opened on 27 August 1975.
It was moved by Commissioner Lehrkind, seconded by Commissioner Vollmer, that the purchase
of the five vehicles for use by the Police Department be authorized and the Clerk of the Commission
be directed to issue a "Call for Bids" to be opened on 27 August, and the motion was carried
by the following Aye and No vote: those voting Aye being Commissioner Lehrkind, Commissioner
Vollmer, Commissioner Vandeventer and Mayor Sedivy; those voting No, none.

Mayor Sedivy introduced former Mayor Charles Sorenson and thanked him on behalf of the City
Commission for attending the meeting.
Ralph Dunahog_...::.."Res~:..&..ning to Accept Another Job
Ralph Dunahoo appeared before the Commission to express his thanks for the support and con-
sideration given him during his employment with the City of Bozeman.
Mayor Sedivy on behalf of the City Commission, paid tribute to Ralph Dunahoo and wished
him every success in his new job.
